RUEASE OF EASEMENT
WHEREAS, Orlando Iacovelli, 347 Coddington Road, Ithaca, New
York, 14650, is the owner of Town of Ithaca Tax Parcel
53.-1-14.1, and
WHEREAS, the Town of Ithaca, a municipality with offices at
126 East Seneca Street, Ithaca, New York, is the holder of a
permanent right-of-way to enter upon, construct, operate, maintain,
repair and replace a sanitary sewer pipeline and appurtenances,
across or upon this parcel, as set forth in the easement from
Orlando Iacovelli dated November 21, 1990, recorded in the Tompkins
County Clerk's Office in Book 660 of Deeds at page 399, and
WHEREAS, the location of the easement is depicted on the
annexed drawing entitled "Permanent and Temporary Easements for
Sewer Main Through the Lands of Tax Parcel #53-1-14.1 Town of
Ithaca Sewer System, Tompkins County, New York, recorded in said
Clerk's office in Book 660 of Deeds at page 401, and
WHEREAS, access to the sanitary sewer is now provided by a
permanent easement through the lands of Tax Parcel 53.-1-14.2, as
set forth in the easement from Lillian Raponi, 341 Coddington Road,
Ithaca, New York, dated December 13, 1993, recorded in. said Clerk's
office in Book 716 of Deeds at page 122,
NOW, THEREFORE, in consideration of the premises and the
circumstances related therein, the Town of Ithaca hereby releases
to Orlando Iacovelli, his successors and assigns, all right, title
and interest it has in and to the permanent right-of-way to enter
upon, construct, operate, maintain, repair and replace a sanitary
sewer pipeline and appurtenances, across or upon this parcel, as
conveyed to said Town by instrument recorded in the Tompkins County
Clerk's office in Book 660 of Deeds at page 399.
