WAYNE, residing at 201 Roat Street, Ithaca, New York, party of the second part, WITNESSETH, that the party of the first part, in consideration of One Dollar ($1,00) lawful money of the United States, and other good and valuable consideration paid by the party of the second part, does hereby remise, release and quitclaim unto the party of the second part, his heirs, distributees and assigns forever such right, title and interest as the party of the first part may have, if any, in and to ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, Tompkins County, State of New York, bounded and described as follows: COMMENCING at a point in the southerly street line of Roat Street, which is located the following three courses and distances from the intersection of the present center line of Orchard Street with the center line of Roat Street; 1. easterly along the center line of Roat Street a distance of 27.9 feet, more or less, to a point; 2. thence S 06 degrees 00, W a distance of 25.0 feet to a pipe; 3. N 83 degrees 41, W a distance of 25.0 feet to the point or place of beginning; running thence S 06 degrees 00, W a distance of 367.3 feet to a point; running thence N 84 degrees 15, W a distance of 24.1 feet to a pipe in the easterly line of premises of the grantee herein; running thence northerly along the easterly line of grantee's premises to a tall pipe in the southerly street line of Roat Street; running thence S 83 degrees 41' E along the southerly street line of Roat Street a distance of 24.6 feet to the point or place of beginning. It is the intention to describe and convey the westerly portion of the premises designated as Orchard Street lying southerly of Roat Street, which street was shown on a subdivision map by Carl Crandall, C.E., dated October 27, 1953, entitled "MAP OF JAMES KRIZER LOTS..." but never opened or dedicated for public purposes. The parcel above described is the westerly portion of the premises shown and designated as "ORCHARD STREET (UNOPENED) - NOT DEDICATED" on a survey map by T.G. Miller, P.C., Engineers & Surveyors, dated February 28, 1994, entitled "SURVEY MAP NO. 117 ROAT STREET, TOWN OF ITHACA, TOMPKINS CO., NEW YORK", a copy of which map is recorded in the Tompkins County Clerk's Office in Book 723 of Deeds at page 213 and which map is incorporated herein by reference. RESERVING, however, to the Town of Ithaca the easement for drainage and water discharge purposes granted to the Town by the grantee herein and Brent M. Kloster and Amy E. AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
