THIS INDENTURE
Made the ,)(�?N day of July, Nineteen Hundred and Ninety-four
BETWEEN
THE TOWN OF ITHACA, a municipal corporation located in
Tompkins County, with offices at 126 East Seneca Street,
Ithaca, New York, .
party of the first part, and
BRENT N. KLOSTER and AMY X. KLOSTER, husband and wife,
both residing at 117 Roat Street, Ithaca, New York,
as tenants by the entirety,
parties of the second part,
WITNESSETH, that the party of the first part, in consideration of
One Dollar ($1.00) lawful money of the United States, and other
good and valuable consideration paid by the parties of the second
part, does hereby remise, release and quitclaim unto the parties of
the second part, the survivor, his or her heirs, distributees and
assigns forever such right, title and interest as the party of the
first part may have, if any, in and to
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca,
Tompkins County, State of New York, bounded and described as
follows:
COMMENCING at a pipe in the southerly street line of Roat
Street, which is located the following two courses and distances
from the intersection of the present center line of Orchard Street
with the center line of Roat Street;
1. easterly along the center line of Roat Street a distance
of 27.9 feet, more or less, to a point;
2. thence S 06 degrees 00, W a distance of 25.0 feet, more
or less, to the point or place of beginning;
running thence S 06 degrees 00, W a distance of 367.1 feet to a
point marked by a pipe; running thence N 84 degrees 15, W a
distance of 25.0 feet to a point; running thence N 06 degrees 00'
E a distance of 367.3 feet to a point in the southerly street line
of Roat Street; running thence S 83 degrees 41, E along the
southerly street line of Roat Street a distance of 25.0 feet to the
point or place of beginning.
It is the intention to describe and convey the easterly
portion of the premises designated as Orchard Street lying
southerly of Roat Street, which street was shown on a subdivision
map by Carl Crandall, C.E., dated October 27, 1953, entitled "MAP
OF JAMES KRIZER LOTS..." but never opened or dedicated for public
purposes.
The parcel above described is the easterly portion of the
premises shown and designated as "ORCHARD STREET (UNOPENED) - NOT
DEDICATED" on a survey map by T.G. Miller, P.C., Engineers &
Surveyors, dated February 28, 1994, entitled "SURVEY MAP NO. 117
ROAT STREET, TOWN OF ITHACA, TOMPKINS CO., NEW YORK", a copy of
which map is recorded in the Tompkins County Clerk's Office in Book
2Z2 of Deeds at page 213 and which map is incorporated herein by
reference.
RESERVING, however, to the Town of Ithaca the easement for
drainage and water discharge purposes granted to the Town by the
grantees herein and Randy 0. Wayne intended to be recorded
concurrently herewith.
TOGETHER with the appurtenances and all the estate and rights y

TO HAVE AND TO SOLD the premises herein granted unto the
parties of the second part, the survivor, his or her heirs,
distributees and assigns forever.
AND the party of the first part, in compliance with Section 13
of the Lien Law, hereby covenants that the party of the first part
will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any
other purpose.
IN WITNESS WHEREOF, the party of the first part has caused its
corporate seal to be hereunto affixed, and these presents to be
signed by its duly authorized officer this day of July, 1994.

personally appeared JOHN WHITCOMB, to me personally known, who
being by me duly sworn, did depose and say that he resides in
Ithaca, New York; that he is the Supervisor of THE TOWN OF ITHACA,
the municipal corporation described in, and which executed the
within Instrument; that he knows the seal of said corporation; that
the seal affixed to said Instrument is such corporate seal; that it
was so affixed by order of the Board of Trustees of the Town; and
that he signed his name thereto by 1, a rder.
