Ithaca, New York, 14830,
party of the first part, and
THE BARDEN & ROBESON CORPORATION of 26 Copeland Avenue, Homer, New
York, 13077,
party of the second part,
WITNESSETH, that the party of the first part in consideration of One and 0(/100 Dollars
($10)), lawful money of the United States, and other good and valuable consideration, paid by
the party of the second part, does hereby remise, release and quitclaim unto the party of the
second pan, its successors and assigns forever, the temporary casement for ingress and egress for
emergency vehicles described in Schedule "B" in an instrument from Chase Farm Associates to
the Town of Ithaca dated March 22, 1991 and recorded March 26,1991 in Book 660 of Deeds
at page 1020 in the Tompkins County Clerk's Office.
RESERVING THEREFROM a temporary easement for ingress and egress for emergency
vehicles and for construction vehicles over the properties described in Schedule "A attached
hereto. This temporary easement shall continue until such time that the road for the proposed
Chase Farm Subdivision - Phase Two is completed and dedicated or such lesser time that the
parties hereto and/or their successors in interest may agree. At that time, the grantor herein shall
execute a release of the temporary easement set forth in Schedule "A" herein.
It is the intention of this instrument to release the easement heretofore conveyed to the
Town of Ithaca, as set forth above, and replace it with a temporary easement described in
Schedule "A" attached hereto.
TOGETHER with the appurtenances and all the estate and rights of the party of the fines
part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
Its successors and assigns forever.
SUBJECT to the Trust Fund provisions of Section 13 of the Lien Law.

SCHEDULE A
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of
Tompkins and State of New York, being part of Military Lot 99 and more particularly described
as follows:
BEGINNING at a point in the southerly line of King Road East, said point being the
northeast comer of subdivision lot 8, as said lot is shown on "The Final Plat of Chase Farm
Subdivision - Phase I", prepared by George Schlecht, P.L.S., dated January 19, 1989; thence
southerly along a curve to the left, having a radius of 100.00 feet, an arc distance of 51.27 feet
to a point; thence south 18 degrees 53 minutes 48 seconds west a distance of 198.75 feet to a
point in the southerly line of said Lot 8; thence along the southerly line of Lot 8 north 48 degrees
57 minutes 11 seconds west a distance of approximately 22.00 feet to a point; thence running
generally northerly and parallel to the first two above described courses and 20 feet distant
therefrom to a point in the southerly line of King Road East; thence south 55 degrees 15 minutes {
11 seconds east a distance of approximately 20.00 feet to the point of beginning. It is the
intention to describe a strip of land 20 feet in width running from King Road East to the
southerly line of Lot 8.
