QUICK of 1564 Slaterville Road, Ithaca, New York 14850 party of the first part, and TOWN OF 1THACA, a municipality of the State of New York, of 126 East Seneca Street, Ithaca, New York, 14850 party of the second part, WITNESSETH, that the party of the first part, in consideration of One and O0/100 Dollar ($1.00), lawful money of the United States, and other good and valuable consideration, paid by the party of the second part, does hereby grant and release unto the party of the second part, its heirs, successors, legal representatives and assigns forever, ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of Tompkins, State of New York, being located on Slaterville Road, being intended to be an extension of Park lane and being more particularly described on Schedule A annexed. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, its heirs, successors, legal representatives and assigns forever. AND said party of the first part covenants as follows: FIRST: That the party of the second part shall quietly enjoy the said premises. SECOND: That said party of the first part will forever warrant the title to said premiss. THIRD: That, in compliance with Section 13 of the Lien Law, the grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to he applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. Tompkins County, New York, being more particularly described as follows: Commencing at a point in the northeasterly line of Route 79, Slaterville Road. which point of beginning is south 40° 54' 13" east 100 feet from the most southerly comer of premises conveyed to Theodore A. English and Deborah L. English by deed of Barbara P. Quick dated June 30, 1977, recorded in the Tompkins County Clerk's office in Book 558 of Deeds at Page 931; running thence north 49" 47' 11" east a distance of 157.60 feet to an iron rod; running thence on a slight curve to the left with a radius of 160.0 feet, chord bearing north 48° 26' 17" east, a chord distance of 7.53 feet and an arc distance of 7.53 feet to an iron rod and cap; running thence on a further curve to the left with a radius of 160.0 feet, a chord bearing north 12° 19' 07" east a chord distance of 182.50 feet and an arc distance of 194.20 feet to an iron rod; running thence north 22° 27' 09" west a distance of 169.18 feet to an iron rod which iron rod is in the boundary of premises owned by the grantor and premises reputedly owned by William Frandsen (690 Deeds 680); running thence north 82° 46' 47" west along the Frandsen boundary a distance of 103.86 feet to an iron rod; running thence south 27° 50' (X)" cast 164.26 feet to an iron rod; running thence on a curve to the right with a radius of 190.0 feet a chord bearing south 15" 56' 30" west and a chord distance of 262.89 feet an arc distance of 290.33 feet to an iron rod; running thence south 59° 43' (X)" west 180.0 feet to an iron rod set in a north line of Route 79 which iron rod is north 40° 54' 16" west along the north line of Route 79 a distance of 156.41 feet from a highway marker; running thence north 40° 54' 14" west along the north line of Route 79 80.0 feet to the point or place of beginning. It is the intention of this conveyance to convey the premises shown as "Park Lane" on a map entitled "Subdivision Plat, Owner: Barbara P. Quick" made by Stockwin Surveying, dated October 21, 1993 a copy of which map was filed in the Tompkins County Clerk's Office on September 30, 1994, in map drawer X. page 17. An casement 20.0 feet in width for the construction, maintenance and replacement of a diversion ditch as shown on said map running southeasterly from the southeasterly line of Park Lane and substantially parallel to Route 79 to the southeasterly boundary of premises owned by the grantor. 3. An easement 20.0 feet in width for the construction and maintenance of a sanitary sewer line as shown on said subdivision map which casement runs southwesterly from the westerly line of Park Lane to the approximate northerly corner of premises conveyed to English by the deed referred to above, said easement being 20.0 feet in width the centerline of which is the actual centerline of the sanitary sewer as located. 4. An easement 20.0 feet in width for the construction and maintenance of a sewer line as shown on said subdivision map which casement runs across grantor's property starting at a point in a northerly line of the grantor's property which point is located north 82° 46' 47" west 145 feet from the northwest corner of Park Lane as described above, said easement running thence southerly to intersect with the sewer casement referred to in paragraph 3 above. There is also granted an additional 15.0 feet on either side of said sewer easement for the purposes of constructing the sewer line. The sewer easements granted above are for the purposes of constructing, maintaining, repairing, and replacing sanitary sewer lines and related facilities including electrical lines, pumps, and metering devices and are granted in perpetuity to the grantee. In granting the easements herein grantor agrees, for herself, her heirs, successors and assigns, not to construct any improvements on said easements except as the same may be approved by and consented to by the grantee. Subject to the following insofar as the same may affect the above described premises: 1. An easement for a gas pipeline granted to New York State Electric and Gas Corporation by instrument dated July 22, 1952, recorded December It, 1952 in said clerk's office in Book 354 of Deeds at page 517. 2. An easement for a gas pipeline granted to New Yak State Electric and Gas 4 . l IltR 740 not 4 t om.NOIV►sh►..J.iMA:a*• Corporation by instrument dated August 30, 1956, recorded October 30, 1956 in said clerk's office in Book 392 of Deeds at page 483. Grantee, in accepting this deed, agrees to permit grantor to have a curb cut on the easterly side of Park Lane as described above to provide access to remaining lands of grantor to the east of Park Lane. The location of the curb cut is to be substantially where the "rip rap" is shown on the above mentioned subdivision map. Being a portion of the premises described in two deeds: first, a deed from Elnora Palmer Dunlap and Maude P. Hungerford to T. Raymond Palmer recorded in said clerk's office in Book 181 of Deeds at page 218; and second, a parcel of former railroad property conveyed by Florence Hart to T. R. Palmer by deed recorded in said clerk's office in Book 308 of Deeds at page 517. T. Raymond Palmer died intestate April 8. 1962, leaving as his only heirs at law and next of kin, Vivian 1. Parker, Raymond A. Palmer, and Barbara P. Quick. Vivian 1. Parker and Raymond A. Palmer conveyed their interest in the premises described in said deeds to Barbara P.
