Box DH, Ithaca, New York 14853, party of the first part, and W TOWN OF ITHACA, 123 East Seneca Street, Ithaca, New York 14850, party of the second part, WTTNESSETH: That the party of the first part, in consideration of One 00/100 Dollars ($1.00) lawful money of the United States and other good and lawful consideration receipt of which is hereby acknowledged paid by the party of the second part, does hereby remise, release and quitclaim unto the party of the second part, and by these presents does grant and release unto the party of the second part, their heirs, successors and assigns forever, a right of way or easement for the purpose of pedestrian access and egress from the westerly line of the Hackberry Lane Cut De Sac and running thence westerly along the 25 foot wide road access conveyed to Cornell University by Deed of Coy Glen Associates, Inc., dated December 11, 1990 and recorded in the Tompkins County Clerk's Office on December 12, 1990, in Liber 659 of Deeds at page 142, as shown on a survey map for Hackberry Lane Subdivision prepared by George Schlecht, P.E. & L.S., dated August 4, 1989 and filed in the Tompkins County Clerk's Office in Drawer O at Page 28-29 and on which survey map the premises subject to the right of way or easement is shown as "25 foot wide road access to be deeded to Cornell University". This grant is intended for the benefit of and as an easement appurtenant to that land in the Town of Ithaca, County of Tompkins, State of New York, shown on the survey map as "Hackberry Lane" and which lands are more particularly described in a deed from Coy Glen Associates to the Town of Ithaca, dated Aug. _, 1992 to be recorded concurrently herewith. The right of way or easement granted herein shall be 25 feet in width along its course. The right of way or easement granted herein is for the purpose of providing pedestrian access and egress to any existing public or quasi public uses in the Cornell property adjoining the right of way or easement to the west and for the purpose of providing pedestrian access and egress in the - event there is any future extension or construction of such trailways or walkways.
