Citizens Savings Bank, F.S.B., a federally chartered savings bank with offices at 118 North Tioga Street, Ithaca, New York, became the owner of Lot 14 - Chase Farm Subdivision - Phase One, located in the Town of Ithaca, Tompkins County, New York, by virtue of a Referee's Deed dated April 10, 1992, recorded in the Tompkins County Clerk's Office in Book 673 of Deeds at page 46, and WHEREAS, Citizens Savings Bank, F.S.B. transferred such lot to Eilia Jahjah and Samira Jahjah by deed dated June 17, 1992, recorded in the Tompkins County Clerk's Office in Book 677 of Deeds at Page 249, and WHEREAS, the Town of Ithaca, a municipality with offices at 126 East Seneca Street,// Ithaca, New York, is the holder of a temporary easement for ingress and egress for emergency vehicles and for construction vehicles over Lot 14 as set forth in the easement from Chase Farm Associates dated March 22, 1991, recorded in said Clerk's Office in Book 660 of Deeds at page 1020, and WHEREAS, the location of the easement is depicted on the annexed survey entitled 'Resurvey of Lot 14 - Chase Farm Subdivision - Phase One% prepared by George Schlecht, dated May 12, 1992, and WHEREAS, construction access to the lots in Chase Farm Subdivision is now available over public roadways dedicated to and accepted by the Town of Ithaca, . NOW, THEREFORE, in consideration of the premises and the circumstances related therein, the Town of Ithaca hereby releases.to Eilia Jahjah and Samim Jahjah, the survivor of them, their successors and assigns, all right, title and interest it has in and to the temporary construction entrance for ingress and egress for construction vehicles over Lot 14, Chase Farm Subdivision - Phase One as conveyed to said Town by instrument recorded in Book 660 of Deeds at page 1020, reserving, however, to the Town of Ithaca the continued easement for ingress and egress by emergency vehicles as set forth in the deed from Chase Farm Associates to the Town of Ithaca referred to above.
