New York Telephone Company acknowledges that it is a Grantee of an easement granted from Charles N. Drake, dated June 21, 1985, and recorded in the Tompkins County Clerk's office on July 10, 1985 in Liber 610 of Deeds at page 4301 and is also Grantee of an easement granted by Robert A. Drake, dated June 21, 1985, and recorded July 10, 1985 in the Tompkins County Clerk's office in Liber 610 of Deeds at page 432. 2. Notwithstanding the terms of paragraph "SECOND" of both such easements, any roadway, lying within the areas described on Schedule A annexed hereto and made a part hereof (the "Easement area"), that is conveyed to the Town of Ithaca as a public road, shall be permitted to remain as a public road in the easement area and used as a public road, and the Town of Ithaca shall, without any further consent of New York Telephone Company, be permitted to maintain and use such roadways as public roadways, including in connection with the construction, maintenance, improvement, or other work usually performed by or on behalf of the Town of Ithaca on the subject roadways. 3. This agreement is being executed for the purpose of inducing the Town of Ithaca to accept dedication of said roadways by providing for the release or removal of any encumbrance on the title to the easement area, as described in Schedule A, which encumbrance could have been created by the terms of paragraph SECOND of the above described easements, and the undersigned acknowledges that the Town of Ithaca will rely on this agreement. PARCEL II ALSO ALL THAT TRACT OR PARCEL OF LAND situate in the Town of , Ithaca, County of Tompkins and State of New York, BEGINNING at a point marked by an iron pipe in the easterly line of the above described northerly extension of Woodgate Lane, which point is North 100 56' East, a distance of 406.30 feet measured.along the easterly line of the said northerly extension of Woodgate Lane from the northeast corner of the existing Woodgate Lane (which corner is the point of beginning of the above described parcel); thence South 65° 55' East, a distance of 282.5 feet to a point marked by an iron pipe; thence South 660 52' East, a distance of 201 feet to a point marked by an iron pipe; thence South 620 38' East, a distance of 192.09 feet to a point marked by an iron pipe; thence curving to the southeast an arc distance of 157.78 feet on. a radius of 216.09 feet to a point marked by an iron pipe, which point lies South 410 43' East, a distance of 154.29 feet from the last mentioned point marked by an iron pipe; thence North 69° 12' East, a distance of 60 feet to a point marked by an iron pipe; thence curving in a northwesterly direction an arc distance of 201.58 feet on a radius of 276.09 feet to a point marked by an iron pipe, which point lies North 410 43' West, a distance of 197.13 feet from the last mentioned point marked by an iron pipe; thence North 620 38' West, a distance of 196.52 feet to a point marked by an iron pipe; thence North 660 52' West, a distance of 200 feet to a point marked by an iron pipe; thence North 65' 55' West, a distance of 296.53 feet to a point marked by an iron pipe, which point is located in the easterly boundary line of the above described northerly extension of Woodgate Lane; thence South 100 56, West, a distance of 61.62 feet to the point and place of beginning. The above described premises being known as Max's Drive. ALSO for right-of-way purposes only a 60-foot-wide turnaround area a extending in a northerly direction off Max's Drive as described above, the westerly boundary line of said temporary turnaround being 100 feet feet, in length and the width of the temporary turnaround being 60 all as shown on a survey map referred to below. This right-of-way shall terminate at any point in the future when Max's Drive is extended so as to connect with any other public street, or when said right-of-way is no longer needed by the Town of Ithaca as a turnaround area. Both of the above described parcels, as well as the temporary turnaround described above, are described and are to be conveyed as shown on a certain survey map labeled "Map Showing Extension of Woodgate Lane and Proposed Max's Drive" by James P. McNamara, Registered Land Surveyor, No. 49355, dated May 11, 1990, a copy of which survey map is being filed in the Tompkins County Clerk's office concurrently herewith.
