paid by the party of the second part, does hereby remise, release and quitclaim
unto the party of the second part, its successors and assigns forever, all
THAT TRACT OR PARCEL OF LAND, situate in the Town of Ithaca, County
of Tompkins, State of New York and described as follows:
Any interest the Town of Ithaca may have in that portion of
Remington Road in said Town heretofore constructed by Jared T.
Newman, all as shown on a map of the Cayuga Heights Region made by
Carl Crandall, C.E., April 1, 1936 and revised January 11, 1937,
filed in the Tompkins County Clerk's Office in January of 1937, to
wit: That portion of the 50 foot wide Remington Road located in
the Town of Ithaca commencing at the boundary line between the Town
of Ithaca and the Village of Cayuga Heights and running southerly
approximately 1700 feet to its intersection with the right of way
line of East Lake Road.
It is the intent of the parties that the Town of Ithaca convey
all of its interest in any portion of Remington Road owned by it
running from its boundary with the Village of Cayuga Heights to its
intersection with East Lake Road and particularly the westerly half
of said road. It being understood that the eastern half is already
owned by the Village by reason of the Annexation Proceedings filed
in the Tompkins County Clerk's Office on April 7, 1953 in Liber 11
of Hiscellaneous Records at page 504.
The Town Board of the Town of Ithaca by resolution duly
adopted on the 3rd day of October, 1991 and the Trustees of the
Village of Cayuga Heights by resolution duly adopted on January
21, 1991, have agreed that the cost of improving said highway shall
be borne solely by the Village of Cayuga Heights and the residents
of the "Remington Roadway Special Highway Assessment District," now
and hereafter and not by the Town of Ithaca.

by me duly sworn, did depose and say that she resides at 139 Pine Tree
Road, Ithaca, New York, and that she is the Supervisor of the Town of
Ithaca, who executed the within instrument; and she acknowledged to
me that she executed the same, and that such execution was on behalf
of the Town of Ithaca and that the Town Board of such Town duly
authorized such execution. /I _
