THIS INDENTURE

BETWEEN CHASE FARM ASSOCIATES, a Limited Partnership, with offices at 108
Ridgecrest Road, Ithaca, New York, 1.4850,
party of the first part, and
THE TOWN OF ITHACA, 126 East Seneca Street, Ithaca, New York 14850
party of the second part.
WITNESSETH, that the party of the first part, in consideration of One and no/100
Dollar, lawful -money of the United States, and other good and valuable considerations
($1.00 ogvc), paid by the party of the second part, does hereby grant and release unto
the party of the second part, its heirs and assigns forever,
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Ithaca, County of
Tompkins and State of New York, known and designated as CHASE LANE and LAGRAND
COURT as set forth on a survey map of George Schlecht, dated January 9, 1989 and
filed February 22, 1989 in the Tompkins County Clerk's Office Drawer M Sheets 87 &
88, which said streets are further according to the aforesaid survey map as follows:
COMMENCING at an iron pin marking the intersection of the southeasterly line of
Chase Lane and the southwesterly line of King Road East, which said iron pin is located
865.11 + westerly, as measured along the southerly and southwesterly line of King Road
East from its intersection with the westerly line of Ridgecrest Road; thence the
following courses and distances.
1. S 34" 01' 07" W 81.18 feet to a point;
2. Thence on a curve to the left with a radius of 360 feet an arc distance of
515.84 feet;
3. S 48" 04' 45" E a total distance of 319.18 feet;
4. Thence on it curve to the right with it radius of 320.00 feet, a total arc distance
of 525.39 feet;
5. S 45' 59' 29" W a total distance of 244.48 feet;
6. Thence along a curve to the left with a radius of 270.063 feet, an arc distance
of 261.44 feet;
THENCE S 80" 31' 32" W diagonally across the aforesaid Chase Lane a distance of 7,0
feet to the westerly line of the aforesaid Chase Lane;
THENCE the following four courses in distances along the westerly, northwesterly
and northerly line of Chase Lane;
1. On a curve to the right, with a radius of 340.063 feet, a total arc
distance of 329.20 feet;
2. N 45" 59' 29" E a total distance of 244.47 feet;
3. Thence on a curve to the left with a radius of 250.00 feet, a total arc distance
of 410.46 feet;
4. N 48" 04' 45" W 111.94 feet to an iron pin marking the intersection of the
westerly line of Chase Lane with the southerly line of LaGrand Court;
THENCE the following four courses along the southerly line of LaGrand Court
1, S 41" SS' 15" W, 135 feet to a point;

4. Thence on a curve to the left with a radius of 25 feet, an arc distance of 24.71
feet to a point;
THENCE in a westerly, northerly, and easterly direction around the cul-de-sac of
LaGrand Court on a curve to the right with a radius of 75', a total arc distance of
383.88 feet;
THENCE following four courses along the northerly line of side LaGrand Court
1. On a curve to the left with a radius of 25.00 feet, an arc distance of 24.71
feet;
2. N 87. 42' 37" E 52.73 feet to a point;
3. Thence on a curve to the right with a radius of 248.00 feet; an arc distance of
198.19 feet;
4. Thence N 41' 55' 15" E 135.00 feet to an iron pin marking the intersection of
the northerly line of LaGrand Court with the westerly line of Chase Lane;
THENCE the following three courses along the westerly line of Chase Lane
1. N 48' 04' 45" W 147.24 feet to a point;
2. Thence on curve to the right with a radius of 430.00 feet an arc distance of
616.14 feet;
3. N 34' 01' 07" E 81.18 feet to an iron pin in the southwesterly right-of-way line
of King Road East;
THENCE S 55' 58' 53" E along the southwesterly line of King Road East, 70 feet to
the point or place of beginning.
This conveyance is subject to easements to New York State Electric and Gas
recorded in the Tompkins County Clerk's Office in Liber 442 of deeds at page 1029 and
Liber 308 of deeds at page 206, and further subject to an easement to New York
Telephone Company, and New York State Electric and Gas, recorded May 26, 1989 in the
Tompkins County Clerk's Office Liber 645 of deeds at page 560. The premises are also
conveyed subject to a ten foot wide walkway area as shown on the aforesaid survey
map of George Schlecht on the general westerly line of Chase Lane, which said walkway
area is to be maintained by the owners of the lots adacent to the walkway.
BEING a portion of the premises conveyed to the grantors by warranty deed of
Butterfield Associates 1, a limited partnership, recorded April 12, 1989 in Book 644
Deeds at page 1131 in the Tompkins County Clerk's Office.
TOGETHER with the appurtenances and all the estate and rights of the parties of
the first part in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, its heirs and assigns forever.
AND said party of the first part covenants as follows:
FIRST : That the party of the second part shall quietly enjoy the said premises;
SECOND : That said party of the first part will forever WARRANT the title to said
premises.
THIRD That, in compliance with Section 13 of the Lien Law, the grantor will
receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.

Douglas D. Wilcox, to me known, who, being by me duly sworn, did depose and state
that he resides at Homer, New York and that he is the Assistant Vice President of
Metropolis Capital Corporation, the Corporation described in and which executed the
foregoing instrument in its capacity as a general partner as Chase Farm Associates, the
limited partnership described hereinabove and that he executed the foregoing instrument
on behalf of . such corporation in its capacity as general partner of the limited
partnership and did acknowledge that he executed the foregoing instrument as the act
and deed of the aforesaid limited partnership.
