Between: DEER RUN HOMEOWNERS ASSOCIATIONS, INC., of POST OFFICE BOX 701, SKANEATELES, NEW YORK 13152 Grantor and TOWN OF ITHACA, a New York Municipal Corporation with off at 126 East Seneca Street, Ithaca, New York 14950 Grantee WITNESSETH, that the Grantor, in consideration of One and 00/100 Dollar ($1.00), lawful money of the United States, and other good and valuable consideration, paid by the Grantee, do hereby grant and release unto the Grantee, their heirs, executors, successors, distributces and assigns forever, A permanent 40 ft. wide casement for general municipal purposes over the following described premises: ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of Tompkins, State of New York, and being more particularly bounded and described as follows: BEGINNING at the northwest corner of "Deer Run - Phase TWO", as shown on a map prepared by George Schlecht, P.E., L.S., dated April 8, 1988, last amended June 6,1989 on record in the Tompkins County Clerk's Office, said point also being the southwesterly corner of lands conveyed to F. W. Hornbrook by Deed Liber 442 at Page 277, said point being marked by a set iron pin; thence South 85° 16' 09" East, along the north line of said subdivision, a distance of 2.24 feet to a point; thence South 49° 12' 50" East a distance of 213.69 feet to a point in an easterly line of the aforementioned "Deer Run - Phase Two" map; thence South 04° 43' 51 West, along said easterly line of said subdivision, 49.48 feet to a point; thence North 490 12' 50" West a distance of 212.65 feet to a point in a westerly line of "Deer Run - Phase Two"; thence North 010 12' 16" East, a distance of 50.19 feet to the point or place of beginning; containing 0.20 acres, be the same, more or less. The above describe easement is shown on a map entitled "Survey of Parcels A, B, C, D, E and F for Hallberg Associates", prepared by George Schlecht, P.E., L. S., dated February 8, 1990 filed in the Tompkins County Clerk's Office on February 20, 1990 in Drawer 0, Sheet 59. The above premises are part of "Common Lands Phase II" conveyed to the Grantor by deed recorded June 23, 1988 in Book 637 at Page 126 and shown on map filed in the Tompkins County Clerk's Office in Map Drawer 34 on April 15, 1988. SUBJECT to all easements and restrictions of record. TOGETHER with the appurtenances and all the estate and rights of the Grantor in and to said premises. RECEIVE REAL ESTATE JUL 6 WO TRANSFER TAX TOMPKINS COUNTY LZER 655 PACE 820 TO HAVE AND TO HOLD the premises herein granted unto the parties of the Grantee, their 3 heirs, executors, successors, distributees and assigns forever. AND the Grantor covenants as follows: FIRST: That the Grantee shall quietly enjoy the said premises. SECOND: That said Grantor will forever warrant the title to said premises. THIRD: That, in Compliance with Section 13 of the Lien Law, the grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
