WARRANTY DEED
THIS INDENTURE made this day of Nineteen
Hundred and Eighty-nine between WILLIAM P. FRANDSEN of the Town
of Spencer, County of Tioga and State of New York (P. O. address:
252 VanEtten Road, Spencer, New York 14883) party of the first
part, and THE TOWN OF ITHACA, A MUNICIPAL SUBDIVISION OF THE

York 14850, party of the second part,
WITNESSETH, that the party of the first part, in
consideration of One Dollar ($1.00) lawful money of the United
States and other good and valuable consideration paid by the

party of the second part, do hereby grant and release unto the

party of the second part, their heirs, executors, administrators
and assigns forever,
CONVEYS ALL THAT TRACT OR PARCEL OF LAND, situate in the
Town of Ithaca, County of Tompkins, and State of New York bounded
and described as follows:
BEGINNING at a point of the intersection on the East
boundary line of Park Lane and the North boundary line of John
Street, previously designated as "Velma Drive", as the same are
designated on maps respectively entitled "Section 1 - Boundary
and Lot Data • Map - Frandsen Subdivision - Slaterville Road,
Town of Ithaca, New York" (filed in Tompkins County Clerk's
Office on August 22, 1984 in Drawer 701 and "Frandsen Subdivision
Section 2 - Slaterville Road, Town of Ithaca, New York" (filed in
Tompkins County Clerk's Office on September 26, 1986 in Box XII,
Slot 85);
THENCE the following courses and distances,
1) South 830 42' 00" East along the Northern boundary line
of aforesaid John Street passing through iron pipes at 115 feet,
150 feet, 215 feet, 315 feet, 415 feet, 515 feet, 615 feet and
715 feet a total distance of 770 feet to a point of curvature
marked by an iron pipe; thence
2) Along curve to the right which curve has a radius of
460 feet passing through iron pipes at arc distances of 45.07

feet, 147.51 feet, and 257.77 feet a total arc distance of 284.17
feet to a point of tangency; thence
3) South 480 18' 10.4" East 100 feet to an iron pipe;
thence
4) Around an arc of a circle having a radius of 55 feet,
said circle having a central angle cf 930 27' 06.9" for an arc
length of 89.70 feet (the chord for which being South 580 31' 16"
East 80.09 feet) to an iron pipe; therice
5) South 800 11' 00" East a d_L;tance of 62.24 feet to an
iron pipe which pipe is on the West boundary of other lands of
the grantor; thence
6) South 090 49' 00" West a distance of 10 feet to an iron
pipe; thence
7) North 800 11' 00" West a distance of 61.34 feet to an
iron pipe; thence
8) Around the arc of a circle having a radius of 55 feet,
said circle having a central angle of 1890 34' 23.8" for an arc
length of 181.97 feet to an iron pipe (the chord for which being

9) North 480 18' 10.4" West along the Southern boundary of
the aforesaid John Street passing through a set pipe at 54.96
feet a total distance of 99.99 feet to a set pipe; thence
10) Along a curve to the left which curve has a radius of
400 feet passing through pipes at arc distances of 66.64 feet and
166.90 feet a total arc distance of 247.11 feet to a point of
tangency; thence
11) North 830 42' 00" West passing through set pipes at 20
feet, 120 feet, 220 feet, 320 feet, 420 feet, 520 feet, 620 feet
a total distance of 770 feet to a set pipe on the Eastern
boundary of Park Lane; thence
12) North 060 18' 00" East along the Eastern boundary of
Park Lane a distance of 60 feet to the point or place of
beginning.
The above description being known as John Street.
Being a portion of the same premises conveyed to William P.
Frandsen and Eleanor P. Frandsen by deed dated November 25, 1964
and recorded December 1, 1964 in the Tompkins County Clerk's
Office in Book 454 of Deeds at page 252 and by Eleanor P.
Frandsen to William P. Frandsen by deed dated January 4, 1987 and
recorded in the Tompkins County Clerk's Office on August 27, 1987
in Book 629 of Deeds at page .680. The aforesaid John Street
being so designated on a map entitled "Frandsen Subdivision
Section 2, Slaterville Road, Town of Ithaca, New York" made by
John S. MacNeill, Jr., P.C. dated September 16, 1986 and last
revised February 24, 1987, which map was filed on June 9, 1988 in
the Tompkins County Clerk's Office in Box XII, Slot 85.
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the �•
party of the second part, their heirs, executors, administrators
and assigns forever.

AND the said party of the first part does covenant as
follows: f
FIRST, that the party of the second part shall quietly enjoy
the said premises;
SECOND, that the said party of the first part will forever ;
Warrant the title to said premises.
THIRD, that in compliance with
Section 13 of the Lien Law,
the
Grantor will receive the consideration
for this conveyance
and
will hold the right to receive
such consideration as a trust
fund to be applied first for the
purpose of paying the cost of
the
improvement and will apply the
same first to the payment of
the
cost of the improvement before
using any'part of the total of
the
same for any other purpose.
