THE TOWN OF ITHACA, a New York municipal
corporation with offices located at 126 East
Seneca Street, Ithaca, New York
party of the second part,
WITNESSETH, that the party of the first part, in
consideration of One and 00/100 Dollar ($1.00), lawful money of
the United States, and other good and valuable consideration,
paid by the party of the second port, does hereby grant and
release unto the party of the secoaa part, its successors and
assigns forever,
ALL THAT TRACT OR PARCEL OF LAND siluate in the Town of Ithaca,
County of Tompkins and State of New York, bounded and described
as follows:
BEGINNING at an iron pin locat-ad on the North line of the
premises conveyed to the grantor herein by deed dated
November 25, 1964 and recorded December 1, 1964 in the
Tompkins County Clerk's Office in Book 454 of Deeds at page
252, which pin also marks the Southwest corner of premises
known as'Park Lane conveyed by Eastern Heights, Inc. to the
Town of Ithaca by deed dated September 9, 1968 and recorded
December 16, 1968 in the Tompkins County Clerk's Office in
Book 479 of Deeds at page 168;
THENCE South 6' 18' West passing through an iron pin at
100.00 feet a total distance of 210.00 feet to a point in
eastern boundary of lot D-2 as shown on the survey described
below;
THENCE South 83' 42' East a distance of 60.00 feet to an
iron pin set in the northwest corner of lot C-1 as shown on
the survey described below;
THENCE North 6" 18' East passing through an iron pin at
60.00 feet a total distance of 210.00 feet to an iron pin
located in the North line of the grantor's land at the
Southeast corner of Park Lane in the Eastern Heights
Subdivision;
THENCE North 83' 42' West a distance of 60.00 feet to the
place of beginning.
It is the intent of this instrument to convey a portion of
Park Lane as designated on a map entitled "Section One Boundary
and Lot Data Map - Frandsen Subdivision - Slaterville Road, Town
of Ithaca, New York" made by John S. MacNeill, Jr. License No.
34035 dated March 7, 1968 and revised March 25, 1968 and April
22, 1968 which map was filed in the Tompkins County Clerk's
Office on August 22, 1984 in Drawer 70.
BEING a portion of the premises conveyed to William P.
Frandsen and Eleanor P. Frandsen by deed dated November 25, 1964
and recorded December 1, 1964 in the Tompkins County Clerk's
Office in Book 454 of Deeds at Page 252 and by Eleanor P.
Frandsen to William P. Frandsen by deed dated January 4, 1987 in
Book 629 of Deeds at Page 680.
SUBJECT TO a sewer easement granted to Eastern Heights, Inc.

by the grantor herein by Instrument executed in July, 1967 and
modified by a second Instrument also executed in July, 1967.
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, its successors and assigns forever.
AND said party of the first part covenants as follows:
FIRST: That the party of the second part shall quietly
enjoy the said premises.
SECOND: That said party of the first part will forever
warrant the title to said premises.
THIRD: That, in Compliance with Section 13 of the Lien Law,
the grantor will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of
the same for any other purpose.
IN WITNESS WHEREOF, the party of the first part has hereunto
set his hand and seal the day and year first above written.
