WARRANTY DEED
WITH LIEN COVENANT
THIS INDENTURE made the tt-A day of % S , 1988,
Between: IVAR JONSON and JANET JONSON, husband and wife,
individually and as tenants by the entirety, both of
612 West Green Street, Ithaca, New York, 14850,
• parties of the first part
and TOWN OF ITHACA, a political subdivision of the State of
New York, with its principal address at 126 East Seneca
Street, Ithaca, New York 14850,
party of the second part,
WITNESSETH, that the parties of the first part, in
consideration of One and 00/100 Dollar ($1.00), lawful money of
the United States, and other good and valuable consideration,
paid by the party of the second part, do hereby grant and release
unto the party of the second part, its successors and
assigns forever,
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of
Ithaca, County of Tompkins, State of New York, to be known as
Lisa Place, as shown on a survey map, one entitled "MAP OF IVAR
JONSON SUBDIVISION - IVAR JONSON OWNER AND DEVELOPER OFF TEXAS
LANE EXT., TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK," said
premises shown thereon as Sherry Lane, as made by Clarence W.
Brashear, Jr., L.S., dated April 26, 1979, and revised May 14,
1979, and approved by the Tompkins County Health Department on
April 30, 1979, and the Planning Board of the Town of Ithaca on
May 15, 1979, and filed in the Tompkins County Clerk's Office May
18, 1979 in Cabinet 2, Envelope 20, and being more particularly
bounded and described as follows:

BEGINNING at a pipe set in a southeast corner of premises
shown as Lot 8 in the
aforementioned Brashear map, which point is
also South 10° 55' West, a distance of 104.5 feet from the
northeast corner of said Lot 8; thence along a curve to the
southwest, a distance of 27.3 feet to a pipe set in the southerly
boundary line of said Lot 8; thence South 89' 08 1/2 ' West,
along said Lot 8 to the line dividing the Town of Ithaca and the
Village of Cayuga Heights; thence southerly along the said
Village -Town line to a point in the north line of premises shown
as Lot 7 on the aforementioned Brashear map; thence North 89' 08
1/2' East along the northerly boundary of said Lot 7 to a pipe,
which pipe is 50 feet from the aforementioned pipe set in the
southerly boundary of Lot 8; thence along a curve to the
southeast, a distance of 34.3 feet to a pipe set in the easterly
boundary line of said Lot 7; thence northerly about 85 feet to
the point or place of beginning.
The above described premises are subject to a right of way
for electric, telephone and television cables and gas lines
conveyed to the New York State Electric & Gas Corporation and New
York Telephone Company by instrument dated September 13, 1979,
and recorded in the Tompkins County Clerk's Office in Liber 573
of Deeds at page 37.
It is the intent to convey to the grantee herein all right,
title and interest of the grantors premises known as Lisa Place
lying east of the line dividing the Town of Ithaca and Village of
Cayuga Heights.

BEING the same premises conveyed to the Grantors herein by
Jonson Homes, Inc., by deed dated November 22, 1982, recorded
December 1, 1982 in the Tompkins County Clerk's Office.in Liber
592 of Deeds at page 398, and by deed of Jonson Homes, Inc.,
dated March 17, 1983, recorded in said Clerk's Office in Liber
593 of Deeds at page 782.

TOGETHER with the appurtenances and all the estate and
rights of the parties of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, its successors and assigns forever,
distributees and assigns forever.
AND said parties of the first part covenant as follows:
FIRST: That the party of the second part shall quietly
enjoy the said premises.
SECOND: That said parties of the first part will forever
warrant the title to said premises.
THIRD: That, in Compliance with Section 13 of the Lien Law,
the grantor will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of
the same for any other purpose.
IN WITNESS WHEREOF, the parties of the first part have
hereunto set their hands and seals the day and year first above
