THIS INDENTURE , made this 96 day of FEBRUARY, Nineteen Hundred
and Eighty -Eight.

TOWN OF ITHACA, 126 Seneca Street, Ithaca, New

party of the second part,
WITNESSETH, that the parties of the first part, in consideration

lawful money of the United States, and other good and valuable
consideration paid by the party of the second part, does hereby grant
and release unto the party of the second part, the heirs or successors
and assigns forever,
See attached Schedule "A".
Together with the appurtenances and all the estate and rights of
the party of the first part in and to said premises,
To have and to hold the premises herein granted unto the party
of the second part, the heirs or successors, and assigns forever.
And said parties of the first part covenant as follows:
First, That the party of the second part shall quietly enjoy the
said premises;
Second, That said parties of the first part will forever
Warrant the title to said premises.
Third, That, in Compliance with Sec. 13 of the Lien Law, the
grantor will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any
other p pose.

ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County
of Tompkins, State of New York bounded and described as follows:
BEGINNING at a point marked by a highway monument on the westerly
highway boundary of Danby Road,(also known as N.Y.S. Route 96 B) said
point being S 80 W 40 feet from the southeast property corner of the
premises now or formerly of Rumsey thence N 820 W 10.00 feet to a
highway monument;
thence southwesterly along a curve to the left a distance of 222.65 feet
to a monument, also described by a chord bearing S 700 37' 30" W a chord
distance of 214.27 feet to a highway monument;
thence S 450 15' W 214.02 feet to a point marked by a highway monument
set at an opening of a culdusac;
thence along a curve to the left an arc a distance of 249.81 feet, which
arc has a radius of 50 feet, to a point marked by a highway monument.
Said point being S 46045'E 60 feet from the point marking the opening of
the culdusac;
thence N 430 WE 214.02 feet along the northwesterly bounds of a 10 3
foot utility easement to a monument set;
thence northeasterly along a curve to the right an arc a distance of
165.31 feet to a highway monument set at a point which is 10 feet
westerly of the west highway bounds of Danby Road, which last course is
also as described by a chord bearing N 70' 37' 30" E a distance of
159.10 feet;
thence S 82° E 10.00 feet to a monument
thence N 80 W along the westerly bounds of Danby Road to the point and
place of beginning.
The above described drive is known as Vista Lane and shown on the map )
entitled "Plot Plan of Cayuga Vista Subdivision, Grover Clustered
• subdivision, Town of Ithaca, Tompkins County, State of New York", made
by Robert R. Flumerfelt, P. E., and Clarence W. Brashear, Jr., L.S. No.
38194, dated 4-2-85, revised 4-15-85, 5-26-87, 7-12-87, and 12-8-87,
which map is intended to be filed in the Tompkins County Clerk's Office
concurrently herewith.
By this deed the grantors intend to dedicated to Town of Ithaca the
roadway within the subdivision known as Cayuga Vista Townhouses for
highway purposes.
The paving of the State Highway has not yet been completed to the
specification of N.Y.S.D.O.T. Grantors covenant that they shall complete
such paving at their cost.
