QUITCLAIM DEED

THIS INDENTURE made the I1stday of May, 1987,
Between: NANCY K. GOLDBERG, of 1709 Taughannock Boulevard,
Trumansburg, New York 14886
party of the first part,
and THE TOWN OF ITHACA, a New York Municipal Corporation,
with offices at 126 East Seneca Street, Ithaca, New
York 14850,
party of the second part,
WITNESSETH, that the party of the first part, in
consideration of the sum of $1.00 lawful money of the United
States and other good and valuable consideration paid by the
party of the second part, does hereby remise, release and quit-
claim forever unto the party of the second part, its successors
and assigns the following premises:
ALL THAT TRACT OR PARCEL OF LAND situated in the Town of
Ithaca, County of Tompkins, and State of New York, and being the
same premises described on Schedule "A" annexed hereto, the
description in which is incorporated in this deed by reference.
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted upon the
death of the party of the first part unto the party of the second
part, their heirs, distributees and assigns forever.
AND said party of the first part covenants that, in
Compliance with Section 13 of the Lien Law, the grantor will
receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for
any other purpose.

ALL THAT TRACT OR PARCEL OF LAND situate in the town of
Ithaca, County of Tompkins, State of New York, and being more
particularly bounded and described as follows:
BEGINNING at an iron stake set in the northerly line of
Snyder Hill Road in said town at the southwesterly corner of
premises now or formerly of Lawrence A. Rosenberg and Pamela
Rosenberg (Liber 585 of Deeds at Page 202), which point is
northwesterly along the line of Snyder Hill Road a distance of
163.5 feet from the intersection of the north line of Snyder Hill
Road with the town line between the towns of Ithaca and Dryden;
thence North 60' 52' West a distance of 75.4 feet to a point
marking the southeasterly corner of premises now or formerly of
Frank E. Backner; thence North 28' 50' East along the easterly
line of Backner a distance of 164.3 feet to an iron stake marking
the southeasterly corner of premises now or formerly of Elba
Velez (Liber 600 of Deeds at Page 844); thence northerly along
the easterly line of said Velez premises to a point, which point
is a tie dimension North 07' 07' West a distance of 46.1 feet
from the last described point; continuing along the easterly line
of said Velez premises to a point, which point is a tie dimension
North 05' 06, West a distance of 89.9 feet from the last
described point; thence northerly continuing along the east line
of said Velez premises to a point, which point is a tie dimension
North 37' 07' West a distance of 87.75 feet from the last
described point; thence North 60' 561 West along the said Velez
premises and premises now or formerly of Alan D. and Lynne K.

Deeds at Page 136), and Bernard Hutchins, Jr. and J. M. Hutchins
(Liber 557 of Deeds at Page 1014), a total distance of 499.87
feet to an iron stake; thence South 15' 56' West along the
westerly line of said Hutchins premises a distance of 128.43 feet •
to an iron stake set at the northwesterly corner of premises now
or formerly of Louise M. Redmond (Liber 599 of Deeds at Page
1030); thence South 29' 151 West along the westerly line of said
Redmond premises at 171.54 feet passing through an iron stake set
a total distance of 174.54 feet to a point at the southwesterly
corner of said Redmond premises in the north line of Snyder Hill
Road; thence North 61' 05' West along the north line of Snyder
Hill Road a distance of 60.5 feet to the southeasterly corner of

line of said Crance premises at 1.7 feet passing through a pin, a

southeasterly corner of said Sciarra premises; thence North 12'
11' East along the easterly line of said Sciarra premises a
distance of 39.4 feet to an iron stake; thence South 82' East a
distance of 60.3 feet to an iron stake set at the northwesterly

westerly line of said Melice premises a distance of 100.5 feet to
an iron stake set at the southwesterly corner thereof, being the

Camazine (Liber 578 of Deeds at Page 1046); thence southerly
along the west line of said Camazine premises to an iron stake
located a tie dimension South 11' 58' East a distance of 105.6
feet from the northwesterly corner of said Camazine premises;
thence continuing southerly along the west line of said Camazine
Premises and along the west line of premises now or formerly of
Lawrence A. Rosenberg and Pamela Rosenberg (Liber 585 of Deeds at
Page 202), passing through an iron stake set at the southwesterly
corner of said Camazine premises being also the northwesterly
corner of said Rosenberg premises, to an iron stake set a tie
dimension South 05. 10' East a distance of 77.76 feet from the
last described point; thence South 24• 38' West along the
westerly line of said Rosenberg premises a distance of 171.5 feet
to the point or place of beginning.
The above premises are described in accordance with a survey
map entitled "'SURVEY MAP ROADS TO BE CONVEYED TO TOWN OF ITHACA,
DOVE DRIVE AN PHEASANT LANE, HAVEN HILLS SUB -DIVISION, TOWN OF
ITHACA, TOMPKINS COUNTY, NEW YORK," dated June 1, 1985, revised
January 28, 1986, and further revised October 15, 1986, by
Clarence W. Brashear, Jr. Licensed Surveyor, a copy of which is
annexed hereto.
SUBJECT TO the following insofar as the same may effect the
above premises:
I. Poleline easement granted by Bertram A. Hildebrant and
Flora M. Dean to New York State Electric & Gas Corporation by
instrument dated June 18, 1937, recorded September 29, 1937, in
the Tompkins County Clerk's Office in Liber 241 of Deeds at Page
239, as the same may have been modified and/or limited by release
of easements from New York State Electric & Gas Corporation to
Eastern Heights, Inc., dated December 20, 1967, recorded April 3,
1968 in the Tompkins County Clerk's Office in Liber 474 of Deeds
at Page 580.
2. Poleline easement granted by Bertram A. Hildebrant and
Flora M. Dean to New York State Electric & Gas Corporation by
instrument dated January 27, 1941, recorded April 24, 1941, in
the Tompkins County Clerk's Office in Liber 254 of Deeds at Page
320, as the same may have been modified and/or limited by release

Eastern Heights, Inc., dated December 20, 1967, recorded April 3,

3. Right of way granted by Eastern Heights, Inc. to New

by instrument dated August 19, 1981 recorded August 20, 1981 in
the Tompkins County Clerk's Office in Liber 585 of Deeds at Page
199.
BEING a portion of the premises described to Bishops of
Ithaca, Inc. from Robert W. Stolp as referee, dated August 18,
1981, recorded in the Tompkins County Clerk's Office August 18,
1981, in Liber 585 of Deeds at Page 128. Said premises were
conveyed to, the grantor herein by Deed from Bishops of Ithaca,
Inc., dated March 23, 1984, recorded March 26, 1984 in the
Tompkins County Clerk's Office in Liber 600 of Deeds at Page 384.
Grantor quitclaims to grantee all right title and interest
F of the Grantor in and to any strips, gores or parcels of land
lying to the North of and adjoining Dove Drive as described above
and shown on the survey map referred to above, to the southerly
lines of those portions of Dove Drive being conveyed to the
grantee by Ralph R. Varn and Richard C. Varn by deed intended to
be recorded concurrently herewith. It is intended by this
paragraph to Convey all and any rights of the grantor so as to
insure the contiguity of Dove Drive conveyed herein to that
portion of Dove Drive conveyed to the grantee by said Varn Deed
referred to above.
This deed is given to convey premises known as "Dove Drive"'
and "'Pheasant LaneO as shown on the survey map referred to above.
This deed is given to confirm the location of the two roads, Dove
Drive and Pheasant Lane, their location as built, and to correct
any discrepancies with the as -built roads from the location of
the proposed roads on the original subdivision map made by Howard
Schlieder, which map is recorded in Cabinet 1, Envelope 92 in the
Tompkins County Clerk's Office.
