WARRANTY DEED
THIS INDENTURE, made the 234day of April, Nineteen Hundred
Eighty-six,
BETWEEN The VILLAGE OF LANSING, a municipal corporation,
organized under the laws of the State of New York, with offices
on North Triphammer Road, Ithaca, New York
party of the first part,
and the TOWN OF ITHACA, a municipal corporation in the County of
Tompkins, New York., with offices at 126 East Seneca Street,
Ithaca, New York, as the agent municipality acting on behalf of
itself, the Town of Lansing, the Town of Dryden, the Village of
Cayuga Heights, and the Village of Lansing, jointly associated
through the Southern Cayuga Lake Intermunicipal Water
Commission, pursuant to Article 5-G of the General Municipal
Law,
party of the second part.
WITNESSETH that the party of the first part, in
consideration of One and 00/100 Dollar ($1.00) lawful money of
the United States, and other good and valuable consideration
paid by the party of the second part, does hereby grant and
release unto the party of the second part, or its successors and
assigns forever,
ALL THAT TRACT OR PARCEL OF LAND situate in the Village of
Lansing, Town of Lansing, County of Tompkins, State of New York,
and being more particularly described as follows:
BEING A PORTION of the premises on which the existing
Village of Lansing offices are presently located, and being that
portion of said premises which lie under the "Existing Pump
House" of the Southern Cayuga Lake Intermunicipal Water
Commission, as shown on the survey map hereinafter referred to,
together with such additional lands so as to make up a parcel
bounded on the westerly, northerly, easterly and a portion of
the southerly property lines by lines parallel with and five
feet distant from the present building lines of the "Existing
Pump House", the :remaining portion of the southerly property
line to be along the building lines and party wall with the
"Existing Village Of Lansing Offices" as shown on said survey
map. The above described premises are shown as the "Proposed
Parcel To Be Conveyed" on the survey map entitled "SITE MAP
SHOWING PARCEL TO BE CONVEYED AND EASEMENTS TO BE ACQUIRED BY
SOUTHERN CAYUGA LAKE INTERMUNICIPAL WATER COMMISSION FROM
VILLAGE OF LANSING„ NORTH TRIPHAMMER ROAD, VILLAGE OF LANSING,
TOMPKINS COUNTY, N.Y.," dated October 1, 1983, by T. G. Miller
Associates, P.C., Engineers and Surveyors, a copy of which is to
be recorded concurrently herewith.
TOGETHER WITH a 15 foot wide right-of-way for ingress and
egress over the existing driveway on the premises of the Grantor
as shown on said map, reserving to the Grantor the right to
relocate said right-of-way in the future at such time and in
such location as will not affect the Grantees use of the
above -described premises or the other rights granted hereunder.

ALSO TOGETHER WITH the right to use a portion of the parking
area to the east of the premises conveyed for the purpose of
parking vehicles on business relating to the purposes of the
Grantee.
ALSO TOGETHER WITH two 30' wide permanent easements to enter
upon, construct, operate, maintain, repair, and replace main
water transmission pipelines, such easements to be located
parallel to and centered on the existing C.I. water mains
crossing the premises to the "Existing Pump House", the said
easements to be located and to be deemed described in accordance
with the easements as shown on the said survey map referred to
above. Whenever work is done by the Grantee on the said
easement parcels, it is agreed that, without expense to the
Grantor, all debris will be removed, the premises will be
restored to substantially the same condition they were in before
such work was done.
SUBJECT TO the right of the Grantor to maintain electrical
lines under a portion of the easterly end of the "Existing Pump
House," and together with the right of the Grantor to maintain a
junction box as presently located in the "Existing Pump House"
for the purpose of providing electric service to the "Existing
Village Of Lansing Offices." This right shall include the right
to enter upon the premises of the Grantee for the purpose of
repairing, maintaining, relocating or otherwise having access to
said electrical lines and junction box. Provided, however,
that, unless an emergency situation is presented requiring
immediate access to said premises, notice shall be given to the
Grantee a reasonable time prior to such entry, which notice
shall advise the Grantee of the nature of any repair,
reconstruction, relocation, excavation or other work which may
affect the property of the Grantee, and provided further that
the Grantor shall be responsible for the costs of repairing,
reconstructing or restoring the property of the Grantee to the
condition it was in prior to such work being done.
ALSO SUBJECT TO and TOGETHER WITH the rights, duties and
obligations set forth in a party wall agreement between Grantor
and the Grantee to be executed concurrently herewith.
There is reserved to the Grantor the right to repurchase the
premises described herein or a portion thereof, for the sum of
$1.00, when and if the Grantee or its successor or successors in
interest, shall cease to use the premises for the purposes of
the Southern Cayuga Intermunicipal Water Commission or its
successors in interest.
The above described premises are a portion of the premises
described in a deed from Robert R. Gibbs and Leon L. Gibbs to
the Town of Lansing, dated November 1, 1966 and recorded
November 18, 1966 in the Tompkins County Clerk's Office in Liber
466 of Deeds at Page 392, which property became the property of
the Village of Lansing upon the incorporation of the Village of
Lansing as a municipality on December 19, 1974.
This deed is executed by the Grantee to signify its consent
to and acceptance of the rights and obligations of the grantee
contained in this deed.
TOGETHER WITH the appurtenances and all the estate and
rights of the party of the first part in and to said premises.

TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, its successors and assigns forever.
AND said first party covenants as follows:
FIRST, that the party of the second part shall quietly enjoy
the said premises;
SECOND, that said first party will forever warrant the title
to said premises.
THIRD, that in compliance with Section 13 of the Lien Law,
the Grantor will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust
fund to be applied for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of
the same for any other purpose.
IN WITNESS WHEREOF, the parties hereto have hereunto
executed this instrument by their duly authorized officer and
set their seals the day and year first above written.
