Loucks by David E. Kaser and Jane J. Kaser dated July 26,1973 and recorded in the Tompkins ' County Clerk's Office the same date in.Book 509 of Deeds at Page 329, running from a point in the north line of said premises approximately 22 feet from a pipe marking the northwesterly corner thereof southwesterly and crossing the southerly line of said premises opposite a manhole in Crest Lane about 6 feet 4 inches from a pipe marking the southwesterly corner thereof. If is intended hereby to convey a sewer easement 5 feet on each side of the above -described line which is the center line of said easement, more particularly shown on a survey made by T. G. Millers Associates ,under .date of June 14, 19859 amended July 25, 1985, a copy of which, said survey was attached to the deed from John P. Hertel and wife to Michael Koplinka-Loehr and wife dated July 31, 1985 and recorded in said Clerk's Office July 31, 1985 in Book 610 of Deeds at Page 1086. is The sewer main and appurtenances (or any other facilities) constructed on said premises shall remain the property of and shall be under the control and supervision of the GRANTEE, but the GRANTOR (1) reserves the underlying fee title to said property covered by said right-of-way, subject to the rights and privileges herein granted to the GRANTEE, and (2) the GRANTOR reserves the right to use and ,enjoy said premises provided that such use shall not interfere with the construction, maintenance, operation or repair of, or cause injury or damage to, the 1smhmsewer main or other facilities or appurtenances. The GRANTEE will restrict its operation to the minimum feasible width for said right-of-way. Whenever any work is done on the GRANTOR'S premises, it is agreed that, without expense to the owner, all debris will be removed, the premises will be restored to substantially the same condition they were in before such work was done; the GRANTOR shall give prompt notice to the GRANTEE or its agents of any damage to the property or failure to restore the same properly. Such notice must be in writing and must be given promptly in order to enable the Town td notify the Town Engineer and the contractor, if any,. who performed the work on the Project.
