THIS INDENTURE, made the day of , nineteen hundred and Eighty-three

BETWEEN individually and as tenants by the entirety, of 130 Crest
Lane, Ithaca, N.Y.; STANLEY W. WARREN, 1006 Hanshaw Road,
Ithaca, N.Y.; JEAN WARREN, 1100 South Foster. Drive Apt 28,
Baton Rouge, LA 70806; RICHARD WARREN, RD #1, Warren Road,
Barrington, New Hampshire 03825; GEORGE F. WARREN, JR.,
1130 Cherry Lane, West Lafayette, Indiana 47906; MARY W.
SWAN, 103 Crest Lane, Ithaca, N.Y.
party of the first part, and the Town of Ithaca, a municipal corporation in
the County of Tompkins and State of New York, with
offices at 126 E. Seneca Street, Ithaca, New York
party of the second part.
WTTNESSETH, that the party of the first part, in consideration of ONE and 00/100 ------

by the party of the second part, does hereby remise, release and quitclaim unto the party of the second part,

the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Ithaca, County of Tompkins, State of New York.
consisting.of a strip of land Ten (10) feet in width running from
the highway known as Forest Home Drive, along the northwest boundary
of the lands conveyed to William A. Riley and Harry Edwin Smith by
deed from Jacob E. Bogardua and wife dated May 16, 1911 and recorded
in the Tompkins County Clerk's Office in Book 175 of Deeds at page
521, to the highway known as Warren Road; the northwestern boundary
of said strip of land being the southeastern boundary of the lands
formerly of Charles Hasbrouck described as follows:
Colmnencing in the center of Forest Home Drive and passing
through a stone monument, on the northeast: line thereof.. runnin N
540 35'E 191.9 feet to an iron pipe; running thence S 320 57' 88
feet to a stone monuiiient; running thence N 590 01' E 317 feet to the'
center of Warren Road, first passing through an iron pipe on the
southwest boundary of said road. The said boundary ling: as above
described being on the northerly and westerly line of the lands hereby
conveyed, and the southerly and easterly line of the premises hereby
conveyed being parallel to the line as above described and 10 feet
distance therefrom.
TUGLTIILR with any right title and inr_er.est in and to premises
adjoining, the above described 10 foot strip to the northwest or south-
east which may have been acquired by the grantors through the use and
occupancy of said premises, or by grant or otherwise.
Being the same premises conveyed by Deed from William A. Riley
and wife and Harry Edwin Smith to George F. Warren dated October 28,
1911 and recorded in the Tompkins County Clerk's Office in Liber .177
of Deeds at page 288.
The said George F. Warren died May 24, 1938 leaving a Will which
Jevised the said property as follow:,: 1/3 ahare to hia wife, Mary W.
Warrtrn; and 1/9 each to hire children Stanley W. Warren, George F .
Warren, Jr., Richard Warren, .lean Warren, Mary Warren and Martha
Warren.. By deed dated April 1, 1949 and recorded April 2, 1949
(Book 319 Deeds at page 319) the said Mary W. Warren quitclaimed
all her right title fund interest: in the said real property to her ,
daughter, Martha (Warren) Hertel, and son-in-law, John P. Hertel.

Grantor Martha W. Hertel is the same person as Martha Warren
and Grantor Mary W. Swan is the same person ans Mary Warren.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
