THIS INDENTURE made as of the...... r ...._day of 1975 BETWEEN
ARCHIE L. COGGSHALL and VERA C. COGGSHALL
referred to as the GRANTOR,and
the TOWN OF ITHACA. a municipal corporation in the County of Tompkins,New York,herein also referred
to as GRANTEE, as the Agent Municipality,acting in behalf of itself, the Towns of Lansing and Dryden, the
Village of Cayuga Heights and other municipalities, all or such as will be jointly associated in the Project to
obtain a water supply from Cayuga Lake for lands in said municipalities (sometimes referred to as the Bolton
Point Water Supply Project,, its or their successors and assigns,
WITNESSETH: WHEREAS the said municipalities have jointly agreed to construct facilities for the said
Project which include water transmission pipe linea and appurtenances which by reason of topography and grades
in.certain locations must depart from established highways in order to render proper water supply and distribu-
tion service to property owners in the said municipalities, and WHEREAS the GRANTOR is the owner or has
an interest in real property where the water transmission pipe line or lines and appurtenances or other facilities
must cross or encroach upon private property for the above reasons,
NOW, THEREFORE, said GRANTOR in consideration of the benefits to accrue both community wide
and to said GRANTOR as a result of stabilization of property values and protection of health and otherwise,
and in further consideration of the covenants herein contained and other good and sufficient consideration, re-
ceipt
ceipt whereof is hereby acknowledged, does hereby grant and convey to said Torn of Ithaca, as such Agent
Municipality,it successors and assigns forever: A permanent right-of-way to enter upon,construct,operate,main-
tain, repair and replace a water transmission pipe line and appurtenances or such other facilities as are herein
described on the lands of the GRANTOR in accordance with official plans and specifications filed originally
at the office of the Town Clerk of the Town of Ithaca; the width of the right-of-way and the approxim tie loca-

made byLozier Engineers, by T. G. Miller, a copy of which is filed
concurrently herewith and a reduced copy of which is attached hereto
and'made a part,hereof.

Together with a temporary easement during the period of original construction over so much of the owner's
property as may be necessary for men and vehicles while the said water main and appurtenances (or any other
facilities specifically described below) are being installed, which temporary easement is also shown on the at-
tached map. See also' Schedule A for a substantial description of the
temporary easement.
The execution of this instrument by a party holding the following lien(s) on the above premises shall con-
stitute a release from any such lien(s) of the easement granted hereby: j

The water main and appurtenances (or any other facilities) constructed on said premises shall remain the prop
erty of and shall be under the control and supervision of the GRANTEE and such other municipalities as may be
associated in the Project, but the GRANTOR (I) reserves the underlying fee title to said property covered by
said right-of-way,subject to the rights and privileges herein granted to the GRANTEE,and (2) GRANTOR re- 4
serves the right to use and enjoy said premises provided that such use shall not interfere with the construction,
maintenance,operation or repair of,-or cause injury or damage to, the water main or other facilities or appur-
tenances.The GRANTEE will restrict its operations to the minimum feasible width for said right of way.When-
ever aby work is done on the GRANTOR'S premises,it is agreed that,without expense to the owner, all debris
will be removed,the premises will be restored to substantially thesame condition they were in before such work
was clone; the GRANTOR shall give prompt notice to the GRANTEE or its agents of any damage to the prop S
erty or failure to restore the same properly.

ties are hereinafter set forth:
The premises covered by the aforesaid easements are a portion i
of the lands conveyed by Grace Hanford to the grantors by deed dated
January 3, 1928, and recorded in Liber 214 of Doeds at page 499. {

SCHEDULE A
DESCRIPTION OF EASEMENT FROM ARCHIE L.
and VERA C. COGGSHALL
The permanent easement consists of a 10 foot easement and
a 15 foot easement. The precise location of the area covered
by the easeme:it is as set forth on the maps referred to in this
instrument. However, the strip of land covered by said permanent
easement may be substantially described as follows:
Beginning at an existing iron pipe in the northeast corner
of the parcel conveyed by the grantors to Jere D. and Sharon F.
' Haas by deed dated May 2, 1975, recorded in Liber 545 of Deeds
at page 136, thence proceeding the following courses:
1. Thence northeasterly along lands of C. G. Bradt 102
f feet more or less to an iron pin in concrete;
II 2. Thence southeasterly 212 'feet, more or less, to a point,
passing through a pipe set 160 feet northwesteiy along said line
from a .corner of said Coggshall property;
125 feet more or less
3. Thence easterly/through lands of Coggshall, to a point
in an easterly boundary line of said Coggshall land ( this course
having an angle of 107° 211) ;
4. Thence northerly along an easterly boundary line of said
Coggshall lands, 570 feet more or less to a point, this course
passing at about 15 feet through a pipe located 175 feet from
said last mentioned corner of said Coggshall lands;
5. Thence continuing north, still along the Coggshall
boundary line, approximately 15 feet to a point as shown on said
map;
6. Thence westerly 17 feet more or less to a point;
7. Thence southerly 574 feet more or less to a point, this
course running along a line which is 15 feet west from and
parallel to course #4 above;
6. Thence southwesterly 105 feet more or lessto a point,
this course running 15 feet northwesterly from and parallel to
course #3 above described;

this course running 15 feet northeasterly from and parallel to
course #2 above described;

10. Thence southwesterly, 117 feet to the north fine of
I said property of Haas, this course running along the line which
is 10 feet northwesterly from and parallel. to course #1 above
described;
11. Thence southeasterly 10 feet along the north line of f

The temporary easement, 25 feet in width is immediately
adjacent to the permanent easement where it is 15 feet in width.
The 15 foot temporary easement is immediately adjacent to the
permanent easement. where it is 10 feet in width.
