of Ithaca, 'County of Tompkins and State of'New York, being a strip•
of land 50 feet in width north and south and 200 feet.in depth east and
west, and comprising the southerly 50 feet of Lot 5 as shown on the
Preliminary Plot Plan of the Proposed Subdivision of Arthur As Prince,
Hanshaw Road Vjci. Lty, made by John S. MacNeill, Jr. on January 20,
1969, revised Larch 5, 1969, and March 12, 1969, and approved by the
Planning Board,of the Town of Ithaca on August 24, 1971, and bounded
and described as followss Beginning at the intersection of the
southeast corner of Lot 5 which is also the northeast corner of Lot 6
as shown on said map, with the westerly line of St. Catherine's
T , Circle,,as shown on said map, which is being conveyed. concurrently
to the Town of Ithaca for road purposes; running thence northerly 50
feet along the westerly line of St. Catherine's Circle; thence westerly
parallel with the common division line between Lots 5 and 6, 200 feet,
more or less, to the westerly line of Lot 5 as' shown on said map;
thence southerly 50 feet along the westerly line of said Lot 5 to the
northwesterly corner of Lot 6 as shown on said.map; thence easterly
t� 200 feet along,'the common division line between Lot 5 and 6 to the
point or place of beginning.
i This conveyance is made SUBJECT to the following provisions:
I, This conveyance is made in consideration of the acceptance
of the St. Catherine's Circle as a Town Road by the Town of- Ithaca;
in order to promote the orderly development of subdivisions and'
streets in -the Town of Ithaca in accordance with the planning of
present'and future streets, it is agreed that said 50 foot strip shall
be used for road purposes only to connect'St. Catherine's Circle with
i any road, street or highway which may be planned and constructed on
lands lying westerly of the proposed subdivision as shown on said map.
2. By accepting this deed at the present time, the Town of
Ithaca does not assume any obligation to maintain said strip as a
• public street, nor shall the said strip of land be used as a public
`I street or as a public thoroughfare for general use and travel by the
public unless the said street has been constructed in accordance with
the requirements of the Town of Ithaca.
3. The .said party of ,the first part, his distributees and
assigns, shall not be under any obligation to construct or pay for the
construction of a road on said strip conveyed as aforesaid.

receive the consideration for this conveyance and will hold the might to receive ouch
consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the coat of the
improvement before using any part of the total of the same for any other purpose.
