TB Resolution 2020- : Supplemental Agreementwith Fisher Associates, PE, LS, LA, DPC
for the Gateway Trail Project for Additional Design Services to Perform a Structural
Assessmentof the Concrete Slab and Abutments
Whereas, in May 2007 the Ithaca Town Board agreed to authorize and execute all necessary
agreements, certifications or reimbursement requests for Federal Aid on behalf of the Town with
the NYS Department of Transportation in connection with the Gateway Trail project: and
Whereas, in May 2013 the Ithaca Town Board authorized an additional $4,000.00 to increase the
funding for the design portion of the Gateway Trail project (TB Resolution No. 2013-077); and
Whereas, in March 2019 the Ithaca Town Board authorized an additional $17,000.00 to increase
the funding for the design portion of the Gateway Trail project following difficulties obtaining
permission for an easement from Home Depot for the trailhead connection into their parking lot
(TB Resolution No. 2019-048); and
Whereas, in February 2020 the Ithaca Town Board authorized an additional $7,500.00 to
increase the funding for the design portion of the Gateway Trail project to obtain additional
hydrologic information for the area between Buttermilk Falls Road West and the Home Depot
property (TB Resolution No. 2020-033); and
Whereas, the Town Board has identified the need for a structural assessment, including
recommendations, to be performed on the concrete slab and abutments located between
Buttermilk Falls Road West and the Home Depot Property as part of the Gateway Trail project;
and
Whereas, $7,500.00 is the amount required for the supplemental consultant services to
accomplish work described above, now therefore be it,
Resolved, that the Town Board approves, authorizes and directs the Town Supervisor to execute
a supplemental agreement with Fisher Associates, PE, LS, LA, DPC, to include an additional
amount not to exceed $7,500.00 (allocated from A7110.526, Gateway Trail), said supplemental
agreement subject to the approval for the Attorney for the Town.

TB Resolution 2020-xxx: Approval of Tobacco Free Policy
Whereas, on June 24, 2019, the Town passed resolution 2019-093c, which prohibited smoking for
employees, customers and visitors in Town buildings, Town vehicles, and on Town Hall property
(including personal vehicles in the Town Hall parking lot), and which restricted smoking within 25 feet
of any public entrance at Public Works; and
Whereas, the Personnel & Organization Committee reviewed the Smoking Policy and desired to extend
to a tobacco free policy and include Town recreational areas for staff and users; and
Whereas, the Town of Ithaca declares that the use of tobacco products (including e-cigarettes and
vaping), upon and in Town-owned Parks, Trails, and Preserves is harmful to the health of persons using
and enjoying the property; now, therefore, be it
Resolved, the Town Board of the Town of Ithaca does hereby establish the Tobacco Free Policy
effective July 1, 2020, for staff, Town Board members and committee members, residents, visitors, and
contractors and directs that signage be posted at all Town properties.

Town of Ithaca Tobacco Free Policy
This establishes the Town’s policy regarding tobacco use on Town-owned or -maintained properties, in
Town-owned or -maintained facilities, and Town-owned vehicles or equipment thus reducing exposure
to secondhand smoke and/or vapor, reducing tobacco use among visitors and employees, and upholding
the Town’s commitment to enhancing the health of its employees and residents.
Section 1: General Statement
The Town of Ithaca recognizes the harm to public health from exposure to both direct and second-hand
tobacco use. It is the policy of the Ithaca Town Board to ban tobacco use in all its facilities and mobile
equipment and on all its properties (except as specified below), to support efforts to educate its
employees and the general public as to the harms that accrue from tobacco and nicotine use.Based on
the authority of the Town to regulate the use of its property the Town of Ithaca adopts this policy in
furtherance of the health, welfare and safety of the Town and its residents.
Section 2: Definitions
Tobacco Products – As defined by the FDA includes cigarettes, cigars, roll-your- own tobacco,
pipe tobacco, hookah tobacco, dissolvable, nicotine gels, smokeless tobacco (dip, snuff, snus,
chewing tobacco), vaporizers, e-cigarettes, and other electronic nicotine or aerosol delivery
systems.
Tobacco Use -The intake of tobacco products by smoke or vapor from cigarettes, cigars, pipes,
hookahs, vapes, e-cigarettes, or other electronic nicotine aerosol delivery systems, either by the
individual smoking/vaping or the oral absorption of nicotine and related toxins through smokeless
tobacco products.
Facilities and Property (leased or owned) – Town of Ithaca-owned or -maintained buildings,
parks, trails, preserves, parking lots, entrance lanes, sidewalks, structures, town-owned vehicles
and equipment, privately owned vehicles parked on town property, and landscaped areas.
Designated Tobacco Use Area – Area on the grounds of Town property identified as a tobacco
use and/or smoking area.
Section 3: Policy
A. This policy prohibits smoking and vaping in any Town-owned or –maintained building or
Town-owned vehicle or equipment. The New York State Clean Indoor Air Act (Public Health
Law, Article 13-E) prohibits smoking and vaping in almost all public and private indoor
workplaces, including restaurants and bars, to protect workers and the public from exposure to
harmful secondhand tobacco smoke and vapingaerosols.
B. This policy prohibits smoking or other tobacco use in any Town park, trail, or preserve.
C. This policy applies to all staff, Town board or committee members, residents, visitors, vendors,
volunteers, and contractors.
D. Tobacco use is prohibited at the Town facilities and property, whether owned or leased, as of
July 1, 2020, including in privately owned vehicles parked in the Town Hallparking lot, with
the following exception:
Public Works Facility Property –Tobacco use is allowed in any designated tobacco use area
approved by the Director of Public Works, for employees only, which will be no less than
25 feet from any building entrance, or in their private vehicle.
E."Tobacco Free"or"No Smoking" signs, or a sign with the international "No Smoking"
symbol, which consists of a pictorial representation of a burning cigarette enclosed in a circle
with a bar across it, must be prominently posted and properly maintained at all facilities,
parks, trails, and preserves.
Town of Ithaca 2020 Early Retirement Incentive Plan-Conceptual DRAFT 3
This retirement incentive plan is being considered in order to avoid the pain and morale-
reducing effects of layoffs and position eliminations due to this time of fiscal stress and
constraint due to the COVID-19 pandemic and aftermath of longer term affects.
The goal of this incentive plan would be to aid in the reduction of overall staffing costs by
rewarding long-term employees in compensation for their years of service and dedication
to the Town in general. For the next one to two years, depending on needs, staffing
numbers would be reduced and restructured, which would reduce costs allowing the
Town to recuperate from this pandemic.
The Town Board is considering the following implementation elements for a local
retirement incentive program to help achieve this goal.
A. Effective retirement dates must be between July 1, 2020 and January 31, 2021.
B. Eligible employees must meet the following criteria by retirement date:
a. Eligible for retirement through the NYS Local Retirement System (NYSLRS)
i. Age 55 or older
ii. Meet the 10-year vesting requirement with NYSLRS
b. Completed a minimum of 10 years of service with the Town of Ithaca
Incentive provided to employee:
A. Lump Sum incentive -paymentof $500 per year of service with Town.
B. Retiree Health Insurance coverageincentive- 12 monthly premiums will be paid in
full, starting the first month following date of retirement, prior to retiree becoming
responsible for paying monthly premiums.
Continued Retiree coverage will be based on current town Retiree Health
Insurance policy allowing sick time to be utilized and then cost share based on
years of service with Town.
If retiree and or dependent is Medicare eligible then they are required to change
coverage to the Medicare Supplemental plan, as specified in policy.
If retiree and or dependent is not Medicare eligible then they may remain on
the same health insurance plan as of date of retirement (PPO or Platinum).
Retiree may change to the Platinum Plan at the time of retirement or any annual
open enrollment period thereafter. Once Retiree chooses the Platinum Plan
for coverage then they may not revert to the PPO Plan thereafter.
Timeframe on offer:

Early Retirement Incentive would be offered by July 1andshall beaccepted or denied
on or before September 1, 2020 to allow for 2021 budgeting. Retirement date
Requirement for departments with employees utilizing Early Retirement Incentive:
A. Vacated position (or lower level position for PWD) remain vacant for a minimum of
6 months, preferred 12-24 months.
B. Some positions may be filled sooner based on limited number of certain positions
for the town. i.e.: 1 Human Resources position, therefore, would be eligible for
replacement prior to requirement in A above.
C. Determination and approval to fill positions will be based on a recommendation by
Town Supervisor, Department Head and Human Resources to Personnel
Committee.
D. Cost savings would be realized because replacements are hired at a lower pay
rate over first three years of employment
E. Cost savings would be realized because replacements would be offered Platinum
Plan health insurance at 15% contribution
F. Cost savings would be realized because replacements would potentially be Tier 6
members in the NYSLRS
G. Cost savings would be realized because annual costly longevity payments would
cease, and new longevity payments would not begin for replacements for 10 years
H. Cost savings would be realized because workers’ compensation costs would be
based on lower wages

TB Resolution 2020-xxx: Approval of Established Employment Policies Due to COVID -19
Whereas, the Town Board on March 30, 2020 approved of modified employment policies due to
the COVID-19 Pandemic from March 15, 2020 through June 8, 2020; and
Whereas, effective May 26, 2020, the Town began opening facilities to the public and increasing
the level of staff on site, therefore the following employment policies are recommended by the
Town Supervisor:
Effective, June 8, 2020, all employees are required to use paid leave accruals for any
hours they are not able to meet their normal weekly hours, as COVID Other leave is no
longer available.
Departments, other than Public Works, may maintain reduced number of staff on site
through the use of telework, but must still be able to maintain essential functions of the
Department.
Employees set up with ability to telework, work onsite or a combination will be expected
to work their regular weekly hours or must utilize paid leave accruals to make up the
difference.
Employees while teleworking are permitted to work hours outside their regular set
schedule to be able to meet their weekly hours – actual times worked must be reflected
accurately on timesheet.
Employees are required to abide by the established work rules including wearing masks,
social distancing, and conducting self-health checks at the start of their onsite workday as
required by the re-opening plan.
Employees that have any COVID-19 related symptoms or have been potentially exposed
to a person being tested for COVID-19 or a person who has received a positive test result
of COVID-19 are forbidden to enter a town facility or report to work (even if essential)
and must be tested for COVID-19, providing a negative test result, and completing any
required quarantine before being able to return to work.
Employees are to use due diligence and not report to work if they are not feeling well due
to COVID related symptoms and other common illnesses. Employees must not report to
work if they have had a fever, vomiting or diarrhea until 24 hours after the symptoms
have ceased. Use of sick time accruals is required.
Employees that have tested positive for COVID-19 or under a required quarantine will be
paid in full without the use of sick time for the length of the required absence. However,
employees that are required to quarantine but otherwise able to work and can telework,
must maintain their weekly work hours. Those not able to telework due to their position
will be paid in full without the use of sick time for the length of the required quarantine.
Employees unable to report to work or meet their regular weekly hours due to childcare
issues such as school being closed, childcare facility being closed or child care provider
unavailable due to COVID reasons, shall utilize Expanded FMLA leave in conjunction
with paid leave time.
Employee vacation time accruals will be allowed to extend beyond the maximum allowed
butwill be required to be brought back within the maximum allowed prior to the accrual
on December 1, 2020. If vacation time is brought back within the maximum prior to
December 1, 2020, from that time on it must remain within the maximum; now,
therefore, be it
Resolved, the Town Board of the Town of Ithaca does hereby establish the above employment
policies due to the COVID-19 Pandemic and are in effect until modified.

TB Resolution 2020 – xxx: Appointment of Highway Superintendent / Director of Public
Works
Whereas, there is a vacancy in the full-time position of Highway Superintendent / Directorof
Public Works due to a retirement; and
Whereas, the Selection Committee comprised of Supervisor Howe, Town Councilpersons Pam
Bleiwas and Tee Ann Hunter, Director of Engineering and the Human Resources Manager
interviewed candidates for the said position along with second interviews held with the Town
Staff; and
Whereas, the Selection Committee has determined that Joseph Slater possesses the necessary
knowledge, skills, and ability to satisfactorily perform the duties of the Highway Superintendent
/ Director of Public Works, and makes the recommendation for appointment; now, therefore, be
it
Resolved, the Town Board of the Town of Ithaca does hereby appoint Joseph Slater as the
appointed Town Highway Superintendent / Director of Public Works, effective June21,2020;
and be it further
Resolved, this is a full time salaried position based on 40 hours per week, at an annual salary of
$96,033, in Job Classification “S”, with full time benefits from account A5010.100; and be it
further

Resolved, the said appointment is for a term continuing until the 1 day of January next
succeeding the next biennial Town election to wit, January 1, 2022, in which he will be eligible
for a new two year appointment; and be it further

TB Resolution2020- : Authorization to Close the Town of Ithaca Sand Bank Road
ImprovementCapital Project Fund
Whereas,the Town Board of the Town of Ithaca authorized the Town of Ithaca SandBank Road
Improvement Capital Project Fund under Resolution No. 2014-190 on November 10, 2014;and
Whereas, the Town Engineer has certified the Town of Ithaca Sand Bank Road Improvement
project has been completed to the satisfaction of the Town; and
Whereas, after satisfying all obligations and liabilities of the fund there remains a positive equity
in the approximate amount of $370,555.14.
Now, therefore, be it
Resolved, after discussion with the Town Engineer this Town Board declares said project
complete; and be it further
Resolved, that the Town Board approves, authorizes and directs the Town Finance Officer to
close the accounting and financial records for the Town of Ithaca Sand Bank Road Improvement
Capital Project Fund; and be it further
Resolved, that the Town Board approves, authorizes and directstheremaining equity in the
Town of Ithaca Sand Bank Road Improvement Capital Project Fund be transferred to the Debt
Service Fund for payment of principal and interest of the 2014 Public Improvement (Serial)
Bonds.

to Override the Tax Levy Limit Established in General Municipal Law §3-c
Resolved that the Town Board of the Town of Ithaca will hold a Public Hearing on July
13, 2020 at 5:30 p.m., local time, at the Town Hall of the Town of Ithaca, 215 N. Tioga
Street, Ithaca, NY, regarding adoption of a proposed local law to override the tax levy limit
established in General Municipal Law §3-c, for the fiscal year beginning January 1, 2021
and ending December 31, 2021.

TB Resolution 2020 - d: Adoption of Revised Weather-Related Time Off Procedures
Whereas, the Employee Relations Committee, Personnel& OrganizationCommittee and Teamsters
Shop Stewards have reviewed the revised Weather-Related Time Off Procedures to update
procedures and essential position lists; and
Whereas, the Personnel & Organization Committee recommends adopting the revised Weather-
Related Time Off Procedures to replace the current policy in the Personnel Manual; now, therefore,
be it
Resolved, that the Town Board of the Town of Ithaca hereby approves the revised Weather-Related
Time Off Procedures to replace the current policy in the Personnel Manual; and be it further

TB Resolution 2020 - e: Approval of Revised Electrical / Code Enforcement Officer Job
Description
Whereas, the Director of Code Enforcement discussed a change to the Electrical / Code
Enforcement Officer job description with the Personnel and Organization committee requesting the
addition of certification by ICCC as an alternative option. The change would be as follows:
*SPECIAL REQUIREMENTS:
• Incumbent must complete an electrical certification from the IAEI or the ICCC within
eighteen months of appointment, if they do not already have it. Incumbent must maintain
electrical certification for the duration of employment.
; and
Whereas, the Personnel and Organization committee recommends the revised job description; now,
therefore, be it
Resolved, the Town Board of the Town of Ithaca does hereby approve the revised job description
for Electrical / Code Enforcement Officer.
TB Resolution 2020 - f: Appointment of Susan Kirby to the Ethics Board
Whereas, Susan Kirby has served on the Ethics Board two previous terms and is eligible for
reappointment following one term period not serving on the Ethics Board, and
Whereas there is a vacancy on the Ethics Board as of this date, now therefore be it
Resolved, that the Town Board hereby appoints Susan Kirby for a five year term through December
31, 2024.
WEATHER RELATED TIME-OFF PROCEDURES Revised draft 2.7.20
A. EMERGENCY CLOSING PROCEDURES
The Town Supervisor (Town) and General Manager (SCLIWC) make the final decision for
closing Town and SCLIWC facilities during inclement weather or other unusual incidents.
This decision will be based on information provided by the Public Works Superintendent,
Sheriff's Department, Tompkins County and other sources.
1.) If the Town Supervisor closes, then he/she will notify the Human Resources Manager
and the media for Town facilities. If the General Manager closes the facility, then
he/she will notify the media for SCLIWC.
2.) The Human Resources Manager (Town) and the General Manager (SCLIWC) (or their
designee) will notify employees as soon as possible that the facility is closed. If you
are not notified that the facility is closed then the facility is considered opened and you
should report to work at your regular time (see below, road closures.)
B. OFFICES OFFICIALLY CLOSED
The Town Supervisor (Town)/ General Manager (SCLIWC) may close the public offices due
to weather or other issues. Staff not required to work will be dismissed from their duties and
paid in full, without the use of banked leave time, for the length of time the offices were
closed to the public up to their normala regular work day, e.g.: 7.5 or 8.0 hours. Due to
specific job duties and responsibilities, some employees might be required to come into or
remain at work. If the Bolton Point facility is closed, then only notified essential personnel
are required to remain at or to report to work. For Public Work staff all essential staff are
required to remain at or report to work, unless specifically notified otherwise.
Employees required to work when a facility is officially closed will receive, over and above
regular pay, time equal to the number of hours the closing facility
iswas closed to the public or to the end of their regular shift, less the half-hour lunch time, if
applicable. For example: if Town Hall closes at noon, essential staff would receive 4 hours
of Other Time. Full day closures would be 8 hours of Other Time. This time off will be

amount of hours the offices were closed, excluding the half-hour lunch break, if applicable.
Employees scheduled to work any shift during the day of closure will receive the Other Time.
Employees working a different schedule and therefore, not scheduled to work the day of the
closure, will not receive the Other Time.
Use of the Other Time shall be requested off (preferably within 30 days of the closure) using
the same procedure as Vacation Time. The Other Time should be taken at one time and
not spread out over multiple days.
a. Official Road Closures:
If the roads are officially closed by the County Sherriff, then only essential positions are
required to report to work during road closures. Essential staff members should be sure
to have their employer ID cards when commuting on closed roads. All non-essential
positions will not be required to report until the roads have re-opened. Non-essential
the time that the roads are closed, and they cannot
commute to work. Once the roads are opened employees should report to work within
60 minutes. For time beyond the 60 minutes the employee may use benefit time. Time
should not exceed a regular work shift. Employees should contact their department
manager if they are not going to come in or are going to come in later than the 60 minutes.

* This policy includes counties other than Tompkins, which staff may live in or drive
through to arrive at the facility.
* During some emergency situations non-essential staff may be asked notified to report
to work to aid in coverage by providing relief time of essential staff or due to their particular
skills; e.g.: Code Enforcement, Engineering, IT, administrative positons.; they will be
notified.
C. OPEN DURING INCLEMENT WEATHER- WEATHER ADVISORY:
The safety of employees is of great importance. Therefore, during inclement weather when
want to leave early then they should contact their department manager. The employee
shall let them know that they will not be in due to the weather; will be coming in late
(specifying an about time) or want to leave early. Employees can use their fringe time
to make up the hours. No payment will be made for this time off unless banked time is
used.
