Persons to be Heard — None 3. Consider authorization to award Danby Rd Infiltration and Inflow (I&I) Study There were no questions on this action. TB Resolution 2020 - 038: Authorization to Award Contract for an Infiltration and Inflow Danbv System Study Whereas a request for proposals for an Infiltration and Inflow Danby System Study was duly advertised and three proposals were received, and Whereas the Town Engineer and staff have reviewed the proposals and qualifications of the firms, contacted past clients and has recommended that the Town Board select the proposal of $38,000 (Part A) for the study made by the firm of Larson Design Group, which is a responsive and qualified proposal, and Whereas the recommendation was discussed at the March meeting of the Public Works Committee and unanimously forwarded to the Town Board, now therefore be it Resolved that the Ithaca Town Board hereby awards the contract for the Infiltration and Inflow Danby System Study to Larson Design Group, Appalachian, New York, and authorizes the Supervisor to sign the contract subject to approval by the Attorney for the Town. TB Resolution 2020 - 039: Authorization for Supervisor to sign the Ithaca Community Childcare Center Additions and Renovations Stormwater Operation, Maintenance, and Reporting Agreement and associated stormwater and access easement Whereas the Ithaca Community Childcare Center Additions and Renovations project includes stormwater management and treatment facilities which necessitates entering into a Stormwater Operation, Maintenance, and Reporting Agreement, along with a stormwater and access easement, between the Ithaca Community Childcare Center. and the Town of Ithaca, for the property located at 579 Warren Road, tax parcel no. 73.-1-1.4, now therefore be it Resolved that the Town Board does hereby authorize the Town Supervisor to sign the Stormwater Operation, Maintenance, and Reporting Agreement and the associated stormwater and access easement associated with the Ithaca Community Childcare Center Additions and Renovation project, subject to approval by the Attorney for the Town. Consider authorization to sign Stormwater Operation and Maintenance Agreement, and associated easements for the Amabel Subdivision There were no questions about this action. TB Resolution 2020 - 040: Authorization for Supervisor to sign the Amabel Pocket Neighborhood Stormwater Operation, Maintenance, and Reporting Agreement and associated stormwater and access easement Whereas the Amabel Subdivision ("Pocket Neighborhood") project includes stormwater management and treatment facilities which necessitates entering into an Stormwater Operation, Maintenance, and Reporting Agreement, along with a stormwater and access easement, between the Amabel Home Owner's Association, Inc. and the Town of Ithaca, for the property located at 619 Five Mile Drive, tax parcel no. 31.-2-28, and the portion of 617 Five Mile Drive located on the west side of the Norfolk Southern Railroad, tax parcel no. 31.-2-6, now therefore be it Resolved that the Town Board does hereby authorize the Town Supervisor to sign the Stormwater Operation, Maintenance, and Reporting Agreement and the associated stormwater and access easement associated with the Amabel Subdivision ("Pocket Neighborhood") project, subject to the approval of the Attorney for the Town. Consider authorization for the Supervisor to sign an agreement with Tompkins County re.: Blue Ways signage Mr. Howe stated that Mr. Mosely did review the sign and it meets our Code. TB Resolution 2020 - 041: Authorization for the Town Supervisor to sign an agreement with Tompkins County for the placement of a Cayu2a Lake Bluewav Trail signs Whereas Tompkins County has initiated the Cayuga Lake Blueway Trail Project in support of its tourism efforts and had presented the concept to the Town Board at its April 22, 2019 meeting, now therefore be it Resolved that the Town Supervisor is authorized to sign the agreement with the County for the placement of the signs. Consider setting a public hearing regarding a local law for canopy signs in Residential and Conservation Zones Mr. Mosely noted that this is a simple change to allow canopy signs in residential zones such as entrance ways to identify where to enter a building such as Cayuga Ridge. TB Resolution 2020 - 042: Setting a public hearing for a proposed local law adding Canopy Sign Provisions in Residential and Conservation Zones to Chapter 270, Zoning, of the Town of Ithaca Code Resolved, that the Town Board of the Town of Ithaca will hold a public hearing at the Town Hall, 215 North Tioga Street, Ithaca, New York on March 23, 2020 at 5:00 p.m. for the purpose of considering a proposed local law adding Canopy Sign Provisions in Residential and Conservation Zones to Chapter 270, Zoning, of the Town of Ithaca Code; and it is further Resolved, that at such time and place all persons interested in the proposed local law may be heard concerning the same; and it is further Resolved, that the Town Clerk of the Town of Ithaca is hereby authorized and directed to publish a notice of such public hearing in the Ithaca Journal and to post a copy of same on the signboard in the lobby of the Town of Ithaca Town Hall. Consider Town of Ithaca Fee Schedule changes - Codes: Mr. Mosely reported that the IFD has raised their rates and this is keeping pace with that. Mr. Goodman asked if $10 covers our costs. Mr. Mosely responded that it does not but seems to have been the approved practice of the past. He added that he can analyze this and report back. Mr. Goodman said he is interested in covering our actual costs in these instances. TB Resolution 2020 - 043: Amend the Town of Ithaca Fee Schedule — Code Enforcement Fees/Fire Safety Inspections Whereas, TB Resolution 2009-227 adopted the establishment and setting of fees by town board resolution; and Whereas, the Ithaca Fire Department (IFD), by contract, assist in the fire safety inspections for the covered Fire Protection District within the town, and the town pays IFD their fee for such inspections at the Ithaca Fire Departments' rate; and Whereas, the Town then processes the inspection paperwork and bills the property owner for such inspection; and Whereas, the IFD recently increased their fees to $58 per hour for fire safety inspections; and Whereas, the Director of Code Enforcement has reviewed the fee increase and made recommended changes to the Personnel and Operations Committee; and Whereas, the Personnel and Operations Committee, at its February 24, 2020 meeting, reviewed the recommendations of the Director of Code Enforcement and recommends to the Town Board modifying the Code Enforcement fees of the Town of Ithaca fee schedule to cover the cost of the IFD fee and the cost of the Town handling the billing and paperwork; now, therefore, be it Resolved, that the Town Board of the Town of Ithaca does hereby approve and directs the Director of Code Enforcement to amend the Town of Ithaca Fee Schedule to show Fire Safety inspections and re -inspections shall be at a rate of $68 dollars for the first hour (1-hour minimum), and $58 per additional hour or part thereof. These changes are effective immediately (for inspections done on and after March 10, 2020). These inspections make TB 2020-03-9 Pg. 4 sure a certain sticker is on trusses which tell fire fighters about the structure and how it was built, which they can then use to determine how much time they have to enter the structure. TB Resolution 2020 - 044: Amend the Town of Ithaca Fee Schedule — Code Enforcement Fees/NYS Truss inspection requirement Whereas, TB Resolution 2009-227 adopted the establishment and setting of fees by town board resolution; and Whereas, the State of New York Title 19 CRR-NY 1264.2 subdivision (a) requires that enforcement of section 382-a of Executive Law shall include a fee, of $50, to be paid to the Authority Having Jurisdiction for the enforcement of 19 CRR-NY 1264, which requires identification of truss type construction for new commercial building additions and new commercial buildings prior to the issuance of a building permit from the Town; and Whereas, the Director of Code Enforcement has reviewed the fee, as required by title 19 CRR- NY 1264 and made recommended changes to the Personnel and Operations Committee; and Whereas, the Personnel and Organization Committee, at its February 24, 2020 meeting, reviewed the recommendations of the Director of Code Enforcement and recommends to the Town Board modifying the Code Enforcement fees of the Town of Ithaca fee schedule as required by titlel9 CRR-NY 1264; now, therefore, be it Resolved, that the Town Board of the Town of Ithaca does hereby approve and directs the Director of Code Enforcement to amend the Town of Ithaca Fee Schedule to comply with 19 CRR-NY 1264 requiring a fee for the inspection of truss type construction for new commercial building additions and new commercial buildings prior to the issuance of a building permit at a rate of $50 dollars in addition to the current fees that are required to be paid for building permit applications or part thereof. These changes are effective immediately (for applications submitted on or after March 10, 2020.) Consider authorization for the Supervisor to sign contract with Erdman Anthony for inspection services associated with the Danby Road sidewalk Ms. Ritter responded that we have received authorization to begin the bid process and the plan is to award at the April meeting. This contract if for them to do the actual onsite inspections. TB Resolution 2020 - 045: Authorization for Supervisor to execute a supplemental contract with Erdman Anthony for inspection services associated with the construction phase of the Danbv Road/State Road 96B sidewalk proiect. TB 2020-03-9 Pg. 5 Whereas, on August 7, 2017 the Town Board agreed to accept funding from NYS Department of Transportation (DOT) for the State Route 96B/Danby Road Sidewalk Project for construction of a sidewalk along the east side of Danby Road/State Route 96B, from Alumni Circle to the City/Town of Ithaca municipal boundary; and Whereas, on March 12, 2018 the Town Board agreed to enter into a contract agreement with Erdman Anthony for engineering services associated with the design phase of the sidewalk project; and Whereas, on April 8, 2019 the Town Board granted approval for the environmental review and alternate design for the Danby Road/9613 sidewalk project; and Whereas, on January 27, 2020 the Town Board agreed to authorize implementation and funding for the construction phase of the sidewalk project; and Whereas, inspection services are a requirement of the federal -aid project and funding for inspections was identified in the 2020-2024 Transportation Improvement Plan, approved by NYS DOT and the Ithaca Tompkins County Transportation Council, for the sidewalk project as $169,200.00; and Whereas, the supplemental agreement with Erdman Anthony estimates the cost of inspections at $167,674, with a maximum amount payable of $168,000; now, therefore be it Resolved, that the Supervisor of the Town of Ithaca is hereby authorized to execute a supplemental contract with Erdman Anthony for inspection services associated with the construction phase of the Danby Road/State Route 96B sidewalk project, subject to review by the Attorney for the Town. Consider authorization to apply for grant funding from the Tompkins County Tourism Program for preliminary design and construction cost estimates for potential expansion of the South Hill Recreation Way Mr. DePaolo asked about the issues with adjacent property owners and potential ROW issues. Mr. Goodman responded that that is going back a couple of years when there were claims that NYSEG didn't actually own the ROW and all the municipal attorneys say that is not a viable claim and NYSEG is wiling to give a license to the municipalities for use as a trail. The issue now is some of the language in that license where they have the ability to revoke the license on 30-day notice. The municipalities is talking about going back to NYSEG and getting something more like a 5 year license with extensions. The other thing people wanted to know is if we are putting a lot of money into this, how much will that be, so we understand our risk if TB 2020-03-9 Pg. 6 they can take it away. This grant is about that, determining that cost. Mr. DePaolo said he thought NYSEG was giving people essentially veto power because they wanted consensus and Mr. Goodman responded that that is no longer the case. TB Resolution 2020 - 046: Authorization to Apply for Funding through the 2020 Tompkins County Tourism Capital Grant Program for Preliminary Design and Construction Cost Estimates for the Potential Expansion of the South Hill Recreation Way — Burns Road to Banks Road Whereas, the Tompkins County Tourism Program has announced the availability of funding under the 2020 Tourism Capital Grant program, which lists feasibility studies (concept level design and determination of cost estimates) as an eligible activity, and Whereas, the Town of Ithaca, with support from Tompkins County and the Towns of Dryden and Danby, is seeking to obtain preliminary designs and construction cost estimates for the potential expansion of the South Hill Recreation Way from Burns Road to Banks Road, and Whereas, the Town of Ithaca estimates the total cost of this project to be approximately $75,000, based on cost estimates provided by several qualified engineering and landscape architect consultants, and Whereas, grant applications are due by March 17, 2020; now, therefore, be it Resolved, that the Supervisor of the Town of Ithaca, or designated representative, is hereby authorized and directed to file an application for preliminary designs and construction cost estimates for the potential expansion of the South Hill Recreation Way from Burns Road to Banks Road under the Tompkins County Tourism Capital Grants program in an amount not to exceed $75,000, and upon approval of said request to enter into and execute a project agreement with Tompkins County for such financial assistance to the Town of Ithaca. Voucher Numbers: 72-116 Check Numbers: 18864-18908 TB 2020-03-9 Pg. 8 Capital Impr/Repl Project Operating Fund TOTAL Less Prepaid TOTAL $ 145,499.18 $ 57,988.99 $ 203,488.17 S 6,431 1 $ 197,056.98 TB Resolution 2020 — 047d: Ratify Promotional Appointment of Senior Civil Engineer Whereas, there is a vacancy in the full-time position of Senior Civil Engineer in the Public Works Department due to a promotion; and Whereas, the Director of Engineering has determined that David O'Shea, Civil Engineer possesses the necessary knowledge, skills and ability to satisfactorily perform the duties of the Senior Civil Engineer; and Whereas, the Director of Engineering promotionally appoints David O'Shea, to the Senior Civil Engineer position, effective March 1, 2020; now, therefore, be it Resolved, the Town Board of the Town of Ithaca does hereby approve the provisional non- competitive promotional appointment of David O'Shea as a full time Senior Civil Engineer, effective March 1, 2020; and be it further Resolved, this is a 40 hour a week position, at the hourly wage of $35.00, which is an estimated annual salary of $72,800, in Job Classification "F", with full time benefits from account A1440.100; and be it further Resolved, if the said successfully completes the mandatory eight (8) week probationary period, there will be no further action required by the Town Board. 13. Report of Town Officials, Committees and review of Correspondence Public Works Facility Renovation — Mr. Howe reported that the recommendation is to close down access to the site including public access to compost and mulch and drop off of brush for safety reasons. Ms. Hunter asked about the length of time of this suspension. Mr. Weber said it is about 6 months. Ms. Hunter asked if there was any place offsite that people might be able to still access those materials so as not to cut off residents needs. Discussion followed on alternatives and the need to think about it before approving a closure. Safety concerns are important for both staff and members of the public. TB 2020-03-9 Pg. 9 Mr. Howe reported that Cornell is thinking about having the geo-thermal site in the Town of Ithaca and more to come on that. Coronovis-19 Mr. Howe reported on the various conference calls with the County representatives and we are following this closely and we have been posting on our own website and social media platforms and a newsletter will be going out. He summarized the high points and what is being done. NYS has declared a State of Emergency and if the County does we will have to react. Ms. Drake added that we are beginning to look at "essential' personnel and how this will affect staff pay checks and fringe leaves. Ms. Brock updated the board on Open Meetings Law suspension by the State and we will be working on holding virtual meetings via Zoom and having the public able to view and comment during public hearings on that platform. The Board discussed ways to get information out to the residents and reviewing and preparing for different scenarios and reviewing our Emergency Response Plan. Ms. Leary added that the Employee Relations Committee discussed streamlining the Sick Bank Policy as staff are concerned about what would happen if they became sick or had to take care of a family member who was sick. Mr. Howe said there are a lot of resources on the County's website; there is a lot of misinformation out there and people should be aware of that site and use it. Ms. Rosa explained the Town's ability and reach to send newsletter blasts out saying it is over 1,000 emails and she sends newsletters to the Human Services Coalition. Ms. Drake added that there is additional cleaning going on. Executive Session/Adjournment Mr. Goodman moved to enter Executive Session to discuss the employment history of a particular person, seconded by Mr. Howe, unanimous.
