1) Call to Order and Pledge of Allegiance — 5:31 p.m.

Mr. MacAnany and Ms. Slotnick spoke regarding Short Term Rentals.
Mr. Goodman moved the Fire Department items up to allow Chief Parsons to address the Board
first on the two items for the Fire Department.
Chief Parsons gave an overview of the proposed purchase.
Ms. Hunter asked whether the truck being replaced would be sold and Chief Parsons responded he
anticipates trying to sell it, but doesn't anticipate getting more than $15k for it.
3) Public Hearing regarding amending the Agricultural Conservation Easement on Town
of Ithaca TP 28.4-1.3
Mr. Goodman opened the public hearing at 5:42 p.m.; there was no one wishing to speak and the
hearing was closed.
TB Resolution 2019- 171 : Authorization to amend the Agricultural Conservation
Easement on Town of Ithaca Tax Parcel No. 28.4-1.3 owned by Gary and Lisa Ferguson
Whereas, Gary and Lisa Ferguson and the Town of Ithaca entered into a Deed of Agricultural
Conservation Easement dated January 31, 2003 (filed in the Tompkins County Clerk's Office as
Instrument Number 426247-001), and
Whereas, on September 17, 2019 Town of Ithaca Planning Staff conducted the annual
monitoring and inspection for this easement and identified that solar panels had been installed in
the Farm Area of the Agricultural Conservation Easement, which is not permitted, and
Whereas, Gary and Lisa Ferguson and the Town of Ithaca wish to amend the Deed to permit
renewable energy systems (which are allowed with conditions in the current agricultural

conservation easement model from the New York State Department of Agriculture and Markets
but not in the model easement in effect when the Fergusons and the Town of Ithaca signed the
Deed in January of 2003), and
Whereas, Gary and Lisa Ferguson and the Town of Ithaca further wish to amend the Deed to
delete the requirement for annual maintenance mowing because of (1) the presence of certain
inactive farmland wet areas that are difficult to mow; (2) the benefit of sequestering carbon in
vegetation, and (3) the fact that the current agricultural conservation easement model from the
New York State Department of Agriculture and Markets does not contain a maintenance mowing
requirement, and
Whereas, Sections 8.6 and 8.7 of the Deed provide details and procedures regarding Deed
amendments and the required approvals and consents by the Town of Ithaca, and
Whereas, the Town of Ithaca Town Board held a public hearing on December 9, 2019 on the
proposed amendments after complying with the public notice publication and mailing
requirements of Deed Section 8.6.13, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and
its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board
that amending the conservation easement is a routine or continuing agency administration and
management activity, and is a Type 11 action pursuant to 6 NYCRR Sections 617.5(c) (26) and
(39), and thus the amending the conservation easement is not subject to review under SEQRA,
now therefore be it
Resolved, that the Town Board of the Town of Ithaca hereby finds that the proposed
amendments are (a) consistent with the purposes of the Conservation Easement as established in
Section 2 of the Deed, and (b) comply with Article 49, Title 3, of the Environmental
Conservation Law, and Section 170(h) of the Internal Revenue Code (the new solar panels
provide electricity to the barn and the rest of the farm and are installed in a way that the farm's
sheep and goats can still graze under them) (areas not mowed could be used for a different type
of agricultural operations or returned to open field if desired by a future farm operation) (both
changes will allow the current farm to be more efficient and financially viable), and it is further
Resolved, that the Town Board of the Town of Ithaca hereby authorizes the execution of the
Amendment of Deed of Agricultural Conservation Easement with Gary and Lisa Ferguson for
the property located along Sheffield Road on Town of Ithaca Tax Parcel No. 28.-1-1.3, subject to
the approval of the Attorney for the Town, and it is further
Resolved, that the Town Supervisor is hereby authorized to execute said Amendment of Deed of
Agricultural Conservation Easement and other related documents on behalf of the Town.

by City of Ithaca Fire Department (Attachment 2 — Apparatus Replacement Schedule)
TB Resolution 2019 - 177: Approval for the purchase of a new Fire Pumper Truck by the
City of Ithaca
Whereas, the Town of Ithaca has entered into a Contract for Fire Protection with the City of Ithaca
for the provision of fire, and emergency medical incident response by the Ithaca Fire Department
within the Fire Protection District of the Town of Ithaca, and
Whereas, the Contract for Fire Protection specifies that the Town of Ithaca shall pay a proportion
of the Ithaca Fire Department's capital expenses, with the proportion of the Town's contribution
determined by calculation specified within the Contract, currently calculated to be 31.19% of the
capital expense, and
Whereas, the Town Supervisor has received communication from the City of Ithaca informing him
of the planned acquisition of a new Fire Pumper Truck, to be delivered in 2020, as replacement of
a 2001 Pumper Truck, at an estimated cost of $675,000 and requesting contributory payment by
the Town of Ithaca in the estimated amount of $210,532.50, and
Whereas, the City of Ithaca will issue bonds to pay for the City of Ithaca's share of the Equipment
as well as for the Town of Ithaca's share, the Town of Ithaca will not co -issue or be liable on the
bonds, the Town of Ithaca will reimburse the City of Ithaca through the annual payments to the
City of Ithaca under the Contract for Fire Protection, and
Whereas, the Town Supervisor and Town Finance Officer, after review of financial projections for
the Town's Fire Protection Fund, are recommending to this governing Town Board that the Town
of Ithaca approve the requested contribution, to be budgeted in the Fire Protection Fund of the
annual Ithaca Town Budget; now therefore be it
Resolved, that after discussion the Town Board approves the purchase of a new Fire Pumper Truck
by the City of Ithaca, and be it further
Resolved, that a certified copy of this resolution be forwarded to the Mayor of the City of Ithaca
and Fire Chief of the Ithaca Fire Department.

4) Discuss and consider setting a public hearing regarding proposed contract with the City
of Ithaca Fire Department
Mr. Goodman reviewed the changes to the current contract and will send the draft out to the full
Board when he gets it back from the City.

TB Resolution 2019 - 178: Set a Public Hearing Re2ardin2 a Proposed Fire Contract with
the City of Ithaca for Fire Protection and Emer2ency Services for Part of the Town of Ithaca
Fire Protection District
Whereas, the Town of Ithaca, on behalf of the Town Fire Protection District, has negotiated a fire
contract with the City of Ithaca for the provision of fire protection services and emergency services
in virtually all of the Town except for the Village of Cayuga Heights and the northeast portion of
the Town pursuant to Town Law § 184; and
Whereas, Town Law § 184 requires a public hearing be held on the proposed contract; now
therefore be it
Resolved, that the Ithaca Town Board will hold a public hearing at the Town Hall, 215 North Tioga
Street, Ithaca, New York, on the 30'h day of December 2019, beginning at 11:30 a.m. for the
purpose of considering the proposed fire contract; and it is further
Resolved, that at such time and place all persons interested in the proposed contract may be heard
concerning the same.

5) Public Hearing regarding a proposed local law entitled "Adding residential registry
exemptions in Chapter 207, Rental Property, of the Town of Ithaca Code"
Mr. Goodman opened the public hearing at 5:52 p.m. There was no one present and the hearing
was closed.
Mr. Goodman gave an overview. There were no questions regarding SEQR.
TB Resolution 2019 - 172: SEQR: Proposed Local Law Adding Residential Rental Re2istry
Exemptions in Chapter 207, Rental Property, of the Town of Ithaca Code
Whereas, this action is the enactment of a local law amending the Town of Ithaca Code, Chapter
207 "Rental Property", to add exemptions to the residential rental registry; and
Whereas, this is an Unlisted Action for which the Town Board of the Town of Ithaca is the
Lead Agency in an environmental review with respect to the enactment of this local law; and
Whereas, the Town Board, at its meeting on December 9, 2019, has reviewed and
accepted as adequate the Short Environmental Assessment Form (SEAF), Parts 1, 2 and 3, for this
action, prepared by the Town Planning staff, now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby makes a negative determination of
environmental significance in accordance with Article 8 of the Environmental Conservation
Law, 6 NYCRR Part 617 New York State Environmental Quality Review, and Chapter 148
Environmental Quality Review of the Town of Ithaca Code for the above -referenced action as

proposed, based on the information in the EAF Part 1 and for the reasons set forth in the EAF
Parts 2 and 3, and, therefore, a Draft Environmental Impact Statement will not be required.

Discussion
Mr. DePaolo asked about paragraph (e) and the term "financial" consideration rather than "any"
consideration because bartering had been discussed at the committee level.
Discussion followed and the Board discussed whether services or bartering should be considered
a "financial consideration" inasmuch as same as cash. The Board decided that only cash would be
considered as "financial consideration" and someone housesitting or pet -sitting or similar would
not be considered a "financial consideration" as they are not paying actual "rent." It will be
situational and may need to be revisited, but for now, only money/currency is a financial
consideration.
TB Resolution 2019 - 173: Adoption of Local Law 10 of 2019 Adding Residential Rental
Registry Exemptions in Chapter 207, Rental Property, in Town of Ithaca Code
Whereas on December 11, 2017 the Town Board adopted a local law adding Chapter 207, Rental
Property, to the Town of Ithaca Code, authorizing operating permits for certain residential rental
units in the town, and
Whereas, revisions to the law are necessary to add exemptions for circumstances that the law was
not developed to address, specifically, an exemption for dwelling units owned by a residential
cooperative corporation, where the dwelling units are leased through proprietary leases with
tenants who are owners -shareholders, and an exemption for house sitting situations where the
house sitter lives in the unit, while the owner is away, and does not pay rent, and
Whereas, the Planning Committee at meetings on 10/24 and 11/18 2019 discussed adding
exemptions to Town Code §207-1 for certain circumstances and recommended language to the
Town Board, and
Whereas, a public hearing was scheduled for December 9, 2019 on the proposed local law entitled "A
Local Law Adding Residential Rental Registry Exemptions in Chapter 207, Rental Property, of the
Town of Ithaca Code"; and
Whereas, said public hearing was duly advertised and held on said date and time at the Town Hall
of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on
behalf of or in opposition to said proposed local law, or any part thereof, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, adoption of said local law is an Unlisted Action
for which the Town Board of the Town of Ithaca, the lead agency in an environmental review with

respect to adoption of this local law, has, on December 9, 2019, made a negative determination of
environmental significance, after having reviewed and accepted as adequate the Short
Environmental Assessment Form Parts 1, 2 and 3; and
Whereas, the Town Board finds that the amendments proposed for Town Code Chapter §207
(Rental Property), Article I (Operating Permits for Certain Residential Units), Section 2017-1,
titled "Applicability", further the health and welfare of the community and are in accordance with
the Town of Ithaca Comprehensive Plan; now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby adopts Local Law No. 10 of 2019 entitled
"Local Law Adding Residential Rental Registry Exemptions in Chapter 207, Rental Property, of the
Town of Ithaca Code".

6) Consider Resolution of Appreciation — Bruce Bates
Mr. Levine called out Mr. Bate's service on the Codes and Ordinances Committee and thanked
him.
Ms. Hunter noted that Code Enforcement is one of the hardest jobs in the Town and she thanked
him for his service.
Mr. DePaolo spoke to his common-sense perspectives given at the various committees he served
on with him.
Mr. Goodman thanked him for his years of service and reminded the Board of the retirement
luncheon on Friday, December 201h where the plan is to "roast" Mr. Bates.
TB Resolution 2019-174: Recognition of Bruce Bates' Dedicated Years of Service
Whereas, Bruce Bates started his career at the town on September 2, 2008 as the Director of Code
Enforcement bringing over nine (9) years of knowledge and experience as a code enforcement
official in Chenango County; and
Whereas, under Bruce's leadership, the Codes Department implemented and embraced a
computerized database program (Municity) giving staff more access to property information both
in the field and at their desks for research and began the movement to a paperless filing system
using Laserfische; and
Whereas, Bruce instituted many changes in the department to improve customer relations and
outreach as well as creating efficiencies throughout the permitting process; and

Whereas, due to Bruce's leadership and dedication the Rental Registry program adopted by the
Town was implemented in a timely and efficient manner; and
Whereas, Bruce has worked tirelessly on the 911 re -addressing of Town properties to assist the
Tompkins County emergency services response system in delivering aid promptly and efficiently
when needed; and
Whereas, the Town of Ithaca has greatly benefited from Bruce's devotion, determination, and his
desire to serve our community in order to make it a better place to live; and
Whereas, after eleven (11) years of dedicated service, Bruce has chosen to retire from the Town
of Ithaca effective December 28, 2019; now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca, on behalf of the Town and its citizens,
expresses its sincere appreciation and gratitude to Bruce Bates for his distinguished and dedicated
service to our community.

7) Discuss and consider approval of an additional Bond Resolution associated with the PWF
Addition/Renovation Project
Mr. Goodman summarized, saying this project is going back out to bid with options and this is to
allow for additional funds if we choose to move forward.
Board members were concerned that this would mean the Town would spend the increased funds.
Mr. Solvig and Ms. Brock explained that this does not commit the funds, but rather helps with the
timeline and the ability to spend up to the total amount indicated and budgeted for.
The bidding and contract signing process was discussed and explained.
TB Resolution 2019-175: BOND RESOLUTION (Subiect to Permissive Referendum)
Authorizing the Issuance of an Additional $600,000 Bonds to Pay Part of the Cost In the
Matter of the Proposed Construction of the Public Works Facility Office Expansion, in and
for the Town of Ithaca, Tompkins County, New York, pursuant to Town Law and the Local
Finance Law
At a regular meeting of the Town Board of the Town of Ithaca, Tompkins County, New York,
held at Town Hall, in Ithaca, New York, in said Town, on the 9th day of December, 2019, at 5:30
o'clock P.M., Prevailing Time.
The meeting was called to order by Bill Goodman and upon roll being called, there were
PRESENT: Supervisor Bill Goodman; Councilperson Pamela Bleiwas, Councilperson Rich

DePaolo, Councilperson Rod Howe, Councilperson Tee -Ann Hunter, Councilperson Patricia
Leary and Councilperson Eric Levine.
The following resolution was offered by Rod Howe who moved its adoption, seconded by
Pamela Bleiwas to -wit:
BOND RESOLUTION DATED DECEMBER 9, 2019.
A RESOLUTION AUTHORIZING, SUBJECT TO PERMISSIVE
REFERENDUM, THE ISSUANCE OF AN ADDITIONAL $600,000 BONDS
OF THE TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK TO
PAY PART OF THE COST OF THE CONSTRUCTION OF THE PUBLIC
WORKS FACILITY OFFICE EXPANSION, IN AND FOR SAID TOWN.
WHEREAS, all conditions precedent to the financing of the capital project hereinafter
described, including compliance with the provisions of the State Environmental Quality Review
Act, have been performed; and
WHEREAS, at its regular meeting on March 11, 2019, the Town Board determined
approval, construction and implementation of this capital project are a Type II Action pursuant to
the regulations of the New York State Department of Environmental Conservation promulgated
pursuant to the State Environmental Quality Review Act, because the Action constitutes
"construction of a primary or accessory/appurtenant, non-residential structure or facility involving
less than 4,000 square feet of gross floor area and not involving a change in zoning or a use
variance and consistent with local land use controls," and thus approval, construction and
implementation of the capital project are not subject to review under SEQRA;
WHEREAS, the Town Board of the Town of Ithaca, Tompkins County, New York, on March
11, 2019, duly adopted a bond resolution authorizing the issuance of $800,000 serial bonds of said
Town to pay the cost of construction of the Public Works Facility Office Expansion, located at 114
Seven Mile Drive, Ithaca, New York, including furnishings, equipment, machinery, apparatus,
appurtenances, incidental improvements and expenses in connection therewith, and
WHEREAS, it has now been determined that the maximum estimated cost of such specific
object or purpose is $1,400,000, an increase of $600,000 over that previously authorized, and
WHEREAS, it is now desired to authorize the issuance of an additional $600,000 bonds of
said Town for such specific object or purpose to pay a portion of the cost thereof,
NOW, THEREFORE, BE IT RESOLVED, by the affirmative vote of not less than two-
thirds of the total voting strength of the Town Board of the Town of Ithaca, Tompkins County,
New York, as follows:
Section 1. For the specific object or purpose of paying additional costs for construction
of the Public Works Facility Office Expansion, located at 114 Seven Mile Drive, Ithaca, New
York, including furnishings, equipment, machinery, apparatus, appurtenances, incidental
improvements and expenses in connection therewith, there are hereby authorized to be issued an

additional $600,000 bonds of the Town of Ithaca, Tompkins County, New York, pursuant to the
provisions of the Local Finance Law.
Section 2. It is hereby determined that the maximum estimated cost of such specific
object or purpose is now determined to be $1,400,000, which specific object or purpose is hereby
authorized at said maximum estimated cost, and thatthe plan for the financing thereof is as follows:
a) by the issuance of the $800,000 bonds of said Town authorized to be issued pursuant
to bond resolution dated and duly adopted March 11, 2019; and
b) by the issuance of the additional $600,000 bonds of said Town authorized to be issued
pursuant to the provisions of this bond resolution and the Local Finance Law.
Section 3. It is hereby determined that the period of probable usefulness of the
aforesaid specific object or purpose is fifteen years, pursuant to subdivision 12(a)(2) of paragraph
a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum
maturity of the serial bonds herein authorized will exceed five years.
Section 4. The faith and credit of said Town of Ithaca, Tompkins County, New York,
are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as
the same respectively become due and payable. An annual appropriation shall be made in each
year sufficient to pay the principal of and interest on such bonds becoming due and payable in
such year. There shall annually be levied on all the taxable real property in said Town, a tax
sufficient to pay the principal of and interest on such bonds as the same become due and payable.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize
the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the
bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor
of said Town, the chief fiscal officer. Such notes shall be of such terms, form and contents, and
shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the
provisions of the Local Finance Law.
Section 6. All other matters except as provided herein relating to the bonds herein
authorized including the date, denominations, maturities and interest payment dates, within the
limitations prescribed herein and the manner of execution of the same, including the consolidation
with other issues, and also the ability to issue bonds with substantially level or declining annual
debt service, shall be determined by the Supervisor, the chief fiscal officer of such Town. Such
bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the
Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to
those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine
consistent with the provisions of the Local Finance Law.
Section 7. The validity of such bonds and bond anticipation notes may be contested
only if:

1) Such obligations are authorized for an object or purpose for which said Town is not
authorized to expend money, or
2) The provisions of law which should be complied with at the date of publication of
this resolution are not substantially complied with, and an action, suit or proceeding
contesting such validity is commenced within twenty days after the date of such

Section 8. This resolution shall constitute a statement of official intent for purposes of
Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are,
or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside
with respect to the permanent funding of the object or purpose described herein.
Section 9. Upon this resolution taking effect, the same shall be published in full or

with Barton & Loguidice D.P.C. for the NYS Route 96 / Trumansburg Road Pedestrian Corridor
Study, a grant funded project through NYS Department of Transportation, and
Whereas, there is now a need for additional time to complete the final project elements, estimated
to take no more than seven months, now therefore be it
Resolved, that the Town Board approves, authorizes and directs the Town Supervisor to execute
the Modification Agreement No. 1 with Barton & Loguidice D.P.C. to change the end date of the
term of agreement from December 31, 2019 to July 31, 2020, subject to the approval of the

Whereas, Donna Shaw was hired on July 10, 2019 on a part time basis, to temporarily fill the
vacant position of Deputy Finance Officer in the Finance Office; and

11) Discuss and consider establishing Sewer Permit Fees
Mr. Thaete gave an overview saying this is a process Bolton Point has passed on to the
municipalities.
Ms. Bleiwas had questions about the Fee Schedule and the calculations and the "additional
inspections" will be clarified for a handout. The fees are $400, $150 and no Charge. Each permit
comes with two (2) inspections; and then additional inspections are billed for in increments of two.
If you need more than the two that come with the permit, you pay an additional $150 for an
"extension" with up to two more inspections.
TB Resolution 2019 —181: Approval of Fee Schedule for External Plumbing Permits
Whereas Southern Cayuga Lake Intermunicipal Water Commission (Bolton Point) will no longer
conducting External Plumbing inspections and permit processing, and
Whereas the Personnel and Operations Committee reviewed and discussed proposed fees for the
Town's establishment of the processes and fees associated with taking over the administration and
issuance of External Plumbing Permits and associated Fees submitted by the Director of
Engineering and recommended them to the Town Board, and
Whereas TB Resolution 2009-227 adopted the establishment of fees by resolution, now therefore

Ms. Ritter explained that all of the project is not in the NYS ROW and we need an easement from
Ithaca College. Because of that, there are some adjustments and further work needed by the
consultants.

permanent easement from Ithaca College for property to be used for the Danby Road
sidewalk project.
Whereas, on August 7, 2017 the Town Board agreed to accept funding from NYS Department of
Transportation for the State Route 96B/Danby Road Sidewalk Project for construction of a
sidewalk along the east side of Danby Road/State Route 96B, from Alumni Circle to the City/Town
of Ithaca municipal boundary, and
Whereas, on March 12, 2018 the Town Board agreed to enter into a contract agreement with
Erdman Anthony for engineering services associated with the sidewalk project, and
Whereas, on April 8, 2019 the Town Board granted approval for the environmental review and
alternate design for the Danby Road/9613 sidewalk project, and
Whereas, at the southern -most end of the project site, topographic conditions and the presence of
a ditch adjacent to State Route 96B requires that the sidewalk be placed outside of the New York
State Department of Transportation right-of-way and on to property owned by Ithaca College, and
Whereas, Ithaca College has agreed to convey a permanent easement to the Town of Ithaca for the
southern -most portion of the sidewalk project, and
Whereas, the Town Board has reviewed the easement document prepared by Ithaca College and
reviewed by the attorney for the town, to allow for the construction and maintenance, use and
repair of a public sidewalk, now therefore be it

14) Town Officials and/or Committee Reports
Ms. Rosa reminded members that she needs to make reservations for the Association of Towns
meeting in New York City soon.
Mr. Goodman reported that the City would like to add two locations in the Town for the next deer
culling program near Six Mile Creek. More to follow.
Mr. Goodman reported on the Route 96 sidewalk and the segment in the Town cost estimates are
coming in higher than anticipate. We approved an increase in the design costs, but the City will
be coming to us for the portion of the 20% match of the increase prorated to our 500' foot length
which is estimated at $46K where the budgeted amount was $25K. He wanted the Board to start
thinking about that.
Some discussion followed on our Sidewalk Law as more and more are being requested and it was
written when we had very few.
Mr. DePaolo asked about the status of the noise from the shooting range and Mr. Goodman said it
is on the agenda for the meeting with Mayor.
Mr. Goodman reported that he and Mr. Howe met with Martha Robertson from the County
Legislature and they are interested in the Town participating in an Affordable Housing Fund.
Ms. Hunter asked about the Opportunity Zone designation on South Hill and what opportunities
or problems that may present to us. Mr. Goodman responded that Ms. Ritter has been to some
workshops and we have talked to Mr. Monkemeyer about it.

Ms. Hunter said she thought they carne with some attractive tax concessions and asked if we have
talked to the groups that are responsible for additional tax breaks at a local level and possibly
restricting those.
Mr. Goodman thought they would have to go through the regular process for that and Ms. Ritter
added that it seems the concessions from the State are geared toward investors, not the developers.
You can't own and develop the land and take advantage of the Opportunity Zone. It is supposed
to help developers secure financing.
Ms. Hunter was skeptical and wanted Lis to be aware of the intricacies questions we might have.
Mr. Goodman thought the topic Could be scheduled for a study session.
Mr. Goodman moved to enter closed session to seek the advice of counsel at 7:00 p.m., seconded
by Mr. DePaolo, unanimous.

Brief'Description of Proposed Action:
The proposed law would add two now exemptions to the rental registry law. The exemptions would be added as subsections ID and E, to Section 207-1
titled Applicability" of the Town Code, (section begins with "This article applies to all residential rental dwelling units except:"). The new proposed
language is as follows:
M. Residential dwelling units that are owned by cooperative corporations and subject to proprietary leases tinder the Cooperative Corporations Law,

Part 3 Determination of Significance
For every question in Part 2 that was answered "moderate to large impact may occur", or if there is a need to explain why a
particular element of the proposed action may or will not result in a significant adverse environmental impact, please
complete Part 3. Part 3 should, in sufficient detail, identify the impact, including any measures or design elements that
have been included by the project sponsor to avoid or reduce impacts. Part 3 should also explain how the lead agency
determined that the impact may or will not be significant. Each potential impact should be assessed considering its setting,
probability of occurring, duration, irreversibility, geographic scope and magnitude. Also consider the potential for short-
term, long-term and cumulative impacts.
The proposed law would add two new exemptions to the Town's rental registry law. The exemptions would be
added as subsections D and E, to Section 207-1 of the Town Code. The exemptions apply to:
1) residential dwelling units that are owned by cooperative corporations and subject to proprietary leases under
the Cooperative Corporations Law.
2) house sitting of an owner's principal residence while the owner is away, with the house sitter providing
security, maintenance and/or pet care, and for which the house sitter pays no money or other financial
consideration to the owner in exchange for the occupancy. For a dwelling unit to qualify as an owner's
principal residence, at least one of the property owners must reside in the dwelling unit for a minimum of 185 days
per year.
No environmental impacts are anticipated from adding these exemptions to the rental registry law. The residential
rental operating permit program is intended to help improve and maintain the health and safety aspects of rental
housing in the town. Neither of these exemptions will affect the program's efficacy. The exemption for residential
cooperative corporations arises from recognition of the fact that all cooperative corporation dwelling units have
proprietary leases with tenants who are owners -shareholders of the landlord -cooperative corporation. The Town
Board does not intend for proprietary leases where the tenant is an owner -shareholder of the landlord to be
considered a rental under this law. In addition, the cooperative corporation's bylaws commonly contain rules for a
sublet arrangement, including approval from the board of directors.
The exemption proposed for house sitting situations is necessary for clarification purposes. The Town Board does
not intend for house sitting, where the owner lives in the unit as their principal residence and the house sitter lives in
the unit while the owner is away and does not pay rent, to be considered a rental under this law. The exemption
makes this clear.
