Mr. Wilcox called the meeting to order at 7:01 p.m.

SEQR Determination: Silvers Subdivision, 919 Elmira Road
Dick Ruswick, attorney, said they're proposing to revert the lot lines to what they were before 2010.
Dr. Silvers first bought the house parcel and subsequently bought two more parcels to the north and
east. In 2010, she requested to revise the lot lines, but there were separate mortgages on the three
parcels that were never changed to conform to the approved subdivision lots. Ms. Silvers now wants
to revert the house lot line to what it was before the 2010 revision and combine the other two parcels
because the one to the east of the house is landlocked.
Mr. Bosak said it will be as if in 2009, we simply combined two of the lots.

617 New York State Environmental Quality Review for the above referenced action as proposed,
based on the information in the EAF Part 1 and for the reasons set forth in the EAF Parts 2 and 3,
and, therefore, an Environmental Impact Statement will not be required.

NOW THEREFORE BE IT RESOLVED:
That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary and
Final Subdivision Approval, as shown on the Preliminary and Final Subdivision Checklists, hav-
ing determined from the materials presented that such waiver will result in a significant alteration
of neither the purpose of subdivision control nor the policies enunciated or implied by the Town
Board; and
2. That the Planning Board hereby grants Preliminary and Final Subdivision Approval for the
proposed subdivision located on Elmira Road, as shown on the survey map noted in Whereas #3
above, subject to the following conditions:
a. Submission, for signing by the Chairperson of the Planning Board, of three dark lined prints
of the final subdivision plat, signed and sealed by the licensed surveyor who prepared the plat,
prior to filing with the Tompkins County Clerk Office; and
b. Submission of a copy of the receipt of filing to the Town of Ithaca Planning Department.

AGENDA ITEM
SEQR Determination: NYSEG Communication Mast Modification, 1260 Trumansburg Road
Joshua Silver, The Murray Law Firm, said they were here last year in support of NYSEG's application
to install a communication mast at its Trumansburg Road substation. The purpose of the mast is to
support smart grid technology, which will modernize the electrical grid in the area. Since the
approval, NYSEG took a closer look at their property and discovered that it was surveyed incorrectly
and that they owned more property than they thought when they put the application together. The
mast needs to be close to the substation because it gets hardwired in, but there's a steep slope right off
the back fence, making it a difficult building site. So having discovered that they have more land, they
want to move the mast 60 feet from the approved location to make it easier for construction to come
in and for the tower to be serviced because service people coming through the substation have to be
specially qualified NYSEG employees to get through with their trucks; with this shift, they can just
drive around it.
Mr. Wilcox asked about the survey error. It raises the question: if an error was missed before, how do
we know that it is now correct without a survey signed by a licensed surveyor?

Mr. Silver said they've done site visits to confirm the location. It was surveyed by Infinigy, who has
surveyors on staff. It was spotted because they looked at the tax map.
Mr. Wilcox liked the new location because of the access; going through the fenced -in area is an issue
when it comes to security.
Mr. Silver pointed out that this was the second iteration of their proposed access drive. The revised
plans they originally submitted to the building department proposed a second access drive coming in
from an angle, but they were told they should use the existing curb cut.
PB Resolution No. 2018-038: SEQR - Reaffirmation of Negative Determination, NYSEG
Communications Tower, 1260 Trumansburg Road, Tax Parcel No. 24.4-5.1

WHEREAS:
This action is consideration of site plan approval for the proposed NYSEG Communication Mast
project located at 1260 Trumansburg Road (NYS Route 96), Town of Ithaca Tax Parcel No. 24.-4-
5.1, Medium Density Residential Zone. The proposal involves modifying the location of the
proposed 100' tall public utility communication mast and access drive on the same property. The
Planning Board granted final site plan approval for this project on April 18, 2017, after issuing a
negative declaration of environmental significance and granting preliminary site plan approval on
March 7, 2017. New York State Electric and Gas (NYSEG), Owner/Applicant; The Murray Law
Firm, PLLC, Agent;
2. This is an Unlisted Action for which the Town of Ithaca Planning Board is the lead agency in the
environmental review with respect to the proposal;
The Planning Board, on November 6, 2018, has reviewed and accepted as adequate a Short
Environmental Assessment Form (SEAF) Part 1, submitted by the applicant, Parts 2 and 3 pre-
pared by Town Planning staff, an applicant narrative and a set of plans prepared by Infinigy, titled
"NYSEG New Communications Tower, County Hospital, 1260 Trumansburg Road, Ithaca, New
York, 14850" including sheets Tl, C1 through C8, ES1 and 2, and E1 through E4, dated
10/05/18, and other application materials; and
4. The Town Planning staff has recommended the Planning Board reaffirm its negative determina-
tion of environmental significance with respect to the proposal;
NOW THEREFORE BE IT RESOLVED:
That the Town of Ithaca Planning Board hereby reaffirms its negative determination of environmen-
tal significance that was made on March 7, 2017, in accordance with Article 8 of the Environmental
Conservation Law and 6 NYCRR Part 617 New York State Environmental Quality Review for the
above referenced proposal, based on the information in the EAF Part 1 and for the reasons set forth
in the EAF Parts 2 and 3, and, therefore, a Draft Environmental Impact Statement will not be

Mr. Wilcox opened the public hearing at 7:22 pm.; hearing no one, lie closed it at 7:23.
Mr. Bosak said that in the letter from our environmental review committee (ERC), they listed two
concerns. One was visual impacts, which we've already considered. The second comment regarding
the driveway would be part of site plan.
Ms. Balestra said that their second comment is contrary to what staff recommended they do, which
was to have the driveway go around the substation. Their concern with the staff recommendation has
to do with vegetation and grading issues, but there will be a grade no matter where you put the
driveway, and staff said to keep with the same curb cut; otherwise, they'd need DOT approval.
Ms. Fogarty asked whether they'd work with the town engineer in terms of erosion.
Mr. O'Shea said they'll do a simple SWPPP. Once the town engineering staff signs off on it, it will be
a private driveway.
Mr. Bates asked why they're using the site name County Hospital.
Mr. Haefeli suggested it's because that's the name of the substation.
Ms. Fogarty said the letter recommended planting native species to help whatever erosion might
happen.
Mr. Silver said they hadn't talked about it, but aren't opposed to it.
Ms. Balestra said staff didn't consider it necessary because there's already large trees and thick
vegetation around the area that will remain, and the visual impacts won't be increased by having a
gravel driveway in an area where there's already vegetation. In the previously approved location, the
tower would have been more visible.
Ms. Fogarty asked how many trees will be cut down.
Mr. Silver didn't know off the top of his head.

Ms. Batestra pointed out that there's already a mown path the drive will follow.
Ms. Fogarty asked if the fence will be enlarged.
Mr. Silver said it was going to be with the initial site plan, but now it won't be. The fact that mainte-
nance employees will now go around the outside of the fence to access the tower is better because not
all employees have clearance to go into the fenced area.
Ms. Fogarty asked about the last line in the ERC's letter regarding clearing sessional forest and
replacing it with native species.
Mr. Haefeti said that doesn't make sense: if they need to cut down trees to make the road, they can't
later put plantings in the road.
Ms. Brock pointed out that they'll just have to do a sedimentation and erosion control plan because
they're not disturbing enough area to require a SWPPP.
Mr. O'Shea added that they're only clearing an area that's around 20 feet wide. For them to go off
that drive, it wouldn't be cost effective.

AGENDA ITEM
SEQR Determination: Cayuga Medical Center Parking Spaces, 101 Harris B. Dates Drive
Frank Santelli, TG Miller, said when most people come in to the hospital, they go to the three-way
stop and then either continue straight to the back or turn left to the front of the building. They plan
to add 15 spaces along the driveway going to the back, and 13 in the front where a staging area used
for construction parking has been replanted. One Norway maple will need to be removed, and an
orange construction fence will protect the closest oak trees. It's a relatively flat area and will involve
boxing out the existing topsoil, bringing in gravel, and paving the area.
Mr. Wilcox commented that cars park there now; they're parked in the back, too. It's difficult to find
a parking space.
Mr. Santelli said the aim is to formalize the parking.
Mr. Wilcox said there are two access points between the lot in front of the hospital and the lot in
front of the old Biggs building: one is a sidewalk and the other is a roadway that is striped and signed
Emergency Use Only. Vehicles are using the sidewalk to get from one parking lot to the other because
the roadway is for emergency vehicles. He'd like to see the hospital open that up for cars because if
you want to get from one parking lot to the other properly, you have to go back out onto Harris B
Dates Drive and all the way around.
Mr. Bates pointed out that if you open that up to cars, you'll create a thruway for people going north
to bypass the traffic light; it's safer to exit at the light.
John Gaetano, Cayuga Medical Facilities Management, said that in their current budget for the next
two years, their goal is to put $1.5 million in capital planning for parking. The proposed 28 spaces are
for folks to park in during the day because they're having a hard time finding a space, but in the long-

term, another tot will be needed. What they'll probably do is move employees to a new parking lot
and make the current parking for visitors only.

That the Town of Ithaca Planning Board hereby makes a negative determination of environmental
significance in accordance with Article 8 of the Environmental Conservation Law and 6 NYCRR Part
617 New York State Environmental Quality Review for the above referenced actions as proposed,
based on the information in the EAF Part 1 and for the reasons set forth in the EAF Parts 2 and 3,
and, therefore, a Draft Environmental Impact Statement will not be required.

Ms. Meier Swain asked whether the new spaces are really relief, given that they're already being used.
Mr. Gaetano said there will be more consistent parking once the spaces are striped.
Mr. Wilcox added that striping will also create more spaces.

This action is consideration of Preliminary and Final Site Plan Approval for the proposed

NOW THEREFORE BE IT RESOLVED THAT:
The Town of Ithaca Planning Board hereby waives certain requirements for Preliminary and Final
Site Plan Approval, as shown on the Preliminary and Final Site Plan Checklists, having deter-
mined from the materials presented that such waiver will result in a significant alteration of nei-
ther the purpose of site plan control nor the policies enunciated or implied by the Town Board;
and
2. The Town of Ithaca Planning Board hereby grants Preliminary and Final Site Plan Approval for
the proposed 28 -space parking expansion at Cayuga Medical Center, located at 101 Harris B.
Dates Drive, as described in Whereas #3 above, subject to the following conditions:

approval by the Town of Ithaca Public Works Department.
