ZONING BOARD OF APPEALS
JULY 26 , 1989
A Regular Meeting of the Town of Ithaca Zoning Board of Appeals
was held on July 26 , 1989 at 7 : 00 P . M . at Town Hall , 126 East
Seneca Street , Ithaca , New York .
PRESENT : Chairman Henry Aron , Edward Austen , Edward King , Town
Attorney John Barney , Zoning Enforcement
Officer/ Building Inspector Andrew Frost .
ALSO PRESENT : Sue Gillis , Al Gillis , Bruce Vanek , Grace Saatman ,
Raymond Saatman .
Chairman Aron stated that the first matter before the Board
was Cornell University in regard to Cornell Graduate Housing . He
read a letter into the record that he received from Cornell
University , signed by David I . Stewart , Assistant to the Vice -
President , dated July 14 , 1989 and which is attached hereto as
Exhibit # 1 . He then read a letter into the record to David I .
Stewart from him , dated July 17 , 1989 ( attached hereto as Exhibit
# 2 ) . Next , he read a letter signed by Susan Cohen and Michael
Singer , dated July 21 , 1989 , attached hereto as Exhibit # 3 .
Chairman Aron said that since • he has written the letter and
the withdrawal of Cornell University ' s request for housing for
Undergraduate Students at Maplewood Park is official , with the
permission of the Board members if there are no further
objections , he will declare the matter moot . There were no
objections from the Board members .
Chairman Aron called the public meeting to order at 7 : 10
p . m . and stated that all posting , publication and notification of
the public hearing had been completed and that proper affidavits
of same were in order .
The first Appeal on the Agenda was the following .
ADJOURNED APPEAL ( FROM MAY 10 , 1989 ) OF PAUL JACOBS ,
APPELLANT , REQUESTING VARIANCE FROM THE REQUIREMENTS OF
ARTICLE XIII , SECTION 59A , PARAGRAPH a ) , OF THE TOWN OF
ITHACA ZONING ORDINANCE , TO PERMIT THE PLACEMENT OF A
SATELLITE DISH ANTENNA , 10 FEET IN DIAMETER , ON THE ROOF OF
THE SINGLE-FAMILY DWELLING LOCATED AT 182 CALKINS ROAD , TOWN
OF ITHACA TAX PARCEL NO . 6-33 -2 - 1 . 21 RESIDENCE DISTRICT R-
30 . SAID ORDINANCE PERMITS ONLY A FREE-STANDING DISH
ANTENNA WITH A DIAMETER OR HEIGHT OF 15 FEET OR LESS .

• Chairman Aron referred to a letter that was received from
Bruce Vanek , Owner of Satellite Consultants , which is attached
hereto as Exhibit # 4 . He asked Mr . Vanek to explain to the Board
in layman ' s terms what he stated in technical terms in his
letter , which is undated .
Mr . Vanek addressed the Board and explained why the
satellite had to be placed on the side of the house as it was .
He said that with Mr . Jacob ' s property being surrounded by hills
and trees it was the only place that they could get the reception
that they needed to have .
Chairman Aron asked Mr . Vanek , if in his opinion , Mr .
Jacobs , who expended quite a bit of money for that dish , had no
other choice but to put it where it is . Mr . Vanek stated that is
correct .
Mr . King asked Mr . Vanek if they considered using a free -
standing satellite and if they were aware of the Town ' s Ordinance
prohibiting placing a dish antenna on a roof . Mr . Vanek replied
that where Mr . Jacobs is located and the way his lot is , where it
is is the best place . In regard to the Ordinance , he felt that
it was not on the roof ; it was on the side of the house . He has
since read the Ordinance and he feels that some of the Ordinance
is unfair from what the FCC laws say but that is not the issue
• here now .
Discussion followed on the hills and the woods surrounding
Mr . Jacobs ' house and the satellite dish that was mounted on the
house .
Chairman Aron opened the public hearing . No one appeared to
address the Board . Chairman Aron closed the public hearing .
Mr . King stated that he is not convinced that the antenna
has to be where it is . Mr . Vanek responded that in some
instances , if the people have the clearance and a hill is not to
the west , it won ' t matter , in that case there could be a free -
standing satellite installed and it would work for those cases .
Mr . King read from the Ordinance in regard to free - standing
dish antennas . Mr . Frost stated that if we assumed that a free -
standing dish was one that was supported by poles and guide
wires , he is not sure but that that would be more obtrusive
looking than one sitting on a roof .
Mr . King asked Mr . Vanek how far above the roof line the
height of the satellite dish is . Mr . Vanek replied that he
believes that it is about 7 feet .

Mr . Austen asked Mr . Jacobs how close he is to his nearest
neighbors . Mr . Jacobs said that he is about 100 feet from the
property line . It is a dead - end road and there is one house
past his property .
Mr . Austen made the following motion .
RESOLVED ,, that the Town of Ithaca Zoning Board of Appeals
grant and hereby does grant a variance from Article XIII ,
Section 59a , permitting an antenna not to exceed 10 feet in
diameter to be mounted on the side of the house as shown in
the photographs taken by the Town ' s Zoning Officer , with the
following findings ;
1 . That due to extenuating circumstances where the
property is shielded by a hill on the west and to get a
proper signal , the antenna is required to be on the
roof .
2 . No neighbors appeared before the Board to object to the
position of the antenna .
3 . That the house sits in a heavily wooded area on a dead -
end road with one house beyond it .
4 . There is no other feasible location for the antenna
without extreme removal • of woodland .
5 . That Mr . Bruce Vanek from Satellite Consultants
appeared before the Board and explained the reasons for
locating the antenna in the location it is in .
6 . There is no Television Cable at this location .
Mr . King stated that he would like to say that he is very
much inclined to vote against granting this variance for the
reason that the Town took considerable pains to pass the law
restricting the placement of satellite dishes in residential
districts . Mr . King further stated that he will vote for this
tonight only because he sympathizes with the fact that Mr . Jacobs
has the antenna already installed . It is a beautiful house and
he is sure that Mr . Jacobs is not trying to devalue his own
property . He is in a cul - de - sac , a dead - end road , where he does
not affect too many people .

Mr . King then seconded the motion .
The voting on the motion was as follows :
Ayes - Austen , King , Aron .
Nays - None .
The motion was carried unanimously .
The next Appeal before the Board was the following .
APPEAL OF ALBERT P . AND SUSAN E . GILLIS , APPELLANTS ,
REQUESTING AUTHORIZATION BY THE BOARD OF APPEALS FOR THE
EXTENSION OF A LEGAL NON-CONFORMING SINGLE-FAMILY RESIDENCE
ON A LEGAL NON-CONFORMING BUILDING LOT , LOCATED AT 112 BURNS
ROAD , TOWN OF ITHACA TAX PARCEL NO . 6 - 56 -2 - 11 . RESIDENCE
DISTRICT R- 15 . SAID EXTENSION PROPOSES THE CONSTRUCTION OF
ADDITIONAL LIVING SPACE ON THE WEST SIDE OF SAID RESIDENCE
WHICH HAS AN EXISTING REAR YARD BUILDING SETBACK OF 4 + OR-
FEET , WHEREAS A - 50 -FOOT SET BACK IS THE . STANDARD FOR
• IRREGULAR-SHAPED LOTS . SAID ADDITION WILL NOT DIMINISH THE
CURRENT 4 - FOOT + OR - REAR YARD SET BACK , HOWEVER , THE
ADDITIONAL SPACE WILL BE 7 + OR - FEET FROM THE REAR YARD
PROPERTY LINE . SAID BUILDING LOT HAS A LOT DEPTH OF
APPROXIMATELY 100 + or - FEET , WHEREAS 150 FEET IS THE
STANDARD .
Chairman Aron read the description . Mr . and Mrs . Gillis
submitted to the Board , which is attached hereto as Exhibit # 5 ,
He also read a letter from R . Wade Schuette , dated July 26 , 1989 ,
( Exhibit # 6 ) and a letter from Nancy Gabriel , dated July 22 ,
1989 ( Exhibit # 7 ) .
Mrs . Susan Gillis addressed the Board and presented a
survey map of her property made by T . G . Miller , P . C . , dated June
16 , 1989 , attached hereto as Exhibit # 8 . She explained that the
reason for the request to put the addition to the west is because
there is an easement across their property from NYSE & G for a
power line , they have to keep a 50 foot distance from that power
line . The house is on a knoll which is relatively level but it
begins to pitch off to the east so it is not practical to try to
do any kind of an addition toward the east . Mrs . Gillis said
that they need to hook up to the Town of Ithaca sewer and their
plans include that but there is a nine - foot gradient from the
hook -up point at the beginning of the driveway . If they were to
• go to the east they would not be able to utilize that gradient .
Ms . Gillis said the other thing is structurally to be able
to integrate any new structure and tie it in with the existing

house ; it has to be on that level spot at the west . She said
that their existing home is less than 800 square feet but those
constraints of slope and power line and the sewer limit them and
that is the hardship .
Chairman Aron opened the public hearing .
Mr . Raymond Saatman , adjoining property owner , addressed the
Board and stated that they have concerns that during the
construction period things will spill over into their yard . He
remarked that the Gillis ' have a very limited amount of space in
which to turn around , etc . He presented a photograph to the
Board that showed that part of the Gillis driveway is actually on
his property .
Chairman Aron stated that the Gillis would be responsible
for any damages to the Saatman ' s property . Ms . Gillis remarked
that they could certainly put up some kind of a fence or
barricade so that the trucks and back hoe could not drive on the
adjoining property .
Mrs . Grace Saatman said that they were not informed on the
intention to build and she questioned the intent of any statement
made here because they do not have the best of relationships as
neighbors . She stated that Ms . Gillis spoke of the original
house . What is outlined in the photos is not the original house .
She pointed out to the Board where the original house was . What
Mrs . Gillis was referring to was an addition at which time there
was a legal agreement made to allow an extension in the boundary
to give them that 4 foot right - of -way . She does not find that
they particularly honored that as she would like them to honor it
as a neighbor and she really questions their ability to work with
a contractor within 7 feet in building that addition . Mrs .
Saatman asked what protection do they have if they accept some
expression of the Gillis verbally tonight . She said that she is
concerned that they be protected .
Mr . King asked Mrs . Saatman to show him on the survey map
the 4 feet that she referred to . Mrs . Saatman showed the Board
on the map what she was talking about . Town Attorney Barney
asked Mrs . Saatman how has it not been honored ; it looks to him
like someone conveyed by deed . Mrs . Saatman said that she means
that the Gillis as being neighbors , if they want to use their
( the Saatman lot ) , she thinks as owners , they should have
mentioned it to them . Atty . Barney said that he has not heard
the Gillis say that they want to use the Saatman ' s lot . Mrs .
Saatman said that she is stating that to the intention of what
the Gillis state tonight of what they will do , which she would
like to accept , but she is saying that the Gillis already
consider part of that lot as theirs ; the lot that is next to the

west end of their house . She mentioned three bird feeders that
are hanging in the tree that is on her land . It is little things
like that that are annoying .
Mrs . Gillis said that there is a conveyance back in the deed
somewhere for that triangle to construct an addition on the house
but she can not tell the Board when that was . She said that they
have lived there for 15 years and it was done way before that .
In response to Chairman Aron ' s question , Mrs . Gillis said that
the reason they have decided to do this addition now is mainly
financial ; they can afford to add onto their home at this time
and they have a teenage daughter who needs to have more room .
Chairman Aron asked if the 800 square feet of their house
include the bathroom and the closets . Mrs . Gillis said , yes ,
that is the total floor space of the house .
Chairman Aron closed the public hearing .
Town Attorney Barney asked the Saatman ` s if they are
opposed to the proposed construction . Mrs . Saatman replied that
• they would be happier if it were going to be further away so that
they felt that they wouldn ' t end up with any encroachment on
their property .
Mr . Austen stated that it looks like a very difficult site .
Mrs . Saatman said that it is a sizeable addition . It is not a
modest addition compared to the size of the house as it is now .
Chairman Aron interjected that the addition according to the
records before the Board is about the same as the existing house ,
square footage wise - 1600 square feet . Mr . King said that it
will still be a relatively small house . Mrs . Saatman said that
not many of us look to expand our house by 100 percent . They
knew they were buying a small lot when they bought it . Mr . King
said that it is a one acre lot .
Chairman Aron said that there are some circumstances on that
lot , as Mrs . Gillis explained to the Board , that they could do
differently provided that the terrain would allow it . Mrs .
Saatman said they could buy some right - of -way as the previous
person did and put a reasonable boundary around their addition .
That is another consideration that might be brought up .
Mr . King asked Mrs . Saatman if she is suggesting that she is
willing to sell the Gillis , a piece of land so they would have a
greater separation . Mrs . Saatman responded that it would
probably protect them to make a formal agreement of what would
then be a little more around their construction site .

Chairman Aron said if there were no more questions he would
entertain a motion .
Mr . King made the following motion .
WHEREAS , the Town of Ithaca Zoning Board of Appeals finds
that the Gillis house is unusually small and the site
unusually difficult to construct on because of the gradients
and the proximity to the neighboring lot line , and the fact
that they have one acre of land and only an 800 square foot
house would tend to make it reasonable to permit an
expansion of the dwelling and the proposal is to expand the
dwelling to the west as the only feasible way to do so
because of the topography of the land and the necessity to
maintain a gradient for eventual hook up to the sewer line ,
and
WHEREAS , the proposal seems reasonable and in general it
would be in harmony with the general purposes of the
Ordinance to permit the proposed extension . It is ap@ut the
only use that can be made and the only way it can / extended
• with any reasonable facility on this lot and the extension
would not appear to be generally detrimental to the general
amenity of the neighborhood and the character of the
neighborhood , being at this time a somewhat isolated
dwelling , not to minimize the. fact that the construction
will impact on the neighboring lot but the structure as
proposed and the uses proposed seem to be well thought out
and safely designed , and
WHEREAS , the proposal would not have any significant effect
upon the community as a whole or traffic load upon any
public street and the sewer system is adequate so the
extension should not prove detrimental to the health , safety
and general welfare of the community . However , Mr . and Mrs .
Gillis need to take heed of the concern with their
neighbors , especially in the matter of seeing that
construction vehicles do not cross lot lines and that the
products of their excavation are kept on their own lot and
to see that there is no encroachment on the neighboring lot ,
now , therefore , be it
RESOLVED , that the Zoning Board of Appeals approves the
addition as proposed by the Gillis with the following
notation .
The north side of the extension closest to the Saatman
property shall not be closer than 7 feet from the lot line ,
and that the extension be conditional on the following .

The Gillis ' will install a barricade such as a snow fence
or some other form satisfactory to the Zoning Enforcement
Officer along the north line of their property to prevent
vehicles from going around the north side of the existing
house and to prevent the excavation and the products of the
excavation going off their own property in the vicinity of
the construction .
Mr . Austen seconded the motion .
The voting on the motion was as follows .
Ayes - Austen , King , Aron .
Nays - None .
The meeting was adjourned at 8 : 35 p . m .

Dear Henry :
Cornell University is formally requesting that the Town of Ithaca Zoning
Board of Appeals remove from the agenda of its meeting on July 24 the request
for a one - year variance related to the use of housing units at Maplewood Park
by upper - class transfer students . The ZBA had set aside a decision on our
recent request for a variance until its next meeting , but we now ask that that
request be removed from the agenda .
Our request for a variance , first heard by the ZBA in late June , dealt
with the possibility of the need to place up to 120 transfer students , along
with single and married graduate students , in the one - story apartments that
are now under construction at 201 Maple Avenue . The total number of students
would not have exceeded the number for which the project was designed , and was
consistent with our earlier filing with the ZBA when this project was approved .
Since that time , our Department of Residence life has mounted an
aggressive and apparently successful marketing campaign with single and
married graduate students . We believe that , as a result of this marketing
effort , we may be able to approach full occupancy of the complex with single
and married graduate students . We continue to experience problems finding
space for our upper - class transfer population , and this may cause serious
problems for them and us in the fall , but at the present time it does not
appear that we will require access to Maplewood Park for these students and ,
therefore , a request for a variance .
The Maplewood Park project is on schedule and the contractor is expected
to have the units in place and completed in mid to late August , in time for
the arrival of graduate students .
You will understand , of course , that we must reserve our rights regarding
the restriction imposed upon the housing of undergraduates , should the
observance of that limitation in the future prove impracticable . Thank you
for your attention to this matter .

In response to your letter of July 14 , 1989 , your request
for withdrawal of the Appeal by Cornell University for a one - year
modification of the use of the housing units at the Graduate
Student Housing project from the Zoning Board of Appeals ' Agenda
of . Wednesday , July 26 , 1989 , has been noted by me .
I would like to inform you that , since this matter has been
adjourned to that date , namely , July 26 , 1989 , at that meeting I
will have to declare the matter of the Appeal withdrawn by the
applicant because of the new circumstances as stated in your
letter and , therefore , moot . That means that Cornell University
will have to comply with all conditions set forth in the decision
of the Board rendered on April 19 , 1989 . Should Cornell
University , at any time in the future , ask for a modification of
that ruling as set forth , the procedure will have to be the . same
as a completely new appeal . I trust the situation is clear to
you .

Dear Ithaca Zoning Board :
We are writing to urge you in the strangest passible way to
reject Cornell ' s request to house undergraduates in Maplewood
Park . We , like other residents of Maple hill Apartments wham we
have talked to , believe that our quality of life would greatly
decline should Cornell be allowed to go ahead with their plan to
fill Maplewood . Most of the people who live here are working
people , people with children , and graduate students ; we want the
place where we live to be generally quiet , especially at night ,
since many of us have to get up early in the morning . There is
no doubt that 120 undergraduates living next door would be far
noisier than graduate students would be .
It is hardly fair to make the people who live near
Maplewood , who had been told that only graduate students were to
live there , pay the penalty for Cornell ' s failure to make
adequate plans and for their decision to charge extremely high
• rent for student housing . We urge you to reject Cornell ' s
request .

at it ' s present location in order to receive the maj -
ority of the arc . As it is , . we had Eo sacrifice Fl
due to the angle of elevation which is 110 and azmuth
of 2640 . We are receiving G1 which is 2590 azmuth at
a 140 angle .

Description :
We ( family of 3 ) currently live in a one story home ;
2 bedrooms , 1 bath with total living space under 800 square
feet . We are hooked to Bolton Point water and natural gas
services and currently have a septic tank .
While the total lot area approximates I acre , much is
unusable because of power line easements and steep slope .
Due to topographic constraints , the house was constructed
very close to the northwest boundary .
Project Proposal
We would like to add on to the rear of the house a
space of approximately 800 square feet to include a second
bathroom , laundry room , bedroom , and a dining / living space .
In conjunction with this project , we plan to hook up to the
Town of Ithaca Sewer .
Rationale
Due to the irregular lot and the placement of the
original house , we understand the necessity of a variance .
We feel this will enable us to integrate the new addition
with the original house , utilize the most level area on the
lot , provide. for adequate gradient for the sewer and avoid
the power line constraints .
