Adjourn MEETING OF THE ITHACA TOWN BOARD Wednesday, November 6, 2019 —Noon Minutes Board Members Present: Bill Goodman, Supervisor; Members Pamela Bleiwas, Tee-Ann Hunter, Eric Levine, and Rod Howe Staff Present: Marry Mosely, Code Enforcement; Mike Solvig, Director of Finance, Paulette Rosa, Town Clerk; Dan Thaete, Town Engineer Mr. Goodman stated that this is similar, but in reverse, to the authorization we gave the City of Ithaca on the NCRE project when most of it was in the City. 1. Discuss and consider and authorization for the Supervisor to sign, a MOU with the City of Ithaca for the Town of Ithaca to have jurisdiction over CU Wrestling Center permits and inspections TB Resolution 2019 - 160: Approval of and authorization for the Supervisor to sign, an agreement between the City of Ithaca and the Town of Ithaca for Code enforcement services associated with the Cornell Friedman Wrestling Center Renovation Proiect Whereas, the Cornell Friedman Wrestling Center Renovation Project straddles municipal boundaries with the bulk of the project being in the Town of Ithaca, and Whereas,the Town of Ithaca is willing to provide code enforcement services for the entire project, and the City of Ithaca has agreed to transfer jurisdiction for this project to the Town, and Whereas,pursuant to the New York State Environmental Quality Review Act("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that approval of the proposed "Agreement Between the City of Ithaca and the Town of Ithaca for Building Permitting, Inspection, and Related Services for the Cornell University Friedman Wrestling Center" is a Type 11 action because it constitutes "routine or continuing agency administration and management,not including new programs or major reordering of priorities that may affect the environment," and thus this action is not subject to review under SEQRA; now, therefore, be it Resolved, that the Town Board of the Town of Ithaca does hereby authorize the Town Supervisor to sign an Agreement with the City of Ithaca for Building Permitting, Inspection and Related Services for the Cornell Friedman Wrestling Center Renovation Project, subject to final approval from the Attorney for the Town. Discuss and consider approval of, and authorization for the Supervisor to sign, a Stormwater O&M Agreement and associated easements for the Cayuga Medical Center Parking Lot Expansion Project Mr. Thaete gave a very brief overview. TB Resolution 2019 - 161: Authorization for Supervisor to sign the Stormwater Operation, Maintenance, and Reporting Agreement and stormwater related easements associated with the Cayu2a Medical Center Parking Lot Expansion Proiect Whereas the Cayuga Medical Center Parking Lot Expansion Project includes stormwater management and treatment facilities which necessitates entering into a Stormwater Operation, Maintenance, and Reporting Agreement, along with stormwater easement agreements, between the Medical Center and the Town of Ithaca, and Whereas,pursuant to the New York State Environmental Quality Review Act("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that approval of the proposed Operation, Maintenance and Reporting Agreement, and the proposed Permanent Stormwater and Access Easements and Right-of-Way, is a Type 11 action because it constitutes "routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment," and thus this action is not subject to review under SEQRA; now therefore be it Resolved that the Town Board does hereby authorize the Town Supervisor to sign the Stormwater Operation, Maintenance, and Reporting Agreement and stormwater easements associated with the Cayuga Medical Center Parking Lot Expansion Project, subject to the approval of the Attorney for the Town. Discuss and consider and authorization for the Supervisor to sign, and amendment to the Wedemeyer Stormwater O&M and associated easement(s) Mr. Goodman gave a brief overview. TB Resolution 2019 - 162: Approval of, and authorization for the Supervisor to sign, an amendment to the Stormwater O&M Agreement and associated easements Whereas, Robert Wedemeyer and Paula J. Wedemeyer ("Owner") previously received final approval for the stormwater pollution prevention plan(the"Approval")from the Town of Ithaca's Town Engineer for the property identified as tax parcel 24.-1-19.12 at 1458 Trumansburg Road in the Town of Ithaca, Tompkins County, New York; and TB Minutes 2019-11-06 Pg. 2 Whereas, such Approval was granted conditionally upon the construction, maintenance and implementation of approved stormwater facilities and/or other stormwater management practices, submission of stormwater inspection reports, and an agreement with the Town regarding the same; and Whereas, the Owner and the Town entered into a certain Operation, Maintenance and Reporting Agreement with an effective date of August 8, 2018, and filed in the Tompkins County Clerk's Office on August 10, 2018; and Whereas, an Amended and Restated Operation, Maintenance and Reporting Agreement is needed because various revisions have been made to the location and type of stormwater facilities and management practices; and Whereas, the Owner and the Town entered into a certain Permanent Stormwater and Access Easements and Rights-of-Way from Owner to the Town dated as of August 8, 2018 and filed in the Tompkins County Clerk's Office on August 10, 2018; and Whereas,because of the revisions to stormwater facilities and management practices, an Amended and Restated Permanent Stormwater and Access Easements and Rights-of-Way is needed in order to revise the reference to a drawing and to revise certain details of the easement areas as described; and Whereas,pursuant to the New York State Environmental Quality Review Act("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that approval of the proposed Amended and Restated Operation, Maintenance and Reporting Agreement and the proposed Amended and Restated Permanent Stormwater and Access Easements and Rights-of-Way is a Type II action because it constitutes "routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment," and thus this action is not subject to review under SEQRA; now therefore be it Resolved, that the Town Board of the Town of Ithaca approves the proposed Amended and Restated Operation, Maintenance and Reporting Agreement and the proposed Amended and Restated Permanent Stormwater and Access Easements and Rights-of-Way, and authorizes the Town Supervisor to execute these documents,subject to the approval of the Attorney for the Town. TB Minutes 2019-11-06 Pg. 3 TB Resolution 2019 - 163: Authorization for the Supervisor to sign an agreement for services provided by John Williams, Jr. Consulting Services associated with the revision and implementation of the water and sewer codes Whereas the town would like to review and revise sections of the Town of Ithaca Code relating to water and sewer regulations, and Whereas the Water and Sewer Maintenance Supervisor has requested the services of John Williams, Jr. to facilitate such a review, now therefore be it Resolved that the Town Board approves of the agreement and authorizes the Supervisor to sign same, subject to the approval of the Attorney for the Town. Discuss and consider referral of the New Building Code to the Planning Board for review and comment TB Resolution 2019 —164: Referral of the draft New Neighborhood Code to the Town Planning Board for review and comment Whereas the Planning Department has provided a draft of the New Neighborhood Code to the Town Board and held a public information session on it, and Whereas the Town wishes to hear comments on the draft document from the Town of Ithaca Planning Board, now therefore be it Resolved that the Town Board hereby refers the draft New Neighborhood Code to the Town Planning Board for review and comment. Discuss and consider authorization to Relevy unpaid Water and Sewer accounts to the 2020 Town and County tax bill Mr. Solvig noted that a number of properties do not pay their bills so that they can get put on their taxes and use it as a write off. He asked if the board wanted to consider ways to curb that since these are funds the town uses throughout the year, and the delay does affect our cash flow. Discussion followed and the Board was interested in learning more and Mr. Goodman will review our Code and report back. TOWN OF ITHACA Reconciliation of Receivables ITEM# DESCRIPTION WATER SEWER TOTALS 1 Delinquent Re-levies $ 111,952.39 $ 64,114.44 $ 176,066.83 2 Billing Credits $ (11,563.15) $ (2,890.44) $ (14,453.59) Account Receivable Balance: $ 100,389.24 $ 61,224.00 $ 161,613.24 Whereas, (Item No. 1 above) $176,066.83 of delinquent water and sewer charges inclusive of penalties and related surcharges for the billing period 12/1/18, 3/1/19, 6/1/19 and 9/1/19 remain unpaid and due to the Town as of October 15,2019 to be re-levied onto the 2020 Town and County Tax Bills; and Whereas, (Item No. 2 above) ($14,453.59) of billing credits will be carried forward for the December 2019 Water& Sewer Billing cycle; and Whereas, Town Code Chapter 261 and Town Code Chapter 210 provides for all delinquent accounts for payment of water and sewer rents and related charges to be placed on the ensuing years tax roll as a re-levy; now therefore be it Resolved,that this governing Town Board approves the list of delinquent water and sewer charges of$111,952.39 and $64,114.44 respectively, for re-levy to the 2020 Town and County Tax Roll; and therefore be it further Resolved, that a certified copy of this resolution along with a listing of those re-levied water and sewer charges are to be delivered to Tompkins County Assessment Department by the Town Receiver of Taxes for the purpose of adding these delinquent charges to the 2020 Town and County Tax Roll, the Finance Officer for accounting purposes, and to the Southern Cayuga Lake Intermunicipal Water Commission for the purpose of reconciling and account billing purposes.
