My neighbor rents her house short term by the day, or week to many families (occasionally to 10-20
young people). We live in a single family occupancy area (allowing for two unrelated parties in one
residence) but this code has never been enforced. I have lodged several complaints to the Town
Board but nothing has been done—the excuse was that the town does not have adequate personnel
to inspect and to enforce this code. How would the new legislation address the issue of occupancy
in rental property in single family areas.? The property next door is not owner occupied and the
house plus one attached apartment is rented on a short term basis to many people. It is more like a
hotel and B and B. Will the new legislation also address air B and B issues, or hotel-like rentals?
Such cases are unregulated and are unfair competition to local hotels which pay taxes for their
business.

After reviewing the proposed legislation (http://www.town.ithaca.ny.us/
documents/new-legislation), Ihave several additonalconcerns. They include:
1.Higher rents: I believe this law will result in many rental properties being
deemed non-conforming, thereby reducing supply of units and inadvertently
causing rental prices to go up even higher than they already are.
2.A"taking" from property owners: Many owners who have an ADU on their
property count on the rental income to make ends meet. If their ADU is
deemed non-conforming by the Code Enforcement Officer, there may be
significant expense involved in bringing old construction up to current
standards. Property owners may not be able to afford the improvements, or
their mortgages.
3.Inequity between owners and renters: Why is the health and safety of
renters any more important than the health and safety of owners? If the Town
wants to enact "health and safety" standards for residential properties, they
should be applied to all properties. If owners can live in non-conforming units,
why would we not allow renters to do so also?
4.Focus should be on education of renters: If the Town wants to improve the
health and safety of renters, they should launch an education campaign about
what to look for and look out for in rental properties - not try to standardize
the entire housing stock of the Town. Some properties will be non-
conforming, just as some trails are more dangerous than others. The user has
the responsibility to choose wisely.
5.Too much discretionary power vested in the Code Enforcement Officer:
What is a "proper" room size, door, or window - and how does one apply the
same standard to every unit in the Town? I forsee a legal and bureaucratic
nightmare here as homeowners realize the latitude this kind of wording gives
the enforcement officer.
I believe the law should be applied to new ADUs, but should not apply to pre-existing units.
This legislation could have unintended negative consequences, including reducing rental
supply, financial hardship on homeowners, and a potential bureaucratic and legal bottleneck
as homeowners challenge the subjective language and standards of the law (for example,
"proper room sizes").

I am very concerned that the proposed legislation (http://www.town.ithaca.ny.us/
documents/new-legislation) attempts to enforce uniform standards for accessory dwelling
units by requiring “proper” room sizes, doors, and windows. Room sizes, doors, and
windows are structural elements of the unit, which may not comply with a uniform standard
in 2017.
Many homes in the town are historic, and their design and construction may not meet the
uniform criteria proposed in your law. Homeowners live in such historic structures
throughout the town, without risk to our health and safety. When well maintained, such
historic units pose no distinct risk to the health and safety of tenants. Requiring
homeowners to comply to uniform standards governing room sizes, doors, and windows for
pre-existing historic homes could require that they replace beautiful old construction with
cookie-cutter, prefabricated elements – in order to meet the demands of your proposed
legislation. This is not in the best interest of our town, which should be seeking to preserve
the historic character of our neighborhoods.
I believe the law should be applied to new ADUs, but should not apply to pre-existing units.
The imposition of such requirements may have unintended negative consequences by
requiring homeowners to replace historic elements in their units with cookie-cutter,
prefabricated elements. The town should not be creating policies which incentivize
homeowners to make changes to their homes which undermine the historic character of our

Howard Jennings, the owner of duplexes at 1513 and 1515 Slaterville Road, phoned with comments
on the proposed legislation. He is unable to attend the public hearing on Monday and asked if I
would impart his comments to you. The following is a summary of his comments:
Mr. Jennings does not support the legislation, he is upset by it, and feels that it is an infringement
and that it will just add to his financial burden. He explained that this year the assessment on each
of his properties was raised by $55,000, so his tax burden is going to be higher. In addition, he has
had difficulty renting one of his units, which has been vacant for the past few months. It rents for
$1050 and, according to Mr. Jennings, in his grievance discussions with County Assessment, the staff
told that he should be renting his units for $1500. He feels that even at $1050/mo. he is having
trouble finding tenants. He stated that his units are kept in good shape (built in 1987) and that he is
responsible owner. He consulted with Code Enforcement staff on a particular issue when he
purchased the property a few years ago. With four units, it will cost him $600 for the operating
permit, which just adds to his financial woes. If the legislation is enacted he may sell rather than be
burdened with these additional regulations and costs.

Dear Town Board,
I believe the amount of opposition to the upcoming proposed legislation, should be enough to discard
these changes to the current Town law. We the people have spoken and yet this process feels like a
th
dictatorship! Other than the obvious, intruding on 80 percent of town’s 4Amendment Rights, via an
Operating Permit, I am adding a few more reasons to the list for the opposition.
According to the Code Enforcement complaint list of 2017, you have no basis to add any more laws to
protect “Public health and safety” as you stated in your letter. Long grass, too many cars, false smoke
alarms, and garbage concerns are already addressed in the Town Law. You do not need to inspect the
interior of a home or apartment to address these issues. The two or three worst interior complaints of
2017 were no heat, mice, and mold. You will never cure these occasional maintenance issues, trust me
I’ve tried! Neither an operating permit, nor inspections will keep mice, mold, or the heat from
occasionally being an issue.
As for over occupancy, this is a gray area in my eyes. A four-bedroom house with a Certificate of
Occupancy can house 10 family members legally, but only 2 or 3 unrelated. It just doesn’t make sense,
yet Dormitories can house 5 unrelated in one room or even in a lounge? The occupancy laws are the
heart of the housing issues in Ithaca, not the condition of housing. We do not have a student housing
problem; this County has ruined affordable housing by trying to combat student housing. Stop! It’s over,
you lost! It’s all discrimination at this point. Focus on affordable housing with supply and demand, not
trying to stop student housing. After all, most of the rental properties border the 4 colleges (FLSM?) in
the area. I assure you, landlords will gladly rent to families and working people, we don’t discriminate!
I would like you to know that I have 20 years’ experience with this housing market. I started at 20 years
old and worked from the ground up. I’ve dealt with every aspect of this Town and Cities processes. If
you move forward with this legislation here is a list of what will happen in the Town of Ithaca shortly
after.
1.Lawsuits (ie.) Syracuse landlords sued the city and won in the Supreme court in 2016 over this
same program.
2.Smaller Family landlords trying to pay a mortgage will not be able to afford the upgrades that
are required by the building department. There are only a handful of newer houses in the Town
of Ithaca that may comply with the current building codes. Homeowners will have to struggle to
pay for the upgrades, possibly have to sell their home or get foreclosed on. (ie.) to change a
non-egress window to egress…The permit alone requires a structural engineer’s drawing at
$500, a new window $300, labor $4-500……Or roughly $1200 Per window! Grandfathered you
say? “Show me the old Code” is the building Departments infamous line. It’s at the discretion of
the Code officer to determine Grandfathering according to the Town law. There is no argument
or defense as a homeowner. Who has a copy of the old building codes for proof, any of you? If
it’s Grandfathered why do we need an Operating permit anyway?
3.Family homes will then start to sell. This will raisethe assessments each timeone sells.
Currently, there are buyers willing to pay over the asking price for Real estate in Ithaca. Great
right? Not if you’re a first time homebuyer, working at Cornell, IC, the hospital etc….You can’t
afford the $250,000 mortgage! So much for affordable housing……..
4.So now that families can’t afford a house in Ithaca, the landlords/investors that have the cash
buys all those homes and rent them. Until of course the Town decides to run landlords ragged
with upgrades to current Building Codes, withholding Certificates of Compliance, or Operating
permits because a hand railing is ¾” too low, (yes it’s happened), non- legal occupancy, etc..ect.
These investors will then just start tearing these old houses down and start building new Big,
probably subsidized, “affordable housing”…. PROJECTS! Ithaca will become a commercial
housing Town within 5 years. Of course, depends on how long the Town Boards can delay the
builders, maybe it’ll be 10 yrs.
So, there it is, there is the future of Ithaca if you pass this legislation. I know this not only from
experience, but because I was approached by 5 builders as I was doing my subdivision on South Hill.
They all wanted to build big 100-300 bed buildings. I could have made out pretty well financially, but
didn’t. With deep family roots, and friends on South Hill, I chose to keep the property residential and
subdivide instead. I still ended up adding 5 million dollars to the tax roll, and still feel pretty good about
the neighborhood.
As a whole, this Town needs to stick to the legal Occupancy Fire Code according to the number of
bedrooms in a structure. Related or unrelated does not matter to a fireman. There are no Health and
Safety issues that tenants can’t work out with their landlords. Tenants have more rights than landlords
these days without the help of the Town, they can move anytime they want if they’re not happy.
This proposed program will also become a tax burden to the town residence. Audits out of Albany show
that only 15-20 percent of the cost to enforce this program is recovered (ie. fines, fees,). The town will
eventually need to pull money from other housing reserves in the budget, and raise taxes to pay for the
newly hired code enforcers, and employees needed to keep up with the paperwork.
I have plenty more information, but I believe I’ve submitted enough to help you understand the BIG
PICTURE of the proposed future of Ithaca Real Estate. I hope you, as the law makers of this Town, open
your minds past this imposing legislation and look into the future as I described. Please let the Private,
Free Market of housing work itself out. I do not want to live next to the projects! I promise, you won’t
regret discarding this proposed legislation for the future of housing. It would be better than invading
privacy, and ruining the affordable housing market completely for future families. If you need to, I
would suggest a temporary moratorium on this legislation for two years or so to prove my theory.

I am writing to express my opposition to any changes which would make it even more financially
prohibitive to own/rent property in the Town of Ithaca. This has all the signs of an additional tax in order to
increase the Town receipts.
If there are actual incidents that involve properties whereby a tenant finds issues with the rental, there are
already guidance in place in order to deal with those situations. I believe that we already pay for such
systems via regularly assessed taxes.
If there is some issue that you see as a genuine problem that is more than a concern and cannot be dealt
with through existing arrangements, I would appreciate knowing just what those issues are. If there are
particular known properties, deal with them individually and charge them - not me.
Also, what, exactly, is the benefit to any property owner choosing to rent space in exchange for paying
more?Ithaca, in general, is a oppressively overpriced market and already benefits on the student
population who need housing, etc. Personally, I have tried very hard to maintain affordable rates and
comfortable living situations for tenants, which gets harder every year as the tax rate gets pushed and
pushed.I guess I do not really understand what you hope to achieve beyond raising revenues that is not
managed by existing systems.
IF there are incidental concerns, that is something for you to work on personally or individually, not by
legislation increasing the cost of ownership on everyone who rents a property. If you cannot manage the
either flood of concerns, which I cannot imagine there are, or if the Town is not able to make rational
property assessments via established systems, sorry; I still do not like the proposal for a new charge and
additional requirements.

I have just finished reading through the three revised Local Laws (dated 11/29/17), the Summary Sheet
(dated 12/1/17), and the Inspection List (dated 11/13/17).
It appears that this revised version of the legislation is much improved, and will achieve its intended
purpose, without unduly restricting the rights of property owners.
It would have been nice if the legislation had included a sunset clause forthe waiver for owner-occupancy
requirements, one that would kick-in if a property were to ever become owner-occupied. And it might
have been appropriate to have had an exemption for historic properties listed on the National Register.
However, I don't think either of these concerns merits sending the legislation back to committee at this
point.
I will probably not be able to attend Monday night's public hearing. However, please know that you have
my support for passage of the proposed legislation.
