Board Members Present: Bill Goodman, Supervisor; Members Pamela Bleiwas, Pat Leary,
Tee -Ann Hunter, Eric Levine, and Rich DePaolo Absent — Rod Howe

1. Call to order and Pledge of Allegiance
Mr. Goodman called the meeting to order at 5:33 p.m.
2. Persons to be heard and Board Comments
Caroline Arms, President of the Forest Home Improvement Association, read a prepared
statement (Attachment 1) regarding the Forest Home Walkway study and the lack of resident
involvement, input and meetings which were promised.
Doug Brittain, also talked about the walkway and thought the Board could have fixed the
walkway with the money already spent on the study. Mr. D Brittain also agreed that the
crosswalk should be maintained also. He was upset that there was no public input which has
been promised and doesn't appear to be in the proposed contract. He thought an onsite visit to
the site with the input would be best.
Bruce Brittain spoke about the walkway and agreed with the others. He also thought there
should be input early in the design process not what is in the contract which states there will be
one meeting with adjoining property owners and nothing indicated for the community at large.
Mr. B Brittain also said there is a rumor that Forest Home residents are going to end up paying
for that and it is unconscionable to have us pay for a project that we have no input on.
Mr. B Brittain also spoke to the agenda item regarding noise and said the proposed legislation
addresses distinct, temporary noises and that is fine, but the biggest problem is the rising baseline
of noise. Forest Home is surrounded by Cornell campus and each new campus projects increases
the noise level just a little bit, but then the next project another little bit and the next another little
bit. Right now, the dominant sound in Forest Home is Cornell campus and it is going to keep
getting worse. He said he didn't know how to address that, but he wanted to mention that.
Mia Slotnick, Renwick Heights read a prepared statement regarding the recent interactive
meeting between stakeholders and the Short Term Rental Committee. (Attachment 2)

Inez Vermaas, Chair, Bed & Breakfast and Vacation Rentals of Greater Ithaca (Attachment 3)
Ms. Vermaas spoke about the decline in B&B's and the uneven playing field between legal
B&B's and Air BB which has lowered their occupancy rates significantly because they can
undercut us.
She was in favor of having STR's only be hosted and under the same regulations, insurance and
taxes as they do. She also thought the proposed violation fines should be much higher so they
are not considered a "cost of doing business" and there should be a revocation of the permit for
three offenses.
Mike MacAnannay
Mr. Macammy talked about the joint meeting also and said there were items that some people in
his group hadn't thought about and one thing that was surprising to many was the number of
nights that some of the operators do sell their houses for the night; 200+.
He said it did show that one size does not fit all for all places in the town as shown by a person
who has no neighbors even close which in cases like that, no one cares but in his neighborhood,
Renwick Heights, this is a real problem.
He is in favor of a reasonable number of nights and permits with a restricted number of permits
in any one area as well as a variance process where individual owners could apply for additional
nights for their particular circumstances where there are no neighbors or the like.
Anne Rose, Resident
Ms. Rose wanted to encourage the town to follow the City and consider adopting a Green Deal
for the town. She thought if the town and the city both adopted it it would have a huge affect
across the county and there are a number of people ready to help and spread the word and
support you in this effort.
Board comments
Mr. DePaolo thanked people for coming out and speaking and he had comments about what was
said at the combined STR Committee meeting.
Mr. DePaolo said he did a little research on the 14 day IRS rule and it is not a delineation
between a business classification and nonbusiness classification; it is simply a reporting
requirement. The IRS allows you to derive income from 14 days of rental use without either
reporting or deducting expenses for that use; after that you report and deduct. It is a business the
entire time, there is just an exemption for the first 14 days.
He said the other thing is there has been this contention that rental use of residential property is
somehow not a "a residential use" and his understanding is that it is a "residential use" and we
can't say that people who own properties are fulfilling the objective of the Medium Density
Residential zone whereas people who rent property in that zone are not. He asked Ms. Brock to
provide any clarification.

Ms. Brock responded that the court cases have said is that you look at the zoning to see what is
allowed and what is not allowed and where, for example, a single family home is allowed, the
fact that it may be rented out does not turn it into something other than a single family home. It
could be rented out for a year, six months, three months, daily is what the courts say, if the
zoning doesn't have rental restrictions or define single family how in a different way.
Mr. DePaolo responded saying so short of a delineation in our Code, the Code as it currently
exists, does not draw a distinction between rental uses and owner -occupied residences.
Ms. Brock said we do have some rental requirements, but in terms of the short-term rental issue,
these would be single-family homes and the courts would say that; they are not going to say
these are not single-family homes just because they are rented daily.
3. 5:30 p.m. Public hearing regarding a proposed a local law amending the yard and
principal building requirements for publicly owned properties and private institutions in
Chapter 270, Zoning, of the Town of Ithaca Code. (Attachment 4)
Mr. Goodman opened the public hearing at 6p.m; there was no one wishing to address the board
and the hearing was closed.
There were no questions regarding SEQR or the proposed legislation.
TB Resolution 2019 - 066: SEAR: Proposed Local Law Amending the Yard and Principal
Building Requirements for Publicly -Owned Properties and Private Institutions in Chapter
270, Zoning, of the Town of Ithaca Code
Whereas, this action is the enactment of a local law amending the Town of Ithaca Code, Chapter
270 entitled "Zoning", to amend the yard and principal building requirements for publicly -owned
properties and private institutions in the Low Density, Medium Density and High Density
Residential Zones; and
Whereas, this is an Unlisted Action for which the Town Board of the Town of Ithaca is the
Lead Agency in an environmental review with respect to the enactment of this local law; and
Whereas, the Town Board, at its regular meeting held on May 13, 2019, has reviewed and
accepted as adequate the Short Environmental Assessment Form (FEAF), Parts 1, 2 and 3, for
this action, prepared by the Town Planning staff, now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby makes a negative determination of
environmental significance in accordance with Article 8 of the Environmental Conservation
Law, 6 NYCRR Part 617 New York State Environmental Quality Review, and Chapter 148
Environmental Quality Review of the Town of Ithaca Code for the above -referenced action as
proposed, based on the information in the EAF Part 1 and for the reasons set forth in the EAF
Parts 2 and 3, and, therefore, a Draft Environmental Impact Statement will not be required.

TB Resolution 2019 - 067: Adoption of Local Law Amending the Yard and Principal
Building Requirements for Publicly -Owned Properties and Private Institutions in Chapter
270, Zoning, of the Town of Ithaca Code (Attachment 4b)
Whereas, the existing Town Code provisions in the Low, Medium, and High Density Residential
Zones require certain front, side and rear yard setbacks from boundaries with adjacent properties
for publicly -owned properties and properties of universities, colleges, cemeteries, and other
private institutions located in those Residential Zones, where the publicly -owned or institutional
property comprises at least six acres in area and is traversed by interior roads or driveways; and
Whereas, the Town Code prohibits more than one principal building on a lot in residential zones;
and
Whereas, there are publicly -owned properties and private and public educational institutions with
large tracts of land located in the Low, Medium and High Density Zones, including Cornell
University and Ithaca College, for which (1) the yard setbacks serve no useful purpose along
boundaries with adjacent properties where lot ownership is identical, and (2) the prohibition on
more than one principal building on a lot serves no useful purpose, given the campus or other
institutional setting; and
Whereas, the Town of Ithaca Comprehensive Plan envisions revising the Town Code to include
the creation of an Institutional Zone to more appropriately accommodate the unique
characteristics of public and private institutions; and in the meantime, the Town of Ithaca Codes
and Ordinances Committee has recommended the proposed local law revisions; and
Whereas, at its meeting on April 22, 2019, the Town Board of the Town of Ithaca discussed the
proposed local law and a public hearing was scheduled for May 13, 2019 at 5:30 p.m. to hear all
interested parties on the proposed local law entitled "A Local Law Amending the Yard and
Principal Building Requirements for Publicly -Owned Properties and Private Institutions in
Chapter 270, Zoning, of the Town of Ithaca Code"; and
Whereas, notice of said public hearing was duly advertised in the Ithaca Journal; and
Whereas, said public hearing was duly held on said date and time at the Town Hall of the Town
of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed local law, or any part thereof, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and
its implementing regulations at 6 NYCRR Part 617, adoption of said local law is an Unlisted
Action for which the Town Board of the Town of Ithaca, the lead agency in an environmental
review with respect to adoption of this local law, has, on May 13, 2019, made a negative
determination of environmental significance, after having reviewed and accepted as adequate the
Short Environmental Assessment Form Parts 1, 2 and 3; and

Whereas, the Town Board finds that the amendments proposed for the Low, Medium, and High
Density Residential Zones, further the health and welfare of the community and are in
accordance with the Town of Ithaca Comprehensive Plan; now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby adopts Local Law No. 3 of 2019
entitled "A Local Law Amending the Yard and Principal Building Requirements for
Publicly -Owned Properties and Private Institutions in Chapter 270, Zoning, of the Town of
Ithaca Code"; and it is further
Resolved, that the Town Clerk is hereby authorized and directed to file said local law with the
Secretary of State as required by law.

4. 5:30 p.m. Public hearing regarding the proposed purchase of real property on Culver
Rd for a preserve using Parks, Recreation and Open Space Funds (Attachment 5)
Mr. Goodman opened the public hearing at 6:03 p.m.; there was no one wishing to address the
board and the hearing was closed.
Mr. Goodman stated that the actual price was stated in Mr. Smith's memo which is under the
$90K and is the price the Finger Lakes Land Trust paid for the parcel.
TB Resolution 2019 - 068: SEAR: Acquisition of Finger Lakes Land Trust property on
Culver Road (Tax Parcel No. 31.4-14.4)
Whereas, this action is the acquisition of a 35.64 +/- acre property owned by the Finger Lakes
Land Trust, located on Culver Road (Tax Parcel No. 31.-1-14.4) in the Town of Ithaca; and
Whereas, the Town has entered into an agreement with the Finger Lakes Land Trust to purchase
the above -referenced property, which immediately adjoins the Coy Glen Critical Environmental
Area and is located across the road from the previously purchased Dress Woods Preserve, Gerda
Knegtman's Glen Preserve and Marcia's Woods Preserve; and
Whereas, the property will be acquired in order to add to the town's existing preserves in the
Culver Road area and to provide residents with additional opportunities for passive enjoyment of
the forested habitats; and
Whereas, the Town has been awarded funding from the Office of Parks, Recreation and Historic
Preservation's Environmental Protection Fund grant program to assist in purchasing this property
(75% State funds); and
Whereas, it has been determined that the above -described action is an Unlisted Action, pursuant
to the State Environmental Quality Review Act, 6 NYCRR Part 617, and Town of Ithaca Code,

Chapter 148 — Environmental Quality Review, for which the Town of Ithaca Town Board is
acting as Lead Agency in an environmental review with respect to the property acquisition; and
Whereas, the Town Board, on May 13, 2019, has reviewed and accepted as adequate the Short
Environmental Assessment Form, Parts 1, 2 and 3 prepared by Town staff for this action; now
therefore be it
Resolved, that the Ithaca Town Board hereby makes a negative determination of environmental
significance based on the information in the Short EAF Part 1 and for the reasons set forth in the
Short EAF Parts 2 and 3 in accordance with the New York State Environmental Quality Review
Act and Chapter 148 of the Town of Ithaca Code for the above referenced action as proposed
and, therefore, neither a Full Environmental Assessment Form, nor an Environmental Impact
Statement will be required.

TB Resolution 2019 - 069: Authorization for the Acquisition of a 35.64 +/- Acre Property
on Culver Road from Finger Lakes Land Trust for the Preservation of Open Space, and
for Completion of the Transaction
Whereas, the Town Board has determined that certain property owned by the Finger Lakes Land
Trust on Culver Road (Tax Parcel No. 31.-1-14.4) has ecological value deserving of protection
from development and inclusion as a town preserve; and
Whereas, this parcel immediately adjoins the Coy Glen Critical Environmental Area and will be
located across the road from previously purchased Dress Woods Preserve, Gerda Knegtman's
Glen Preserve and Marcia's Woods Preserve; and
Whereas, the property Appraisal Report, dated September 12, 2017, prepared by Kenneth V.
Gardner II of the North East Appraisals & Management Co., Inc., for the Finger Lakes Land
Trust, lists a fair market value of $112,000 for the portion of the property to be acquired by the
town; and
Whereas, the Finger Lakes Land Trust has agreed to sell the 35.64 +/- acres to the Town of
Ithaca, for a total purchase price not to exceed $90,000, which is less than the appraised fair
market value; and
Whereas, the Town has been awarded funding from the Office of Parks, Recreation and Historic
Preservation's Environmental Protection Fund grant program to assist in purchasing this property
(75% State funds); and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and
its implementing regulations at 6 NYCRR Part 617, the acquisition of this parcel is an Unlisted
Action for which the Town of Ithaca Town Board, acting as lead agency in an environmental
review with respect to the property acquisition, has, on May 13, 2019, made a negative

environmental determination of significance, after having reviewed and accepted as adequate a
Short Environmental Assessment Form Parts 1, 2 and 3; now, therefore, be it
Resolved, that the Town acquire said parcel as soon as practicable and at a cost not to exceed
$90,000 for same after receiving a proper deed fully executed and evidence satisfactory to the
attorney for the Town on this matter that the title to such property is marketable, with said funds
to be made available from the Open Space Plan Account, which has sufficient funds to cover the
costs of this acquisition, and be it further
Resolved, that the Town Supervisor be, and hereby is, authorized and requested to take such
steps (including the expenditure of Town funds for the purchase, survey, recording fees, filing
fees, and other customary real estate fees and expenses), and to execute such documents, as
deemed necessary to effectuate such purchase and the purposes of the forgoing resolutions, and
be it further
Resolved, that such lands be acquired for, and held as, passive recreation, education and
ecological forest lands for the benefit of the residents of the Town of Ithaca.

Mr. Goodman moved Item 11 up on the agenda.
Discuss and consider the Forest Home Walkway project and authorization for the
Supervisor to sign associated contracts/agreement
Mr. Goodman looked to the letter from Barton and Loudice and addressed the questions from the
persons to be heard.
The RFP that was put out did mention that in addition to the meeting with the consultants, we
would be having meetings with the community with staff, we will have staff from Public Works,
Town Board members to get input from the larger community. We wouldn't be paying our
consultants to be there, but we would have our staff get the input to discuss with the consultants.
The public is always invited to the Public Works Committee meetings, but in terms of having a
meeting at night when it would be more likely to get members of the community to attend we
wouldn't have the consultant there.
Ms. Hunter asked about the meetings and asked if she was understanding correctly that there will
be three meetings with town staff and a meeting with town staff and adjacent property owners
and she asked if that meeting would happen before the final design and not be a public meeting
but specifically for the adjacent owners.
Mr. Goodman asked Mr. Weber to respond.

Mr. Weber said what we had talked about with the consultant were the first meeting would be
town staff with the consultant to discuss what we would like to see, what our options our, what
we know about the site and get a few ideas and advice and the second meeting would be with the
consultant, staff and adjacent property owners because those will be the most affected and the
third would be another meeting with staff to get the options clarified before bringing them to the
Public Works Committee were we would have the opportunity to make changes again and then it
would be brought to the Town Board where it would be a public meeting one more time.
He said this was the solution that was discussed with staff and Mr. Goodman to be able to meet
some of the concerns of the neighborhood and keep the price down.
Ms. Hunter asked if following the meeting with the adjacent owners, would their comments and
recommendations be conveyed to the members of the PWC (yes) and that meeting would allow
public attendance (yes) and then it would come to the Town Board with those comments from
the public incorporated into the final plan and that final plan to the Town Board?
Mr. Weber responded yes, then the Town Board would determine what option is the desired
solution.
Mr. DePaolo said his understanding is that the residents are concerned that they be given enough
access to the process early enough to effect the actual outcome and not just as an addendum to a
process where the Town Board is essentially looking at something that is more or less carved in
stone so even though it may not be within the scope of our agreement with Barton & Loudice, he
wondered if there is any opportunity for an informal walk through of the project site with
residents or something where some colloquial information that could be imparted to staff that can
then be incorporated into these more formal meetings.
Mr. Goodman said he thinks we should come up with a schedule at the next Public Works
Committee meeting and figure out when to do these meetings without the consultants within the
overall schedule. He said we want to make sure we get to the second meeting with the
consultants and the adjacent property owners by the end of June when one of them is out of the
country and then we can fit in the evening meeting we would have with the full community
where we can get input from them and if we want to do a field trip out there, get that on the
schedule as well, based upon what the consultants calendar looks like. He said those should
happen before the third meeting between the consultants and staff so any comments can be
worked into that before they bring it to the Public Works Committee to finalize which three
options the Public Works Committee wants them to pursue so by the time the three options come
to the full Board it is towards the end of the process.
Ms. Leary said she thought a meeting with the larger community early on is important and not
just with our staff, but with the consultant. It would be good for the consultant to hear from the
community directly rather than filtered through our staff. She thought it was just as important as
hearing from the adjacent property owners at that stage.
Mr. Goodman thought that would require an additional meeting and more money.

Ms. Leary thought it might be worth it or to combine it with the meeting with the adjacent
property owners' meeting or have one fewer meeting with staff. She said she really thought that
by the time the process is that far along, it is almost like a done deal and the community input
needs to happen earlier.
Mr. Levine wondered if someone would address Doug Brittain's concern that it is not a
necessary expenditure of funds, $26K, for work which he is characterizing as basic and straight
forward for a design.
Mr. Weber responded that we have approached this particular project as trying to be as
transparent as possible about this. The Town has thrown money at this over time, before he got
here and also since, but there really hasn't been any plan; there have been a lot of opinions as to
what needs to be done, what should be done and there are a lot of questions on what the Town
truly should do on this. Is it really part of our transportation system, our walkways....?
It is a very difficult area so you are butting up against any number of recommendations for
designs so we thought the best thing to do is if the Town is willing to spend some money fixing a
facility, lets make a determination on what it is we are actually going to be building and what we
are going to be fixing and come up with an idea on long term maintenance of this facility.
There are five properties up there that do abut it and the trail as it exists now has not stayed
within the town ROW or owned property, it runs out onto other properties where we don't
necessarily have easements for and we were trying to get some type of design or options so we
can move forward to a design that is sustainably and maintainable that is within reasonable costs.
Mr. Goodman turned to Ms. Leary's suggestion about adding an additional meeting and find out
the cost of that and asked the Board if they are interested in that.
Mr. DePaolo said although he is not uninterested in that, he thinks that in looking at the three
proposed meetings, if he had to punt on one and replace it with another, it would be the Town
Board meeting because by then it is pretty much a formality and we will have already had the
benefit of all the information through the entire process up to that point with representatives from
Public Works, the Public Works Committee and any issues that do come up at that point in time
could be relayed to the contractor in time to effect a plausible outcome and they don't need to
come and roll it out in front of the Town Board at the end; that money would be better spent
earlier in the process.

and it is still daylight at 6pm so that should work. He said we can check in with the consultant
and see if that is feasible and wouldn't increase the price.
The Board was in favor of that swapping out the night meeting with the Town Board to an in -
person meeting with the community at large.
Some discussion followed on the type of staff from the consultant that would be at that meeting
and if there would be additional cost(s) for it and in the end it was decided to talk to them and

leave the draft resolution as is in the interest of moving forward given there is no May study
session to approve the contract.
TB Resolution 2019-070: Authorization to award contract for a study of potential Forest
Home Walkway improvements
Whereas, within the approved 2019 Town Budget monies were included for a study of options
for the Forest Home Walkway Improvements, and
Whereas, on February 28, 2019 the Town of Ithaca Director of Public Works/Highway
Superintendent received three proposals for the Forest Home Walkway Improvements study, and
Whereas, Town Staff have reviewed the proposals and qualifications of the firms, presented
recommendations to the Public Works Committee, conducted interviews and recommended that
the low proposal of $25,900.00 for the study made by the firm of Barton and Loguidice is a
qualified proposal, now therefore be it
Resolve, that the Town Board of the Town of Ithaca authorizes the Town Supervisor to sign a
contract with Barton and Loguidice, Liverpool New York, for the study of potential Forest Home
Walkway Improvements subject to final approval of the contract documents by the Town
Engineer and Attorney for the Town.

5. Discuss proposed changes to Town of Ithaca Code Chapter 184 Noise and consider
setting a public hearing
Mr. DePaolo had a question on Section 184-7 and the first reference to unreasonable noise where
it says "25' feet or more from the source of the sound" and he wondered why that is a metric if
25 feet from the source of the sound is still on the subject property; why is that still a problem?
He said he thought what we are trying to prevent is unreasonable noise at property boundaries or
at other dwellings on the subject property so if you have a multiple residence, for example, and
one of your residents is creating noise and another one objects; what does this mean? Why is 25'
feet or more important if you have 10 acres of land and you are making noise in the center, why
is it unreasonable if it is audible at 25' feet?
Ms. Brock said she didn't think the committee looked at the 25' feet specifically but we were
trying to think of all situations where the 25' feet might be on the same property or off the
property and adversely impacting people who are not making the noise as in the example given.
She thought it was in there for that reason, whether the noise is being made on the property
because if someone is making noise on their own property and there is no one to hear it and be
bothered by it, it wouldn't be unreasonable. The question is is anyone being bothered by it, if
they are it may be unreasonable noise, if there is no one then it isn't unreasonable.

Ms. Brock thought it was important to not say the noise must come from off the property because
you are going to have people impacted, such as tenants in a building, even if noise is being made
on the property, who should have the same rights as people who own their own properties.
Mr. DePaolo said his question is, if we have a nuisance threshold to determine what is
unreasonable, we have some criteria, but we essentially have a nuisance threshold, why have any
distance metric at all? If someone is being bothered, that is really the issue and her you could
say, but wait a minute, my noise is unreasonable, but it is not unreasonable beyond 25 feet so
you would have a 50' foot radius within which you can make noise.
Mr. DePaolo said it really isn't the most important enforcement metric; the metric is somebody
calls and somebody goes out and makes a judgement call about whether the noise is
unreasonable right?
Ms. Brock said we didn't really discuss the 25' feet and Mr. DePaolo said he wouldn't force the
issue since it seems it hasn't been an issue in the past.
Some discussion followed regarding our plan for more mixed uses in the Form Based Zoning
and shared space and it will come down to an interpretation of "unreasonable" rather than the
distance.
Mr. DePaolo turned to 184-9 paragraph 3 — where the "person" listed seems to be covered in
numbers 1 & 2.
Ms. Brock said number 1 is for the property owner, such as the town with Tutelo Park where 2 &
3 are for the people in charge of the event such as the person who rented Tutelo Park.
Mr. DePaolo was satisfied with that explanation.
Mr. DePaolo looked at the next line where "person" seemed unclear also and Ms. Brock said she
will look at it. This is a carryover from the City's law and the Committee didn't look at it.

6. Discuss the Public Works Facility Expansion Project
Mr. Goodman started the topic by saying the low bid was $1.4M which was way over the budget
and the first thing we thought was the contractors already had their work scheduled out and
weren't looking to price their bids in order to get the work but he didn't think it was worth that
price for a 1,400 sqft addition and HVAC renovations.
Mr. Goodman said the options are to try and rebid later in the year as the contractors are looking
to 2020 schedules, but he wanted to get comments from staff and members.
Mr. Goodman said we would have to readjust our Capital Improvement Plan but something to
think about is what if it still comes in high.
Mr. Goodman said we wanted to do this because they are very cramped down there and we are
currently talking about adding another person next year and they are on top of each other now.
Ms. Leary said she would like to look at ways to economize because she isn't confident in
rebidding and we can't count on them coming in with a lower price.
Mr. Goodman responded saying we would still be pushing it off since we would have to change
the design and redo the drawings and rebid it.
Mr. Levine asked if the really expensive price is because we are changing an existing building
and what about adding a building? You can build an 1,100 square foot house for $250K so these
numbers just don't make sense.
Mr. Goodman responded that for him, this is bringing up future space needs which he had been
thinking of as strategic planning for 10-15 years down the road but this is making him think that
rather than spending this kind of money on an addition, it would maybe be better to spend it on a
new building and that is a much bigger decision.
Mr. Levine said he was thinking a building to house some of the staff not all of the staff but
maybe that makes sense too.
Mr. Weber added that the building industry is very busy right now and finding staff has been an
issue as well as materials. We could advertise in the Fall where contractors are starting to look at
next year.
Discussion on the costs to rebid were discussed and those are minimal, so that isn't an issue. The
question is whether it would do any good.
Mr. Goodman added that there were contractors who went to the pre -bid but didn't bid.

Discussion followed on the time frame of the bid posting and opening and the number of
contractors that picked up materials, plus the clearing houses and how long contractors had to
prepare a bid.
Mr. DePaolo asked how our Consultants at HOLT estimates were so far off? What are we
paying them for? They provided some justification for why the bids were so high, but for a firm
that prides itself on being aware of market conditions and all these forces, it is unfortunate that
the estimates were about half of what came in.
Ms. Bleiwas said if we are going to re-evaluate, are we going to look at what we might need to
add or different financing because what she has been hearing is we really need to do this and the
sticker shock shouldn't get in the way of our ability to function. If we can make some changes
on both ends, in terms of budget and design, maybe we can meet somewhere in the middle.
Mr. Goodman said he thought the committees should talk some more; Public Works, Budget and
Space and Facilities and try and figure out what kind of plan we can come up with. He said he
assumes no one wants to move forward and award this so we can take a couple of committee
meetings and look at this. The board agreed.
7. Discuss and consider Bond Resolution for Winston-Salem Watermain Replacement
Project
Mr. Goodman reported that this also came in over bid by $50K and there was only one bidder so
we need to decide whether we go forward with this and if so, what process do we do to manage
the extra cost.
Mr. Weber said the bidders numbers were in line with there other bids on the two previous
projects which they didn't get as low bidder. Town staff has a lot on their plate and Bundy Rd is
still out to bid. He said this project is the last watermain section that has a high number of breaks
within the system so our process of eliminating most of our problems is almost done and by
delaying it to next year doesn't really hurt us all that much.
Discussion followed on the process of increasing the maximum price of the Public Interest
Order. The Board decided to hold off and discuss this at the Public Works Committee as it has
implications to our Capital Improvement Plan.

A RESOLUTION AUTHORIZING THE ISSUANCE OF $675,000 SERIAL BONDS OF
THE TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK, TO PAY THE COST
OF WATER SYSTEM IMPROVEMENTS FOR THE TOWN OF ITHACA MURIEL
STREET WATER MAIN REPLACEMENT WATER IMPROVEMENT AREA, IN THE
TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK.
WHEREAS, pursuant to the proceedings heretofore duly had and taken in accordance
with the provisions of Article 12-C of the Town Law, and more particularly a resolution dated
March 25, 2019, said Town Board has determined it to be in the public interest to establish the
Town of Ithaca Muriel Street Water Main Replacement Water Improvement Area (the "Area")
and to make certain improvements therefore at a maximum estimated cost of $675,000; and
WHEREAS, said improvements have been determined to be an Unlisted Action pursuant
to the regulations of the New York State Department of Environmental Conservation
promulgated pursuant to the State Environmental Quality Review Act, will not result in any
significant adverse environmental effects; and
WHEREAS, it is now desired to provide funding for such improvements for said Area;
NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Ithaca,
Tompkins County, New York, as follows:
Section 1. For the specific object or purpose of paying the cost of water system
improvements, for the Town of Ithaca Muriel Street Water Main Replacement Water
Improvement Area consisting of the replacement approximately 3,000 LF of existing 6" and 8"
water main with new 8" water main under Muriel Street from Hanshaw Road to the end of the
cul-du-sac, together with related ancillary facilities, as well as other original equipment,
machinery, apparatus, appurtenances, furnishings, incidental improvements and expenses in

connection therewith, at a maximum estimated cost of $675,000 there are hereby authorized to
be issued $675,000 serial bonds of said Town pursuant to the provisions of the Local Finance
Law.
Section 2. It is hereby determined that the plan for the financing of said specific
object or purpose is by the issuance of the $675,000 serial bonds of said Town authorized to be
issued therefore pursuant to this bond resolution.
Section 3. It is hereby determined that the period of probable usefulness of the
aforesaid specific object or purpose is forty years, pursuant to subdivision 1 of paragraph a of
Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum
maturity of the serial bonds herein authorized will exceed five years.
Section 4. The faith and credit of said Town of Ithaca, Tompkins County, New York,
are hereby irrevocably pledged to the payment of the principal of and interest on such bonds as
the same respectively become due and payable. There shall be annually apportioned and
assessed upon the several lots and parcels of land within said Town of Ithaca Muriel Street Water
Main Water Improvement Area which the Town Board shall determine and specify to be
especially benefited by the improvements, an amount sufficient to pay the principal and interest
on said bonds as the same become due, but if not paid from such source, all the taxable real
property in said Town shall be subject to the levy of ad valorem taxes without limitation as to
rate or amount sufficient to pay the principal of and interest on said bonds as the same shall
become due.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize
the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the
serial bonds herein authorized, including renewals of such notes, is hereby delegated to the
Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and
shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the
provisions of the Local Finance Law.
Section 6. The powers and duties of advertising such bonds for sale, conducting the
sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such
bonds for sale, conduct the sale, and award the bonds in such manner as he or she shall deem
best for the interests of said Town, including, but not limited to the power to sell said bonds to
the New York State Environmental Facilities Corporation; provided, however, that in the
exercise of these delegated powers, he or she shall comply fully with the provisions of the Local
Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal
bonds. The receipt of the Town shall be a full acquittance to the purchaser of such bonds, who
shall not be obliged to see to the application of the purchase money.
Section 7. All other matters, except as provided herein relating to such bonds,
including determining whether to issue such bonds having substantially level or declining annual
debt service and all matter related thereto, prescribing whether manual or facsimile signatures
shall appear on said bonds, prescribing the method for the recording of ownership of said bonds,
appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of

said bonds (and if said bonds are to be executed in the name of the Town by the facsimile
signature of the Supervisor, providing for the manual countersignature of a fiscal agent or of a
designated official of the Town), the date, denominations, maturities and interest payment dates,
place or places of payment, and also including the consolidation with other issues, shall be
determined by the Supervisor. It is hereby determined that it is to the financial advantage of the
Town not to impose and collect from registered owners of such serial bonds any charges for
mailing, shipping and insuring bonds transferred or exchanged by the fiscal agent, and
accordingly, pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such charges
shall be so collected by the fiscal agent. Such bonds shall contain substantially the recital of
validity clause provided for in section 52.00 of the Local Finance Law and shall otherwise be in
such form and contain such recitals in addition to those required by section 52.00 of the Local
Finance Law, as the Town shall determine.
Section 8. The Supervisor is hereby further authorized, at his or her sole discretion,
to execute an application, a project financing and/or loan agreement, and any other agreements
with the New York State Department of Health/or the New York State Environmental Facilities
Corporation, including amendments thereto, and including any instruments (or amendments
thereto) in the effectuation thereof, in order to effect the financing or refinancing of the specific
object or purpose described in Section 1 hereof, or a portion thereof, by a serial bond or note
issue of said Town in the event of the sale of same to the New York State Environmental
Facilities Corporation.
Section 9. The power to issue and sell notes to the New York State Environmental
Facilities Corporation pursuant to Section 169.00 of the Local Finance Law is hereby delegated
to the Town Supervisor. Such notes shall be of such terms, form and contents as may be
prescribed by said Town Supervisor consistent with the provisions of the Local Finance Law
Section 10. The intent of this resolution is to give the Supervisor sufficient authority to
execute those agreements, instruments or to do any similar acts necessary to effect the issuance
of the aforesaid serial bonds or notes without resorting to further action of this Town Board.
Section 11. The validity of such bonds and bond anticipation notes may be contested
only if:
1) Such obligations are authorized for an object or purpose for which said Town is not
authorized to expend money, or
2) The provisions of law which should be complied with at the date of publication of
this resolution are not substantially complied with, and an action, suit or proceeding
contesting such validity is commenced within twenty days after the date of such
publication, or
3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 12. This resolution shall constitute a statement of official intent for purposes
of Treasury Regulations Section 1.150 - 2. Other than as specified in this resolution, no monies

are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set
aside with respect to the permanent funding of the object or purpose described herein.
Section 13. This resolution which takes effect immediately shall be published in

substantially the form provided in Section 81.00 of the Local Finance Law.
The question of the adoption of the foregoing resolution was duly put to a vote on roll

of Ithaca Muriel Street Water Main Replacement Water Improvement Proiect
Whereas on April 30, 2019, the Town of Ithaca Director of Public Works/Highway
Superintendent received bids for the Town of Ithaca Muriel Street Water Main Replacement
Water Improvement (the "Improvement"), for the replacement of 3,000 feet of existing ductile
iron main with new 8" water main made of Polywrapped Ductile Iron pipe, new valves, hydrant
connections and related ancillary facilities, and
Whereas the Director of Public Works has reviewed the bids and qualifications of the bidders
and has determined that the lowest responsive bid of $628,000.00 for the total project was made
by the lowest responsible bidder, Chicago Construction Co. Inc., 1788 Union Center Hwy.,
Endicott, NY 13760, and
Whereas at the March 25, 2019 Town Board meeting, the Town Board adopted a Public Interest
Order (Resolution No. 2019-043) authorizing the maximum amount of $675,000.00 be expended
by the Town of Ithaca for this Improvement, now therefore be it
Resolved that the Town Board of the Town of Ithaca authorizes the award of the contract for the
Town of Ithaca Muriel Street Water Main Replacement Water Improvement project to Chicago
Construction Co. Inc., subject to final approval of the contract documents by the Town Engineer

Engineers accumulating compensatory time in excess of the 40-hour maximum preferred under
Town policy; and
Whereas, the expected workload of the Town's Civil Engineers for 2019 capital projects is such
that accumulated compensatory time is not expected to decrease but rather is expected to
continue to increase over the maximum preferred under Town policy; and
Whereas, after reviewing this situation, the Personnel & Organization Committee recommended
paying out 70 hours of accumulated compensatory time for each Civil Engineer to bring down
the amount of accumulated compensatory time within maximum preferred under Town policy;
and
Whereas, upon review the Budget Committee concurred with the Personnel & Organization
Committee and recommended the appropriation of additional funds in the 2019 Ithaca Town
Budget for this unbudgeted expense; now therefore be it,
Resolved the Town Board hereby amends the 2019 Ithaca Town Budget and authorizes and
directs the Town Finance Officer to appropriate an additional $2,200.00 from the unreserved
fund balance of the General Townwide Fund and an additional $2,200.00 from the unreserved
fund balance of the Sewer Fund to meet these expenditures, as follows:

Discuss possible special meeting — Mr. Goodman stated that we do not have the study
session in May but we will be getting the bids in on the Bundy Rd project and we need to
approve the abstract and he suggested May 301' at 4:00 p.m. Approved.
Green New Deal — Mr. Goodman discussed the recent resolution passed by the City of
Ithaca and scheduled a discussion for the June meeting.
Ms. Hunter reported that a joint meeting of the Water Resources Council and the IO will
be held here next Monday to hear from Cayuga County and their efforts to draft
regulations to protect their watershed.

Discuss petition — The petition for a yield sign at Homestead Circle was discussed and a
local Iaw to allow the placement will be drafted and a public hearing held in June.
15. Executive Session
Mr. Goodman moved to enter executive session to discuss the employment history of a
particular person, current litigation, and the possible acquisition of real property where
disclosure could affect the price. Seconded by Mr. DePaolo, unanimous.

I am Caroline Arms. I live at 200 Forest Home Drive and am President of the Forest Home
Improvement Association (FHIA).
This is in relation to item #11 on the agenda, the Forest Home Walkway Improvement Project. In
addition to my FHIA role, my husband and I own property adjacent to the Walkway.
At the February board meeting, I urged that there be engagement as soon as possible to identify
significant issues that should be taken into account in any design, with two groups of stakeholders:
adjoining property owners; and regular users of the Walkway. it is clear from the letter from B&L, thal
a meeting involving the adjacent property owners is part of the project. I was disappointed to see no
mention of a meeting to allow Walkway users to provide input at the beginning of the project. I do
recognize that contractor expenses for such meetings are non -trivial. However, by the end of this
evening I hope to have guidance from the Town Board as to how individual users can most effectively
provide input at the beginning of the design project. I should point out that not all Walkway users are
Forest Home residents. People from further away commute to campus this way. Of course, anyone
can attend a discussion of the design alternatives if that is held at a public Town Board meeting. On
FHIA's behalf, I urge that a discussion of alternatives be held in public.
One safety issue that is repeatedly brought up at FHIA meetings relates to the road intersection at the
bottom of the Walkway. FHIA urges the Town to consider whether simple changes that would improve
safety for Walkway users might be made in association with the improvement project. A useful
starting point for any discussions on this would be a drawing made as part of the Forest Home Traffic
Calming Project, which recommends moving the STOP signs to align with the associated lines painted
on the road. Without such alignment, the police cannot enforce appropriate driver behavior. I have
copies of the drawing here.
Recently, several residents have complained, with good reason, that the pedestrian crossing has been
essentially invisible for several months. I promised that I would bring this problem up at the earliest
opportunity.

Below is a photograph of part of a map that was prepared as part of the Forest Home Traffic Calming
Plan and considered part of the Final Report, dated June 29, 2007. A copy of the entire map was given
to the Town. The section included here covers the intersection of Pleasant Grove Road and Forest
Home Drive and has suggestions for improvements at the intersection, as well as for a provision for
pedestrians along Pleasant Grove Road. FHIA believes that recommendations from the Traffic Calming
Plan should be the starting point for any discussions on changes in this area.

Mia Slotnick, May 13th, 2019, Ithaca Town Board meeting
The April 3rd STR committee meeting was a discussion between the STR committee and 4 people who
are in favor or who are active hosts for STRs in the Town, and 4 Town residents with concerns and
negative experiences with STRs in their neighborhoods.
Some points that emerged from that meeting:
1. The 3 hosts at the table reported that they were renting their properties for 145 nights per year, 200
nights per year, and 220 nights per year.
There was surprise at the high occupancy rates of these STRs , which surpass occupancy rates for many
of the registered B&Bs in the area. Clearly, these hosts are not renting their homes to supplement their
incomes. These are unregulated businesses, operating with an unfair competitive advantage over
registered B&Bs, and therefore should be subject to the same state and local requirements as registered
B&Bs.
There was a suggestion that those STR hosts who wish to continue renting their properties for a large
number of days should apply for a special permit for a B&B, and should be subject to the procedures
governing B&Bs in the existing Town Code.
2. Cayuga Heights has limited the number of days allowed for STRs to 14 days of unhosted and 28 days
of hosted. The 14 days align with IRS rules. Anything over 14 days is considered a business by the IRS
and is subject to reporting and taxation. Therefore, 14 days seems a logical limit for STRs.
3. Some hosts are renting multiple properties as STRs, and have converted their long term rentals to
more lucrative STRs. This practice leads to a decrease in the availability of long term rentals and homes
available for purchase, making housing unaffordable or unavailable in the area. Limiting the number of
days for both hosted and unhosted rentals, and requiring that the property that is rented is the primary
residence will discourage this practice.
4. A One Size Fits All policy does not work for all areas of the Town for STR legislation. Some
neighborhoods are not conducive to STRs due to topography, parking limitations, and density of homes.
Some of these neighborhoods have already experienced problems with STRs. For these areas a zoning
overlay could be considered.
5. The negative impact on neighborhoods from STRs are many, but are not limited to noise, parties, and
parking. They significantly change the character of a neighborhood, and cause a loss of a sense of
community.
6. The Town's Comprehensive Plan clearly describes the purpose of Medium Density Residential zones
as almost exclusively residential. The Town Code (Section 270-65) states the following:
The purpose of the Medium Density Residential Zone is to create areas that are almost exclusively
residential in nature where there is minimal intrusion of commercial, farming, or other activities that could
be detrimental to residential development and occupancy.
STRs are basically mini -hotels —businesses operating in an area that were never intended to allow
businesses. This in direct conflict with what the Town Code, the Comprehensive Plan, and our forefathers
had intended.

BBVRGI membership has dwindled in the past 10 years from 40-50 members to 7 and the
occupancy rate is poor, appr. a 30% average per year.
Our B&B's are "honest" lodgings:
• They are registered with state and county and pay 8% sales tax and 3% occupancy tax.
• They comply with all the local codes and regulations.
• They carry sufficient liability insurance.
• They serve wholesome breakfasts.
• They are owner occupied.
Our vacation rentals:
We expect the same standards with exception of the last two: They don't provide breakfast
and they are not owner occupied.
Because we have these overheads, members of AirBnB and other such companies are able to
undercut us; hence our dwindling numbers.......
So we believe that ALL accommodation that is sold to third parties should be registered and
regulated!
Comments to draft of "Operating Permits for certain Unhosted Short Term Rental Units"
• Admirable draft!
• Would only allow Short Term Rental Units in residential areas such as Ithaca.
• Allow Unhosted Short Term Rental Units in rural areas only.
This will curb the dangerous scenario of people from all over buying properties for
short term rental purposes with the result that whole neighborhoods end up with a
lot of strangers, cars, traffic, rowdy parties and other doubtful activities.
o Double the fees and fines as stated in the document. An AirBnB with a 200 night/Year
occupancy rate will not be intimidated by these figures.

The proposed action is the acquisition of +/- 35.64 acres by the Town of Ithaca. The property to be acquired by the Town will be used for passive
recreation uses (walking, bird watching, cross country skiing, nature observation, enjoy scenic views, etc.). The acquisition will add to the Town's
existing preserves in the Culver Road area (Dress Woods, Garda Knegtman's Glen, Marcia's Woods, and the other portion of the Babcock property),
providing additional opportunities for passive enjoyment of these mixed habitats. The proposal is consistent with both the Town's Park, Recreation and
Open Space Plan and Comprehensive Plan.

There are no anticipated negative environmental impacts related to the Town of Ithaca acquisition of +/- 35.64 acres
for apreserve, The purpose of the acquisition by the Town is to protect the land for preservation purposes and to
provide Town residents with additional conservation land for passive recreation. The land contains omix ufmature
trees, open fields, and early successional areas dominated by invasive shrubs. The property ianear other lands the
Town has acquired for the same purpose and is immediately adjacent to the Coy Glen Critical Environmental Area.
While there are no designated Unique Natural Area's on this property, the Coy Glen UNA (UNA-139) is located
immediately adjacent to the north and the Culver Creek Ravine and Woods UNA (UNA-140) is located immediately
adjacent tothe south. Additionally, the property is zoned Conservation and the Future Land Use Map from the
Comprehensive Plan designates the area aa''Natuna|x]pon^ The acquisition isconsistent with both the Tmwn'a
Park, Recreation and Open Space Plan and the Comprehensive Plan.
Regarding Part 1, 12b, the Town is not aware of any archeological resources on the property. Large portions
of the parcel were farmed in the past, according to Cornell University's Digital Library database of aerial photos.
Therefore, any archeological resources would have likely been discovered with the prior disturbances.
Regarding Part 1, 13a, the property itself does not contain any regulated wetlands or water bodies. There are
significant streams located on adjacent properties to the north and south.
