TB Resolution 2018 - Adoption of Local Law 1 of 2019w : Revising the Secs for Do
Impoundment in Chapter 112, titled "Animals," of the Town of Ithaca Cade
Whereas, at its December 2018 meeting, the Personnel and Organization Committee reviewed a
request for an increase and standardization of clod; impoundment fees collected by Tompkins County
Animal Control, and forwarded the same to the Town Board, and
Whereas, at its December 1.0, 2019 meeting, the Town Board discussed a proposed local law titled
"Revising the Fees for Dog Impoundment in Chapter 1 l 2, titled "Anitnaals," of the Town of Ithaca.
Code" and set as public hearing on the local laww> for January 71, 2019 at :30 psrn. to receive public
comments on tile proposed local law, and
Whereas, notice of"said public hearing was duly advertised in the Ithaca Journal, and
Whereas, said public hearing was duly held on said date and time at the Town Hall of the Tow r.
of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in.
opposition to said proposed local lauw, or any part thereof, and.
Whereas, pursuant to the New 'York Mate Environmental Quality review ,Act i"SEE AV";i
and its implementing regulations at 6 NYCRR hart 617, it has been determined by the Town 'Board
that adoptiori of this local law is a Type ll action because it constitutes "routine or continuing agency
administration and management, not including new programs or major reordering of priorities that
may affect the environment,', and thus adoption of the propose(] local law is not subject to review
under SEQRA, now therefore be it
Resolved, that the Town Board of" the Town of Ithaca hereby adopts Local Lawn 1 of 2019:
Revising the fees for Dog impoundment in Chapter- 112, titled "Arurnals," of the Town of Ithaca.

Secretary of State as required by law..

LOCAL LAW NO. OF THE YEAR 2018
A LOCAL LAW REVISING THE FEES FOR DOG IMPOUNDMENT IN CHAPTER 112,
TITLED "ANIMALS,"OF THE TOWN OF ITHACA CODE
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Chapter 112 (Animals) of the Town of Ithaca Code, Article I (Dog Control and
Licensing), § 112-10, titled"Impoundment fees," is amended by:
A. Deleting subsections A through C in their entirety;
B. Adding new subsections A through D reading as follows:
"A. For the first impoundment of any dog owned by a person: $25
B. For the second impoundment of any dog owned by the same person within 12 months
of the first impoundment of any dog owned by the same person: $50
C. For the third impoundment of any dog owned by the same person within 12 months
of the first impoundment of any dog owned by the same person: $75
D. If more than one dog owned by the same person is impounded at the same time, the
impoundment of each dog is considered a separate impoundment. (For example, if
two dogs owned by the same person are impounded at the same time and the owner
has not had any dogs impounded within the past 12 months, the fees are $25 for one
dog and$50 for the other dog.)"
Section 2. In the event that any portion of this law is declared invalid by a court of competent
jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity.
Section 3. This local law shall take effect upon its filing with the New York Secretary of State.

TB Resolution 2019 - : Resolution of Appreciation and Recognition of Service for Ellie,
Stewart
Whereas, Ellie Stewart was appointed to the Town of Ithaca Conservation Board in January
2011, and served as Chair of such board from January 2014 through 2017; and
Whereas, Ms. Stewart submitted her resignation on said board effective December 31, 2018; and
Whereas, Ms. Stewart has been a significant member of the board, who has devoted much
personal time and energy to Conservation Board projects,including serving on the
Environmental Review Committee(chairing the ERC for three years) and the Coy Glen
Conservation Zone Committee; and
Whereas, Ms. Stewart's background and her passion for environmental concerns has been a
valuable asset to the board; and
Whereas, the Town of Ithaca is indebted to Ms. Stewart for her contributions and service to the
town and its citizens in these capacities;
Now, Therefore, Be It
Resolved, that the Town Board of the Town of Ithaca, on behalf of the Town and its citizens,
express our sincere appreciation and gratitude to Ellie Stewart for her dedicated and valuable
service to our community.

Whereas the Zoning, Board rd of Appeals members have recommended that hob loosen be
reappointed as Chair l`or the year ending december 31 2019, and
Whereas the David Squires and David Filibcr°to have indicated they would like to be reappointed
as Alternate Members and Christine Juni; has indicated she would like to be reappointed as a.
Regular Mehiber, now therefore be it.
Resolved that the Town Board of the Town of Ithaca hereby reappoints Rely Rosen as Chair for
the year 21119 and reappoints Christine .hang as a Regular Member for a five-year term ending

Annual Contracts
Resolved, that the Ithaca Town Board hereby approves and authorizes the Town Supervisor to
execute annual contracts; which amounts were included as part of the 2019 Town Budget or are

TB Resolution 2019- : Approve the 20,19 Agreement for the Expenditure of Highway
Monies
Resolved that the Town Board of the Town of Ithaca approves the following Agreement
with the Hip,1way Superintendent of the Town of Ithaca for 2019:
AGREEMENT between the Town Highway Superintendent of the Town of Ithaca, Tompkins
County, New York and the undersigned members of the'Town Board.
Pursuant to the provisions of Section 284 (if the Highway Law, we agree that moneys levied and
collected in the Town for the repair and improvement of highways, and received from the State
for State Aid tiara-the repair and improvement of highways, shall be expended as follows:
HIGHWAY:
1. GENERAL. REPAIRS. The sum of$200,000 shall be set aside to be expended for primary
work- and general repairs upon 7 miles of town highways, including sluices, culverts, and
bridges having a span of less than five feet and walks or the renewals thereof.
1 PERMANENT IMPROVEMENTS. The sura of S200,000 shall be set aside to be expended
for the permanent improvement of town highways, including paving, guide rails, etc.
The sura of$300,000 shall be set aside to be expended for the permanent improvement of
Poole Road to re-establish shoulders and install an asphalt overly on 0,86 miles of road
The sum of$500,000 shall be set aside to be expended for the permanent i rnprovernent of the
lower section of'Bundy Road to re-establish shoulders, gutters, drainage facilities,
replacement of gravels and asphalt on 0.08, miles of road

TB Resolution 2019-000: Authorizing Certain Expendituresby the Superintendent of
Highways without Prior TownBoard Approval
Whereas, Section 142, Subdivision- I(a) of the New York Highway Law authorizes the Town
Board to adopt a resolution permitting the Town Superintendent of Highways to liurchase
equipment, tools and implements without prior approval of the Town. Board in ail arnount or
amounts to be fixed by it from tirne to time; and
Whereas, the Town Board adopted a 2019 Ithaca Town Budget which included ninnies for tile
purchase of vehicles, tools and equipment-, and
Whereas,, it is determined by this Board to be reasonable and proper and in the best interests of
the efficient functioning of the Public Works Department that the Town Superintendent of
Highways be granted permission to purchase such iterns without its prior approval in amounts
not to exceed the approved respective budgeted amounts; now therefore be it
Resolved, that the governing Town Board of the Town of Ithaca does hereby authorize the ']"own
Superintendent eat l-lighways to spend amounts, not to exceed what is identified within the
adopted 2019 Ithaca Town Budget, without the prior approval of this Board, for the purchase
during fiscal year 2019 of vehicles, tools and equipment to be used for highway maintenance,
constrLICtion, reconstruction, and/or snow removal; except when the lowest responsive and
responsible bidder is not selected and be it further
Resolved, that the authorization hereinabove granted shall be construed as meaning that the total
amount spent on each item purchased by the Town Highway Superintendent during.fiqcal year
2019 shall not exceed the respective budgeted amount for that item in the adopted 2019'rown of
Ithaca budget.

West flill Water System Improvements; and
Whereas, the Town board entered into an contract with (j'HD Consulting, Inc. to provide such services
to assist the Town in detern-iining water system immiprovenneants in the South and West Hill, arena, of the
Town of Ithaca that will increase customer service and system operation, and
Whereas, Gl1iD Consulting, Inc. has prepared a model ef, the water system, analyzed existing
conditions and made rccornmendations in the form of findings about potential system improvement
changes and upgrades; and
Whereas, The Public Works Committee met on February 20, 2018, received a presentation by GHD
Consulting,, Inc. about its findings, reviewed they findings anndl has recommended acceptance dna" the
findings by tine Town Board, and
Whereas, the Town.Board enact dein February 26, 2018 received as presentation by GH.D Consulting, Inc,
about its findings, and reviewed the findings, now therefore be it.

Inc. regarding recommended system changes and upgrades, which findings will be reflected in the
forthcoming final report by GHD Consulting, Inc.
