Mr. Rosen opened the meeting at 6:02 p.m.

request is a variance from Town of Ithaca Code Chapter 270-223 A (8)a for the parcels in LDR
listed above to be permitted to erect a security fence with the required building permit at a height
of 6’ feet with an additional 1’6” feet of barbed wire where fences over 6’ feet are permitted in
all zones with the issuance of a building permit but barbed wire is only permitted in LI or I
zones.
Alex Chevallard, Project Manager stated that the intent of the appeal is to put a security fence
around some of the tanks and other assets for both protection of the public and the assets
themselves.
Clarifications were sent out prior to the meeting to the board noting that the only variance needed
is in the LDR for the height of the fence going from 6 feet to 7.5 feet and the addition of the
barbed wire.
Mr. Rosen noted that it is not near any public rights-of-way, the nearest being at least 400 feet
away.
Mr. Vignaux added that the fence and wire fit in with the industrial setting.
Ms. Jung stated that the slope of the topography help obscure the fence and you probably can not
see it from the Rec Way.
Ms. Rubin stated that it seemed to make sense and fit in with the LI zone.
Mr. King wondered why the portion is zoned LDR and Ms. Brock stated that much of Cornell is
zoned LDR and it will probably change in the upcoming rezoning but the variance needs to look
at it as is.
Ms. Brock noted that this is Type 2 as an educational use.
Mr. Rosen opened the public hearing at 6:12p.m.; there was no one wishing to address the board
and the hearing was closed.

Resolved that this board grants the appeal of Cornell University, Dryden Rd., TP 63.-1-5, LDR
from Town of Ithaca Code Chapter 270-223 A (8) to be permitted to erect a security fence with
the required building permit at a height of 6’ feet with an additional 1’6” feet of barbed wire
where fences with the following
Conditions:
1. That the fence be substantially built as shown in the revised sheets as requested by the
Planning Board prior to the issuance of any building permit, and
Findings:
1. The benefit the applicant wishes to achieve cannot be achieved by any other means
feasible given that this type of fence is necessary for security around this area, and
2. That there will not be an undesirable change to the neighborhood character or to nearby
properties given that the closest public right-of-way is 400 feet away, the land slopes up
from the Recreation Trail and the area seems very industrial in nature, and
3. The request is substantial given that barbed wire is not permitted in residential zones, and
4. The request will not have adverse physical or environmental effects as evidenced by the
fact that SEQR is not required.
5. The alleged difficulty is self-created in that the applicant needs a security fence, but
nevertheless, the benefit to the applicant outweighs any detriment to the health, safety
and well being of the neighborhood for the reasons listed above.

feet are allowed.
Ms. Riley explained that they would like to be able to enter the basement through a walk-out
door to store their mower etc. and this would not be for habitable space, simply a better way to
get in and out versus a bulkhead type entry. The house is built into the side hill and there is one
spot where the wall to the basement is visible and they would like a door there for ease. It will
not be visible from anyone other than the property around them which is at least a 100 feet away
on all sides and owned by relatives.

The variance is needed because the code requires measuring height of building from the lowest
grade and once the door is put in, that becomes the new lowest grade because we will be
removing some earth.
Mr. Rosen opened the public hearing and closed it given there was no one present.
The Board discussed the drawings and asked questions to clarify the applicants are simply
cutting a space in the land against the basement wall and putting an access door there.

1. That the door be built substantially as shown on the drawings submitted and the grading
be limited to what is described and represented in the application, and
Findings
1. That the benefit the applicant wishes to achieve cannot be done by any other way given
that the slope of the property would mean any door would increase the height under the
current code, and
2. That there will not be an undesirable change to the neighborhood or nearby properties in
that the perimeter grade line is not being changed and is not visible from the public right-
of-way and the side and rear property lines are at least 100 feet away, and
3. That the request is substantial in that 43’ feet is requested where 36’ feet is allowed, but
the entrance will not be noticeable, and the excavation is only to a portion of the
basement and will not look like the whole house is another level, and
4. That there will not be any adverse environmental effects as evidenced by SEQR not being
required as Type 2 for a single-family residence and
5. That the hardship is self-created in that they would like a walk out door, but nevertheless,
any detriment to the health, safety and welfare of the neighborhood for the reasons listed
above.

To whom it may concern,
The purpose of the CEP Physical Security Improvements project is to respond to the recommendations of the Cornell University Police
Department (CUPD) that are provided in the Crime Prevention and Environmental Design (CPTED) evaluation of the Central Energy Plant
(Dated April 10, 2018). The report identifies the Central Energy Plant (5510b), Chilled Water Plant 3 (5111), Steam Condenser Building
(5510f), and the multiple support buildings, exterior tanks (including the Aqueous Ammonia Tank), and substation to be secured with a
fence and signage.
The property where the variance is sought is surrounded by other Cornell properties and a large utility substation; there are no other
neighboring properties and the predominant use is for utility infrastructure (Cornell and NYSEG).
The security fence is for protection of the public (and deer) from entry into areas that contain numerous industrial hazards, similar to the
hazards within the adjoining NYSEG substation which has the same zoning and also has similar fencing.
The security fence will clearly delineate areas of hazard from outside areas appropriate for other uses. In the past, unauthorized persons
have entered these areas, including one incident resulting in injuries.
A shorter (6') fence fully compliance with the zoning ordinance does not provide sufficient warning and detriment to trespassers who could
cause significant harm to themselves or to the campus operations within the utility yard area. Barbed wire and signage will help ensure
safe operations and clearly delineate the areas of hazard.
The current zoning boundary does not represent a logical boundary between historical uses; the addition of barbed wire and post extensions
above a normal 6' (permitted by right) fence in the relatively small area of the site currently zoned "residential" is a logical and necessary
extension of the remainder of the fence line and is similar in design and character to the NYSEG substation fence in the same zone and
vicinity. The extension is also needed to prevent ready deer access.
The entire area is already used for central utility operations; the variance only allows a modest extension of the fence beyond the official
"light industrial zone" into the adjacent area zones as "residential" but in fact already used for utility services.
The extension of the fence is based on the historic use of the area and the need to enforce reasonable security measures for the protection of
both the public and of the facilities which serve the campus (including the state-supported campus areas). Attachment No.1 has been
provided to illustrate and describe more clearly the existing parcel boundaries and uses within the areas proposed for security fencing.

Attachment Figure 1 shows the overall area on Tax Map 63 in the Town of Ithaca. Cornell owns and
operates all of the property shown as being within the bounds of Tax Map 63 except for the NYSEG
public utility substation off Maple Avenue; the recreation trail that bisects the area from south to north
(maintained for public use by the Town of Ithaca); and the perimeter paved public walking trails along
Pine Tree Road and Maple Avenue.
Figure 2 is an annotated “Google Maps®” aerial view showing the approximately tax parcel boundaries
relative to the approved routing for the security fence.
Attachment 1: Addition Information related to Zoning Variance for security fencing around the Cornell
Central Energy Plant utility yard
For the benefit of the Zoning Board of Appeals, the following is a description of the current primary uses
of the parcels in the proposed work area:
Parcel 63.-1-8.1 is zoned “Light Industrial” (LI). This parcel contains the bulk of the Central Energy Plant
and appurtenant structures and features, including a high-pressure gas receiving station, chilled water
(thermal) storage tank, bulk fuel oil storage tank and fuel off-loading area, central chiller plant, and
utility yard areas. Just over half (about 900 linear feet) of the proposed 1800 linear feet of security
fencing is within this parcel.
Parcel 63.-1-5 is zoned “Low Density Residential” (LDR). This parcel extends southward and eastward to
areas currently used for College of Agricultural Science field research (with its own fencing, portions of
which include barbed wire) and seasonal exercising of horses assigned to the Cornell Polo barns. A
portion of the East Hill Recreation Trail cuts through this site. Despite this assigned zoning, the portion
of the parcel in the vicinity of the proposed fence is exclusively used for electric utility purposes and
storage and work space associated with the Cornell Central Energy Plant (CEP), and has been for
decades. The following utility features are currently located in the western portion of this parcel:
NYSEG High-Voltage Utility Substation (with its own fence with security barbed wire)
NYSEG High-Voltage Power Lines (and associated right-of-way) – extends across parcel from
east to west
Cornell Primary Electrical Substation (Maple Avenue Substation)
Former Coal Pile and Conveyor Yard (possible future biofuels staging and conveying area)
Gravel Access Road to Emergency Diesel Generators (2 x 1 MW); bulk fuel oil storage tank,
containment dike, and fuel off-load platform; high-pressure gas receiving station; chilled water
(thermal) storage tank; and top side crane access to the CEP and Chiller Plant #2
Based on the current location and orientation of these existing uses, utility right-of-ways, location of the
public trail, and lack of access to public roads, residential development in this portion of Parcel 63.-1-5
would not be possible (per zoning) or desirable. Just under half (about 845 linear feet) of the proposed
1800 linear feet of security fencing is within this parcel.
Parcel 63.-1-11 is an extension of a parcel to the east which was originally a “Planned Development
Zone” for Cornell educational uses and the larger parcel section is zoned “P” for “Planned”. However,
the official zoning map shows this extended area as “orange” which denotes “Light Industrial”. Since it
is unusual to have two different zones delineated for the same parcel, this may be a minor error in the
zoning map.
In any case, the small portion of parcel 63.-1-11 in the proposed work area is an extension of a broader
future planned development zone to the east. This portion roughly follows the path of a former railway
bed. Only about 20 feet of the proposed 1800 linear feet of security fencing is within this extended area
of parcel 63.-1-11. This portion is also undevelopable for most uses under zoning rules (no road
frontage) and also contains significant buried utility right-of-ways (high-pressure gas line and high
voltage electrical duct bank).

Mr. Rosen opened the meeting at 6:02 p.m.
Appeal of Cornell University, owner; Central Energy Plant, location. Multiple tax parcels are
included in this project/location: 63.-1-8.1 LI, (Light Industrial); 63.-1-11 P9 and LI, (Light
Industrial and Planned Development 9 and 63.-1-5 LDR (Low Density Residential). The
request is a variance from Town of Ithaca Code Chapter 270-223 A (8)a for the parcels in LDR
listed above to be permitted to erect a security fence with the required building permit at a height
of 6’ feet with an additional 1’6” feet of barbed wire where fences over 6’ feet are permitted in
all zones with the issuance of a building permit but barbed wire is only permitted in LI or I
zones.
Alex Chevallard, Project Manager stated that the intent of the appeal is to put a security fence
around some of the tanks and other assets for both protection of the public and the assets
themselves.
Clarifications were sent out prior to the meeting to the board noting that the only variance needed
is in the LDR for the height of the fence going from 6 feet to 7.5 feet and the addition of the
barbed wire.
Mr. Rosen noted that it is not near any public rights-of-way, the nearest being at least 400 feet
away.
Mr. Vignaux added that the fence and wire fit in with the industrial setting.
Ms. Jung stated that the slope of the topography help obscure the fence and you probably can not
see it from the Rec Way.
Ms. Rubin stated that it seemed to make sense and fit in with the LI zone.
Mr. King wondered why the portion is zoned LDR and Ms. Brock stated that much of Cornell is
zoned LDR and it will probably change in the upcoming rezoning but the variance needs to look
at it as is.
Ms. Brock noted that this is Type 2 as an educational use.
Mr. Rosen opened the public hearing at 6:12p.m.; there was no one wishing to address the board
and the hearing was closed.

Resolved that this board grants the appeal of Cornell University, Dryden Rd., TP 63.-1-5, LDR
from Town of Ithaca Code Chapter 270-223 A (8) to be permitted to erect a security fence with
the required building permit at a height of 6’ feet with an additional 1’6” feet of barbed wire
where fences with the following
Conditions:
1. That the fence be substantially built as shown in the revised sheets as requested by the
Planning Board prior to the issuance of any building permit, and
Findings:
1. The benefit the applicant wishes to achieve cannot be achieved by any other means
feasible given that this type of fence is necessary for security around this area, and
2. That there will not be an undesirable change to the neighborhood character or to nearby
properties given that the closest public right-of-way is 400 feet away, the land slopes up
from the Recreation Trail and the area seems very industrial in nature, and
3. The request is substantial given that barbed wire is not permitted in residential zones, and
4. The request will not have adverse physical or environmental effects as evidenced by the
fact that SEQR is not required.
5. The alleged difficulty is self-created in that the applicant needs a security fence, but
nevertheless, the benefit to the applicant outweighs any detriment to the health, safety
and well being of the neighborhood for the reasons listed above.

Ms. Riley explained that they would like to be able to enter the basement through a walk-out
door to store their mower etc. and this would not be for habitable space, simply a better way to
get in and out versus a bulkhead type entry. The house is built into the side hill and there is one
spot where the wall to the basement is visible and they would like a door there for ease. It will
not be visible from anyone other than the property around them which is at least a 100 feet away
on all sides and owned by relatives.

The variance is needed because the code requires measuring height of building from the lowest
grade and once the door is put in, that becomes the new lowest grade because we will be
removing some earth.
Mr. Rosen opened the public hearing and closed it given there was no one present.
The Board discussed the drawings and asked questions to clarify the applicants are simply
cutting a space in the land against the basement wall and putting an access door there.

be limited to what is described and represented in the application, and
Findings
1. That the benefit the applicant wishes to achieve cannot be done by any other way given
that the slope of the property would mean any door would increase the height under the
current code, and
2. That there will not be an undesirable change to the neighborhood or nearby properties in
that the perimeter grade line is not being changed and is not visible from the public right-
of-way and the side and rear property lines are at least 100 feet away, and
3. That the request is substantial in that 43’ feet is requested where 36’ feet is allowed, but
the entrance will not be noticeable, and the excavation is only to a portion of the
basement and will not look like the whole house is another level, and
4. That there will not be any adverse environmental effects as evidenced by SEQR not being
required as Type 2 for a single-family residence and
5. That the hardship is self-created in that they would like a walk out door, but nevertheless,
any detriment to the health, safety and welfare of the neighborhood for the reasons listed
above.

existing single family home w'rth a 36' height at peak by adding a walk out 36" wide door to the basement at the North East Corner.
This would allow the basement to be a habitable space. The existing natural grade of this property slopes gradually to the North East,
which is the rear of the home. There is no feasible alternative. It is a matter of grading soil away from the basement at the NE comer
and installing the door. The basement currently has a skimmed over opening at the NE (Rear) Comer. The door would not be visable
from the road. The installation of the door would have no physical or environmental impact. Installing this basement door would
increase the height from the lowest exterior grade to 43' at the area around the Basement walk out door. On average the homes
lowest exterior grade will still be close to the 36' height.
