HomeMy WebLinkAboutZBA Minutes 1974-07-17 ' 4• mot• 1 TOWN OF ITHACA ZONING BOARD OF APPEALS JULY 17 , 1974 A meeting of the Town of Ithaca Zoning Board of Appeals was held on Wednesday , July 17 , 1974 , at 7 : 30 p . m . in the Town of Ithaca Offices , 108 East Green Street , Ithaca , New York , PRESENT : Chairman Peter Francese , Edward Austen , Edward King , Jack Hewett , Lawrence P . Fabbroni ( Zoning Officer ) , Reynolds Metz . . (Assistant Zoning Officer ) , Nancy Fuller ( Secretary ) . ABSENT : Roger Sovocool , ALSO PRESENT : Mr . Stanley Tsapis , Attorney , Mrs . Amy Suzanne Soyring , PUBLIC HEARING : APPEAL OF AMY SUZANNE SOYRING , APPELLANT , FROM THE DECISION OF THE ZONING OFFICER DENYING PERMISSION TO DIVIDE PROPERTY AT 847 TAUGHANNOCK BLVD . INTO TWO LOTS , The Chairman called the Public Hearing to order at 7 : 34 p . m . The Secretary noted for the record . the presentation of the Town Clerk ' s notarized Affidavit of Posting and Publication on July 12 , 1974 , of the Notice of Public Hearing in the above -named matter . Mr . Stanley Tsapis , attorney for Appellant , Amy Suzanne Soyring , presented to the Board Chairman a sworn Affidavit of Service by Mail of Notice of Public Hearing in the above -named matter on July 10 , 19749 Mr . Tsapis also presented for the record a letter from the Tompkins County Department of Health , dated May 1 , 1974 , and signed by George W . Guest , Sanitarian . The letter refers to the three -apartment structure containing five bedrooms . ( See attachment ) . The septic System for the main residence containing two apartments is adequate also . ( See attachment ) . Mr . Tsapis presented a Survey of the Soyring property at 847 Taughannock Blvd . , prepared July 7 , 1955 , by Carl Crandall , C . E . There is approximately 152 ' frontage on Cayuga Lake , the depth of one side is 86 ' and the other side is irregular . The frontage on the Boulevard is 145 ' more or less . Mr . Tsapis noted that parking is adequate for the two structures containing five apartments . All of the parking is off the road and on Mrs . Soyring ' s own property . None . is on the shoulder of the road . Mr . Tsapis stated that Appellant is asking for an area variance and not a use variance . He said that the propert. yas far as use is con- cerned is okay . He said that the Board was aware that a three -apartment ® structure is located on the property and the official records only indicate a permission for a two-apartment house . He noted that that . ; condition has existed for some time . He stated that Mrs . Soyring has tried for at least three years to sell the property . There were no offers for the entire parcel at $ 120 , 000 . 00 . Mrs . Soyring did receive a purchase offer of $ 48 , 000 . 00 for a portion of the parcel containing the three- apartment structure and a frontage on the Boulevard of 651 . Zoning Board of Appeals - 2 - July 17 , 1974 The ` Soyring parcel designated by the Tompkins County Assessment Depart ment as Tax Parcel # 25 - 2 - 32 , 847 Taughannock Blvd . , is assessed as one parcel . Mr . Tsapis noted that Mr . Tom Reese , the neighbor on the South side of the property in question has two residences on his property . One he rents and one he resides in . The Reese property is tax parcel # 25 - 2 - 33 having 150 ' frontage on the lake and 145 ' on the highway . To the north , the Zazzara parcel # 25 - 2 - 31 has 97 ' of frontage on the lake and 157 ' on the highway . Mr . Zazzara presently resides in one house . Mr . Tsapis asked the Board to take note of the fact that the Lake frontage properties lack uniformity of size . Some have as little high - way frontage as 151 , some 501 , some 65 ' and some . are 150 ' . And , in ' view of this , the appellant ' s request for two parcels of 65 ' and 80 ' frontage is not unusual . Mr . Tsapis also pointed out that the request will make no change in the character of the neighborhood . There will be no change in the population density . The water supply is potable . the septic system is okay . Mr . Tsapis felt that the Health Department approval is very significant . Mr . Francese asked in what year the second structure was built and Mr . Tsapis replied that it was constructed in 1966 or 1967 . Mr . Tsapis stated that he had reviewed the regulations for an area variance , and , for the following reasons , the appellant ' s request had met those regulations . 1 . There is no other vehicle except to ask for a variance . 2 . Mrs . Soyring has a burden . 3 . Mrs . Soyring would sell the parcel as one , but attempts to do so have failed . 4 . The interests of justice will 'not be offended by the issuance of a variance since she did not have anything to do with the situation that is there . 5 . There has been no objection from any one in the neighborhood over the years , and , no one has appeared in opposition at any of the hearings previously advertised or the hearing of today ' s date . Mr . Tsapis further stated that in terms of the square footage requirement of 15 , 000 sq . ft . for a lot in an R- 15 zone which the Soyring parcel may meet , the parcel should not be looked at in the vacuum of the lot alone . It must be looked at in connection with the other lots on the West Shore of Cayuga Lake , Mr . King asked if each septic system exists within the bounds of each of the requested lots . Mr . Tsapis stated that they did . Mr . Francese asked when Mrs . Soyring had acquired the parcel and she stated that it was in 1955 . Mr . Francese asked if the assessment had been increased over the years and Mrs . Soyring said that it had after the duplex was put in . Mr . Francese asked if all of the dwelling units were occupied . Mrs . Soyring said they were . The Chair adjourned the Public Hearing at 8 : 25 p . m . :for`. Executive Zoning Board of Appeals - 3 - July 17 , 1974 Session , and upon the re-opening of the Public Hearing at 8 : 55 p . m . the following Findings of Fact were noted : 1 . The subject property is a lot designated as Nos . 845 - 847 Taughannock Boulevard , and consists of a single irregular lot , Tax Parcel # 25 - 2 - 32 , about 145 feet wide on the highway ( 152 feet on the west shore of Cayuga Lake ) and a depth of about 85 feet , for a total of not more than 15 , 000 square feet . 2 . The lot is improved by two buildings , the one at No . 845 Taughannock Boulevard on the south end of the lot having been construc - ted about 1966 - 1967 , and containing three dwelling units ; 'and the " cottage " building at No . 847 Taughannock Boulevard on the north end of the lot having been the original single - family dwelling of appellant and her husband , and having been modified about 1966 or after to contain two dwelling units . Appellant continued to occupy the main unit therein as her dwelling until recently . 3 . Title to this real property was vested in Anselm Soyring , and his wife , Appellant Amy Suzanne Soyring , as tenants by the entirety , about 1957 , and continued thus until Mr . Soyring ' s death about four years ago . Appellant has been sole owner since then by right of survivorship . 4 . The property is in an R- 15 Zone , which permits a one - or two- family dwelling on a lot with a minimum area of 15 , 000 square feet , and a minimum width of 100 feet and a minimum depth of 150 feet . The property , as it existed before 1966 , viz . with a single family dwelling only , was a permitted non- conforming parcel because of the area and depth . 5 . Many of the lots in this area of the Town , lying between Taughannock Boulevard and the shore of Cayuga Lake , may be nonconfor - ming in total area , width and depth , due to the topography and due to the early , relatively intense development of lake front properties . 6 . In 1966 Anselm Soyring obtained a variance from this Board to permit him to construct a two- apartment building on the south part of this lot -- viz . that designated No . 845 Taughannock Boulevard , making for a total of three dwelling units on the lot ; about the same time he also obtained building permit No . 975 to allow him to extend the size of the existing main building . 7 . Construction on the property thereafter resulted in three new dwelling units being built on the south side of the lot , and a second dwelling unit being added to the main house . No record can be found for any application for or approval ; of such extension of the construction to a total of five dwelling . units instead of the total of three units authorized by the 1966 Variance . The fifth dwelling unit was apparently added by the applicant ' herself . ® 8 . Appellant was , as noted , co-owner of this property at the time the construction violations took place . 9 . Appellant ' s deceased husband , Anselm Soyring , was the Town of Ithaca Zoning Officer at the time he applied for the 1966 Variance , and during the construction of the additional dwelling units on this property . ffl Zoning Board of Appeals - 4 - July 17 , 1974 10 . The present use of the property is illegal . Neither applicant nor her deceased husband , ever made any known attempt to rectify the situation by decreasing the number of dwelling units thereon . All five dwelling units are now rented out . 11 . Applicant alleges a total investment of $ 105 , 000 in the properties ( including the amounts used to construct the two unauthorized dwelling units ) , and an unsuccessful two-year effort to sell the property as a unit for $ 120 , 000 to fully recover her total investment , expenses of sale , and to give her enough capital for reinvestment to replace the net rental income from this property . 12 . Applicant further alleges that by subdividing the property into two parcels , the south part containing the three -unit building to be about 65 feet wide , would thus contain roughly 7 , 000 square feet , and the northerly part to be about 80 feet wide , would contain roughly 8 , 000 square feet . Neither resultant lot would conform to the area requirements of the ordinance , and the southerly lot would still violate the " one- or two- family dwelling " permitted by the Zoning Ordinance , as well as the two-dwelling unit authorized by the Variance . 13 . The three -dwelling building ( No . 845 ) has its own , separate septic system , which has been approved by the Tompkins County Health Department as sufficient for the five bedrooms contained in the three - dwelling unit . There is no municipal water supply available in this area , lake water being used . AAhL qP14 . Appellant has a contingent contract for the sale of the . three -dwelling unit on such a 65 - foot wide lot for $ 48 , 000 , that contingency being that petitioner be able to obtain a Certificate of Compliance or otherwise meet zoning requirements . 15 . Of the $ 105 , 000 total costs Appellant claims to have invested in the property over the years , $ 30 , 000 of that amount was recently expended by her to rehabilitate the foundation walls of the original cottage building . 16 . Of the remaining $ 75 , 000 of the claimed investment , a substantial amount must have been used in the creation of the two illegal additional dwelling units on the property . 17 . We do not deem it established by any evidence offered by Appellant or otherwise , that the property could not yield a reasonable return if one dwelling unit were eliminated from each building to bring the property into compliance with the Ordinance and the 1966 Variance , 18 . , Despite the Applicant ' s allegation that she had no personal knowledge that the property was being developed in violation of the Ordinance and Variance , she was a co- owner of the property at the time , and has since profited from the intensive development . If she is now in fact exposed to any financial hardship ( which we do not find ) we would deem it to be a self - imposed hardship . 19 . We find no reasonable grounds for granting a further Variance in order to legitimize the two extra dwelling units to enable Appellant to recover , through sale , the costs of construction of such illegal units . Zoning Board of Appeals - 5 - July 17 , 1974 20 . The granting of the requested variance to legitimize the five dwelling units on property for which only three were authorized would in our judgment defeat the intent and purpose of the Zoning Ordinance and might well encourage similar intensive development of other larger lots such as this in this area of the Town . 21 . Although this property may have adequate septic facilities. for the present intensive use , we take notice that such is the exception for the lake front properties : most of them now have inadequate septic systems due to the soil , the topography , and the limited land areas , as well as due to the proximity of most dwellings -to the - lake shore . . Any act or policy which would encourage a more intensive development of any land in this area would thus likely endanger the public health and welfare . 22 . We also note the possibility that if we permitted this subdivision , subsequent owners might well want to build another unit near the lake shore on the southerly parcel ; and near the highway on the northerly parcel thus pressuring for even more intensive occupancy . Upon Motion by Chairman Peter Francese , seconded by Mr . Edward Austen , it was RESOLVED , that the Zoning Board of Appeals of the Town of Ithaca upon review of the facts above found and the findings of fact determined at the Board meeting of June 20 , 1974 , as corrected by the findings of fact heretofore noted , deny and hereby does deny the request for a variance to sub-divide the property owned by Mrs . Amy Suzanne Soyring at 847 Taughannock . Boulevard , Ithaca , New York , tax parcel # 25 - 2 - 32 . There being no further discussion , the Chair called for a vote with the members voting as follows . Aye - Francese , Hewett , Austen , King . Nay - None . The Chair declared the Motion to be carried unanimously . The Board suggests to the applicant that she can obtain a Certifi - cate of Compliance for this property as one lot by removing one dwelling unit from each building . The Chair declared the Public Hearing to be closed at 9 : 20 p . m . ADJOURNMENT': Upon Motion , the meeting of the Zoning Board of Appeals was adjourned at 9 : 30 p . m . By the end of 1967 said building was constructed and there were contained therein three apartments instead of two . There - after , on the � 7 day of �' r' �� � � ► , 197 �� Mr . Soyring passed away , leaving your petitioner , his widow , as the owner of the property . That on or about December 2 , 1973 , a purchase offer was re - ceived for the sale of the apartment house on my property . One of the requirements of the sale was to obtain certification that the lot complied with the zoning ordinances of the Town of Ithaca . That application was made for said certification and was refused . That that was the first time petitioner learned of any violation of any zoning ordinance . Petitioner has no knowledge concerning any of the applications for variances or construction of the apartment house . At the present time it is petitionerb desire to relieve herself of the obligations that go with the ownership of apartments and the constant problems connected with the same. However , the property is unmarketable so long as it does not comply with the zoning ordinances . It was economically unfeasible for me to rent any fewer than the three apartments since the costs of construction were obtained through a mortgage and the payments and real estate taxes are such - that require all . of the rent obtained from the apartments . Therefore , it is respectfully requested that the Board of Zoning Appeals grant a variance by allowing me to separate the pro - perty as shown on a survey , into two lots , one with the three - apartment ® : house , having a road and lake frontage of 65 feet and a depth of i approximately 111 . 5 feet , the other lot housing the main residence , having approximately 80 feet on the highway and 80 feet of lake frontage . I am attaching hereto a report from the Health Department regarding the septic systems on the two properties together with the . original plans and specifications of the Health Department for the septic system My property is unmarketable in its present condition because of the zoning ordinance and I cannot continue to handle the property since my husband ' s death and cannot afford to hire a third person to do so . There would be no detriment to the neighbor - hood since many properties on the west shore of Cayuga Lake are on lots smaller than lots required by the zoning ordinances and side - yard and front - yard set-backs vary with each property , many of which do not come near to the requirements of the zoning ordinances . In addition , the property has existed in its present condition for at least 6 years with no apparent complaint from the . neighbors . There is adequate parking to handle persons who are living on the site therefore , there will be no additional traffic or parking hazards . Ankh FINDINGS OF FACT 1 . The set —back request of 15 feet is more than the _. average set —back to the north and south of this property'. 2 . The topograpAy is difficult upon which to build because the land drops off sharply to the east . = - 30 Mr . \ Soyring cannot make a reasonable use of his hand ' due to its peculiar size and shape . 4 . 7 The proposed building does comply with side line requirements and depth of lot . 5 . The combined areas of the two buildings will not exceed the 20 % land use requirement . , 6 . _ The proposed building complies with Section 68 - of the Town of Ithaca Zoning Ordinance . _ 7 . There will be ample parking space , and there will be no traffic hazard created by the building or If the proposed use . 8 . The proposed building is a two —family dwelling . Upon motion by Mr . Sovocool , seconded by Mr . Scott and carried by unanimous vote, it was moved that the findings of fact - be adopted and that a variance be granted to build the proposed building and that the building be built no less than 15 feet from the right of way line . Soyring : This letter is in reply to your request concerning the basis of design for the sewage system serving your property at 847 Taughannock Boulevard . The permit dated October 13 , 1965 indicates that the sewage system was designed for a sewage flow of 750 gallons per day . Seven hundred fifty gallons per day represents the design sewage flow from a five bedroom house or a combination of apartments for a total of five bedrooms .
