HomeMy WebLinkAboutZBA Minutes 1974-06-20 I� TOWN OF ITHACA ZONING BOARD OF APPEALS C - JUNE 20 , 1974 A meeting of the Town of Ithaca Zoning Board of Appeals was held on Thursday , June 20 , 1974 , at 7 : 30 p . m . in the Town of Ithaca Offices , 108 East Green Street , Ithaca , New York . PRESENT : Chairman Peter Francese , , Edward Austen , Edward King , Reynolds Metz ( Zoning Officer ) , Nancy Fuller ( Secretary ) . ABSENT : Roger Sovocool , Jack Hewett . ALSO PRESENT : Mr . and Mrs . Sanford Reuning , Mrs . .Kumiko Korf , Mr . and Mrs . Thomas Bell . 1 . PUBLIC HEARING : CONSIDERATION OF APPROVAL OF ADDITION . TO HOME OF SANFORD REUNING , 112 WEST BUTTERMILK FALLS ROAD . Chairman Francese called the Public Hearing to order at 7 : 30 p . m . Mr . Metz read the Notice of Public Hearing as published in The Ithaca Journal on June 15 , 1974 , and presented an Affidavit of Posting and Publication of said Notice sworn to by the Town ® Clerk . Mr . Metz also presented an Affidavit of Service by Mail of Notice of Public Hearing on the above - noted matter sworn to by the Secretary of the Board . Mrs , Y.umiko Korf , Architect , presented to the Board a drawing and a model of the proposed building which is to be built at 112 West Buttermilk Falls Road . Mr . Reuning pointed out that the • proposed building will -be attached to his - home . Mrs . Korf said that the building was designed to accommodate a -maximum of 250 people and had bathroom facilities for the same . However , Mr . Reuning said that they at � no time expected more than 100 persons . Further , Mr . Reuning stated that most of these 100 persons would be children thereby lessening any parking problems . The only purpose of the building is use as a music school . He said that they do not plan to give large concerts or recitals at this location . He further stated that they give their recitals at the Women ' s Community Building and at Ithaca College . Mr . Reuning said that the required parking would be off - street and that they would convert a garden for use as a parking lot if necessary . He pointed out that they now have parking space for 25 cars and there were " No Parking " signs along both sides of the paved street that is in front of their house . Mr . Francese noted that none of the neighbors have appeared , at this Public Hearing , having been properly notified , in opposition to the granting of an approval for the proposed addition . MOTION by Chairman Peter Francese ; seconded by Mr . Edward King . Zoning Board of Appeals - 2 - June 20 , 1974 The Zoning Board of Appeals of the Town of Ithaca upon �® review of the proposal presented by Mr . and Mrs . Sanford Reuningi for the construction of a music school of approximately 2 , 500 sq . ft . on West Buttermilk Falls Road finds that the proposed facility and use are in accordance with the provisions of the Town of Ithaca Zoning Ordinance . It further finds that such use is permitted under Article V . Section 18 , paragraph 40 This approval by the Zoning Board of Appeals is limited to the stated use as a music school . There being - no further discussion , the Chairman . called . for a vote . Aye - Francese , Austen , King . Nay - None . The MOTION was declared carried unanimously . 3 . PUBLIC HEARING : APPLICATION FOR SPECIAL PERMIT BY MR . AND MRS . THOMAS BELL TO ERECT A TEMPORARY SIGN AT THE LOCATION OF THEIR GROCERY STORE , 610 ELMIRA ROAD . Chairman Francese called the Public Hearing to order at 8 : 15 p . m . Mr . Metz read the Notice of Public Hearing as published in The Ithaca Journal on June 15 , 1974 , and presented an Affidavit of Posting and Publication of said Notice sworn to by the Town Clerk . Mr . Metz also presented an Affidavit of Service by Mail of Notice of Public Hearing on the above - noted matter sworn to by the Secretary of the Board . Mr . and Mrs . Thomas Bell appeared before the Zoning Board of Appeals and stated that they no longer wish to have a .temporary sign installed at the location of . their Grocery Store at 610 Elmira Road . They thereupon withdrew their request for a temporary sign which was to be heard by the Board at this public hearing . They stated that their permanent sign is now available , but that the letter size had been reduced from 18 " to 12 " by the Town Board upon recommendation of the Planning Board . They feel that 12 " letters are not adequate for their needs . Mr . and Mrs . Bell were instructed to appear before the Town Board again in an attempt to have the Town Board reconsider the matter , and , failing that , to notify the Zoning Enforcement Officer that they wish to appeal a decision of the Town Board to the Zoning Board of Appeals . A new date would be set , with the proper notification of Hearing , and the Zoning Board of Appeals would hear the matter then . 2 . PUBLIC HEARING : APPEAL OF AMY SUZANNE SOYRING TO DIVIDE PROPERTY AT 847 TAUGHANNOCK BLVD . INTO TWO LOTS . Chairman Francese called the Public Hearing to order at 9 : 00 p . m . r Zoning Board of Appeals - 3 - June 20 , 1974 Mr . Metz read the Notice of Public Hearing as published in ® The Ithaca Journal on June 15 , 1974 , and presented an Affidavit of Posting and Publication of said Notice sworn to by the Town Clerk , Mr . Metz also presented an Affidavit of Service by Mail of Notice of Public Hearing on the above - noted matter sworn to by the Secretary of the Board . Chairman Francese noted that Mrs . Soyring and her attorney , Mr . Stanley Tsapis , had not appeared for this Public Hearing . Mr . Metz outlined the background for this matter as presented at a Public Hearing held by the Zoning Board of Appeals on April 17 , 1974 , at which time the Board took no formal action . ( See Official Minutes of the Zoning Board of Appeals on file in the Town Office together with Exhibits and pertinent data . ) The Appeal was discussed by the Board and the following Findings of Fact were noted : 1 . There exist four dwelling units in two buildings on a single lot of approximately 16 , 000 sq . ft . with 145 ' frontage . One building has three units and one building has one unit . There exists an occupancy violation . 2 . The three - unit dwelling violates the side yard requirements of the Town of Ithaca Zoning Ordinance . 3 . The dwelling presently containing three units was constructed under a building permit granted as per a variance allowing a two - unit structure . 4 . The present use is illegal and the applicant has made no attempt to rectify the situation . 59 The side yard violation with respect to the three - unit dwelling is that the southerly side of the building is within 5 ' of the side yard because of a porch- like fire escape . 60 The owner has made two changes to the dwellings located on the property . 7 . The property is in an R- 15 zone which allows for only a one - or two - family dwelling on a 15 , 000 sq . ft , lot with a minimum of 100 ' frontage . The Board of Zoning Appeals took no action on Case # 2 , the Soyring Appeal , because the applicant was not present . REPORT OF ZONING OFFICER : YARN SHOP ON PINE TREE ROAD . Mr . Metz reported that he had received a complaint about the presence of a retail yarn shop on Pine -. Tree Road . The Board felt ® that the yarn shop did not fit into the category of a home occupation but instructed Mr . Metz to look into the matter further to determine if a violation exists .
