TOWN OF ITHACA ZONING BOARD OF APPEALS
® September 29 , 1971
A meeting of the Town of Ithaca Zoning Board of Appeals was
held on Wednesday , September 29 , 1971 at 7 : 40 p . m . in the Town
of Ithaca Offices , 108 E . Green Street , Ithaca , New York .
PRESENT : Chairman David Powers , Loran Marion , Lorraine ,
Ripley , Roger Sovocool , Jack Hewett , and Reynolds Metz ( Assistant
Zoning Officer ) .
PUBLIC HEARING - NELSON OVERBAUGH : A public hearing was
held to consider the appeal of Nelson Overbaugh from the decision
of the Zoning Officer denying permission for construction of an
addition to his house within 10 ft . of the side lot at 255
Coddington Rd . Permit was denied by the Zoning Officer under
Art . IV , Sect . 14 of the Zoning Ordinance .
A fetter from Albert Sherwood , 249 Coddington Rd . , the closest
neighbor to the Overbaugh property , was read stating he had no
objections to such a addition to the Overbaugh residence .
Discussion was held and Loran Marion made a motion that the
variance requested by Mr . Overbaugh be granted for a 5 ft , side
yard ; but not closer than 10 ' to the existing property line , for
the addition of a bedroom to his home at 255 Coddington Rd .
The motion was seconded by Jack Hewett and unanimously
approved .
PUBLIC HEARING HOWARD C . ADERHOLD : A public hearing
was held to consl er the appeal of Mr . Howard C . Aderhold from
the decision of the Zoning Officer denying permission for
construction of a garage on the south side of his house off of
the side lot line with room above the garage for a study . The
property is located at 23 Muriel Street . Permit was denied by
the Zoning Officer under Art . IV , Sect . 14 of the Zoning
Ordinance .
This proposal brings the construction within 7 1 / 2 ft ., of
the neighboring property . A letter from this neighbor , Mr .
Ronald Cornell , was read stating he had no objections to Mr .
Aderhold ' s proposed construction .
Discussion was held , and it was pointed out that since there
is no hardship in this case , a variance could not be granted to
change the side yard requirements . If the proposed structure

were reduced to 13 ' in width , the garage would meet the 10 '
side yard requirements and would need no variance .
Mr . Aderhold asked for the variance to build a study over
the garage in the event that he decides to reduce the size of
the garage and go ahead with the construction .
Roger Sovocool made a motion that the request of Mr .
Howard Aderhold for a variance of side yard requirements be
denied , and that a variance be granted to allow for the con -
struction of a study over the garage , conditional upon the
submission of plans that meet with the Zoning Officer ' s approval .
The motion was seconded by Lorraine Ripley , and unanimously passed .
PUBLIC HEARING - JEANNE TOMLINSON : A public hearing was
scheduled to consider the appeal of Jeanne Tomlinson from the
decision of the Zoning Officer denying permission for use of
her property as an antique store . The property is located at
224 Bostwick Rd . and is presently zoned Residential Zone R - 30 ,
Permit was denied by the Zoning Officer under Art .. V , Sect ._ 1820
of the Zoning Ordinance .
In the absence - of Mrs . Tomlinson , the hearing was adjourned
until such time as she will be present to answer questions that
the Board has .
ADJOURNMENT : The meeting was adjourned at 9 ; 00 p . m .
