ZONING BOARD OF APPEALS MINUTES
NOVEMBER 289 1967
The Regular Meeting of the Town of Ithaca Zoning Board of
Appeals was held on Tuesday , November 28 , 1967 , in the Town Offices ,
108 East Green Street , Ithaca , New York at 7 : 30 P . ffif'.
Membersoof the Board present : Chairman David Powers , Robert
Powers , Loran Marion , Andy Sorying , Roger Sovocool , Zoning
Officer Donald Franklin and Secretary Cheryl S . Beninati .
Others present : Noel Desch , David Carr , and David Berman .
CODDINGTON ROAD COMMUNITY CENTER - APPEAL FOR ERECTION OF SIGN
This Public Hearing was called to order at 7 : 30 P . M . by
Chairman David Powers . Zoning Officer Franklin read the
legal ad as published in the Ithaca Journal . The Coddington
Road Community Center , represented by David Carr and Noel
Desch , appealed from the decision of the Zoning Officer
denying permission for erection of a 41 X 41 sign at Coddington
Road , which permit was denied under Article V , Section 19
of the Zoning Ordinance .
The Zoning Officer read the minutes of the December 6 , 1966
Zoning Board meeting head on this matter at which time the
appeal was denied due to insufficient reasons being shown
why the sign size should be increased and why the variance
should be granted .
Mr . Carr submitted a petition signed by 19 area residents ,
all in favor , and stated that the sign is needed to identify
the center . Mr : Desch stated that without the sign a hard -
bhip is created to the activity of the center . Mr . Desch
also pointed out that Mr . and Mrs . Carter , who own the land
on which the center is located , signed the petition and are
in favor of a larger sign . There has been a lack of turn-
out at center functions in the past , and it is the opinion
of the Directors of the Coddington Road Community Center
that the sign would help in this respect .
Mr . Marion stated that these centers are community functions ,
there is a need for such functions , and there is also a need
for signs to identify them . It was also pointed out that the
proposed sign would improve traffic conditions .
The Public Hearing was adjourned at 8 : 00 P . M . and decision
reserved until the first scheduled meeting in February , 1968 .
Note : No persons appeared in opposition to the foregoing .

DAVID BERMAN - 212 MURIEL STREET
This Public Hearing was called to order at 8 : 05 P . M . by Chairman
David Powers . Zoning Officer Franklin read the legal ad as
published in the Ithaca Journal . Mr . Berman had been denied
permission to erect a porch at 212 Muriel Street under Article
IV , Section 14 of the Zoning Ordinance . Article IV requires
a 15 -foot side yard , and with the addition of the porch , Mr .
Berman will have only 12 feet .
Mr . Berman stated that his family has .outgrown their present
dining room facilities, and the porch , which would be enclosed ,
would be used for dining . Mr . Berman also stated that the
neighbors house on the side in question is at least 20 feet
from the lot line with a row of trees dividing the two houses .
Note : No persons appeared in opposition to the foregoing .
This Public Hearing was closed at 8 : 30 P . M . The Board took a
10 -minute recess after which they came up with the following
findings of fact :
1 . The house is of an inadequate size to accomodate the present
needs of the owner .
2 . The lot slopes off to the rear and any addition cannot be
built to the rear of the house .
3 . The proposed addition will be no wider than the proposed
carport which is 20 feet wide .
4 . The variance creates no traffic hazard .
5 . The variance would be consistent with the letter and
spirit of the Zoning Ordinance .
Upon motion by Mr . Soyring , seconded by Mr . Robert Powers
and carried by unanimous vote , it was moved that the variance
be granted based on the foregoing findings , ; of fact .
LORAN MARION - WAREHOUSE _ BURTT PLACE
This Public Hearing was called to order at 8 : 35 P . M . by
Chairman David Powers . Zoning Officer Franklin read the
legal act as published in the Ithaca Journal .
Mr . Marion stated that at the present time he has a small
warehouse on Five Mile Drive with his offices on the Old
Spencer Road . It is necessary that his employees go to
Cayuga Electric to get many of their supplies because of
the small size of the present warehouse . It is also in-
convenient and a hardship for Mr . Marion to have his office
at one location and his warehouse at another . If the variance
is granted for the warehouse on Burtt Place , he will also
have his office at the same location . The building Mr . Marion
wishes to convert into a warehouse is presently an old barn ,

and the conversion to a warehouse would improve the appearance
of the property .
It was pointed out that Burtt Place is a private road , and that
Mr . Marion spoke to the area residents who had no objections to
his proposal . Mr . Marion also stated that his present small
warehouse will not be operated if the variance is granted .
Note : No persons appeared in opposition to the foregoing . Mr .
Marion left the room and did not participate in the discussion
or the vote .
This Public Hearing was closed at 9 : 00 P . M .
Findings of Fact :
1 . The property is on a private road and the proposal does not
create a traffic hazard .
2 . The building presently standing on the premises is3 in a poor
state of repair and will be benefited by the improvements to
the interior and exterior of the building , but there will be no
exterior additions thereto .
3 . No one appeared in opposition .
4 . The character of the neighborhood has been changed so that it
is no longer practical to use the land as a dairy and/or
farm purposes .
5 . The applicant has purchased property surrounding the building
so there will be no hardship on any adjacent landowners .
Upon motion by Mr . Robert Powers , seconded by Mr . Sovocool and
carried by unanimous vote , it was moved that the variance be
granted on the following conditionss
1 . That the accompanying application is made a part hereof with
a description of the building .
2 . That the land surrounding the building not be used for any
exterior storage of merchandise and that it not be used for
parking more than ten ( 10 ) vehicles .
The variance is personal only and shall terminate automatically
upon any lease , sale or transfer of the land or the building
by Marion Electric Co .
4 . The variance is granted for warehouse space only .
This meeting adjourned at 9 : 30 P . M .
