TOWN OF ITHACA
ZONING BOARD OF APPEALS MINUTES
JULY 18 , 1967
A regular meeting of the Town of Ithaca Zoning Board of
Appeals was held at the City Court Room , City Hall , 108
East Green Street , Ithaca , New York at 8 : 00 P . M .
Members of the Board present : Acting Chairman , Robert N .
Powers , Roger Sovocool , Loran Marion , Zoning Officer Andy
Soyring , and Secretary Carol Co Reeves . Also present were
37 residents who live in the area of Koppers Co .
KOPPERS APPEAL ( continued ) - VINE STREET - VARIANCE APPLICATION
Co M . VanMarter , Building Commissioner for the City of Ithaca
spoke on the question of the operation of Koppers Co . at
their present location . It would appear that many things
are pertinent to the extension of a nonconforming use in an
R - 15 residnece district . No attempt was made to show hardship .
All permitted uses had not been explored . Dollar and cents
proof of hardship had not been shown . Specific circumstances
were not shown . It was further not demonstrated that a
variance is necessary . Only minimum variance to accomplish
the purpose can be granted . Also , it must be shown that
granting of a permit will not be injurious to property . This
had not been proved nor can they find proof .
George Melville , Production Manager of Koppers Co . , Inc .
stated that the purpose of seeking this variance was to reduce
noise by installing electric haters in two new tanks they
were seeking to install , and thereby eliminate the need for
the truck heaters that were noisy .
Let it be here stated that the Members of the Zoning Board of
Appeals viewed the Koppers Co . premises on Tuesday , July 18 ,
1967 at 4 : 00 P . M .
The Acting Chairman , Robert N �. Powers asked if there were any
persons present who wished to make a statement . There were
none .
The Board Members then left the room for a private discussion .
Upon returning 20 minutes later , the following motion was
made by Mr . Sovocool :
Move that the Zoning Board of Appeals of theTown of Ithaca
makes the following findings :
1 . No showing of hardship .

2 . Granting of such a variance would not be consistent with
the spirit and intent of the Zoning Ordinance .
Therefore , it was moved that the application entoto be denied ;
motion was seconded by Robert N . Powers . On voting it was
passed unanimously . Mr . Sovocool Laxplained that this denial
applied to the entire contents of the application .
MICHAEL PICHEL APPEAL - SNYDER HILL ROAD - VARIANCE APPLICATION
The Zoning Officer read the legal announcement concerning
the appeal of Michael Pichel , appellant , from the decision
of the Zoning Officer requesting permission to construct a
house in an R -15 zone on a lot of less than minimum dimensions .
Mr . Pichel appeared and - was questioned by the Board .
After discussion , a7;emotion was made that the Board grant the
variance and made the following findings :
1 . That the land could not be used for building purposes
under Article 4 , Section 16 of the Zoning Ordinance .
2 . That the land could :: not be used for commercial purposes
under the Zoning Ordinance .
3 . Granting of this variance creates no traffic hazard .
4 . That it is in keeping with the spirit and intent of the
Zoning Ordinance .
5 . Such approval is conditioned on the Zoning Officer making
final measurement of the house location and filing a plot
plan with this Board .
It was moved by Roger Sovocool and seconded by Loran Marion
that the variance be granted . The motion was passed by
unanimous vote . No one appeared in opposition .
The meeting was adjourned at 8 : 40 P . M .
