ZONING BOARD OF APPEALS MINUTES
APRIL 189 1967
A regular meeting of the Town of Ithaca Zoning Board
of Appeals was held on Tuesday , April 18 , _ 1967 , at
the Town Offices , 108 East Green Street , City of Ithaca ,
New York .
Members of the Board present : Chairman David Powers ,
Robert Powers , Loran Marion , Zoning Officer Andy
Soyring , and Secretary Cheryl S . Beninati .
Others present : Mr . Sarsfield , Walter Lane , Lawrence
Drake .
SARSFIELD - 1458 SLATERVILLE ROAD - VARIANCE APPLICATION
Chairman Powers called this Public Hearing to order at
7 : 45 P . M . Zoning Officer Soyring read the legal ad as
published in the Ithaca Journal .
Mr . Sarsfield has applied for a variance to conduct
a business consisting of a small coffee dhop at
1458 Slaterville Road . No changes have been made
to the outside of the building , nor are any proposed ,
and only a 12 -foot bar has been installed on the inside .
The Board recessed for 10 minutes , after which they
came up with the fol lowing findings of fact :
1 . The situation is unique .
29 The use willnnot create a traffic hazard .
3 . The use is not detrimental to the health ,
welfare , and general amenity of the community .
4 . There appears to be a need at this time for
this service .
Therefore , the variance is granted on the following
conditions :
1 . Only 1 sign shall be permitted , not to exceed
2 square feet and which sign shall not be illuminated .
2 . The floor area of the coffee shop shall not
be extended beyond its present f ootAge .
3 . There shall be no further additions to the
length of the counter , no additional stools , tables
or chairs .
4 . This variance is subject to yearly review
by the Zoning Officer or review If change of owner-
ship .

Upon motion by Mr . Robert Powers , seconded by Mr . Marion
and carried by unanimous vote , the above variance was
granted on the conditions set forth . No one appeared in
opposition to the foregoing .
LAWRENCE DRAKE - 718 ELM STREET - VARIANCE APPLICATION
Zoning Officer Soyring read the legal ad as published in the
Ithaca Journal . Mr . Drake requested a variance to add a
dining room ( 12 X 14 ) to his home , which addition would
leave only 9 feet on the side lot line wherein the Zoning
Ordinance requires a side yard of at least 15 feet in this
R- 15 District . It was pointed out by Mr , Drake , and by Mr .
Lane. , the contractor , that it would be impractical to build
the addition on the other side because of the steep slope of
the land on that side .
The Board recessed for 10 minutes after which , upon motion
by Mr . Robert dowers , seconded by Mr . Marion , and carried by
unanimous vote , the variance was granted due to practical
difficulties because of the slope of the land and the present
construction of the Drake house . The following facts were
pointed out with reference to the construction :
1 . The siding will be wood .
2 . The roof will be asphalt shingle .
3 . The property will be free of all construction, debris
and trash by completion date .
4 . Completion date is September 1 , 1967 .
. 5 . Grading is to be smoothed .
6 . The construction is to be completed by Mr . Lane .
This meeting was adjourned at 9 : 15 P . M .
