TOWN OF ITHACA
ZONING BOARD OF APPEALS
NOVEMBER 3 , 1966
A regular meeting of the Town of Ithaca Zoning Board of
Appeals was held at the Town Offices , 108 East Green Street ,
Ithaca , New York , on Thursday , November 3 , 1966 at 7 : 30 P . M .
Members of the Board present were : Chairman David Powers ,
Roger Sovocool , C . A . Tilton , Robert Powers , Loran Marion ,
Zoning Officer Andy Soyring and Secretary Cheryl S . Beninati .
Also present were : Mr . and Mrs . David Hartman , Armand
Adams , as attorney for Mr . and Mrs . Frear ,
HARTMAN - VARIANCE APPLICATION - 333 CODDINGTON ROAD
Mr . Soyring read the legal ad as published in the Ithaca
Journal for this and the following two cases .
Mr . Hartman had been denied permission to conduct a small
business in his home under Article IV , Section 12 of the
Zoning Ordinance . Mr , Hartman presented a letter from his
doctor stating that he consider conducting a business in
his home ( such as a ceramic studio ) due to the fact that his
health is such that he cannot be gainfully employed outside
the home . Mr . Soyring pointed out that this proposed
business would not create any traffic hazards .
The following restrictions on such business were suggested :
1 . The maximum use of said business would be 800 square
feet to be devoted to a ceramics enterprise .
2 . The hours in which said business could be operated
would be 10 : 00 A . M . to 9 : 00 P . M . and not on Sundays .
3 . The house is to be used primarily as the Hartmants
personal living quarters .
4 . There shall be no outside display other than a
sign of a maximum size of 4 square feet , which sign
may be illuminated , but no other illumination shall
be permitted in the area .
5 . This variance is granted ^personally to Mr . David
Hartman and shall continue only as long as Mr .
Hartman personally operates the business and
resides in the dwelling .
FINDINGS OF FACT :
1 . The proposed use does. not create a traffic hazard .
2 . The proposed use is in harmony with the neighborhood .
3 . The situation is unique .
4 . There is a physical hardship .

5 . The proposed use is in keeping with the spirit of
the Zoning Ordinance .
6 . The variance is granted subject to the 5 restrictions
listed above .
Upon motion by Mr . Sovocool , seconded by Mr . Tilton and
carried by unanimous vote , the foregoing findings of fact
were adopted and the variance granted subject to the
restrictions set forth .
No persons appeared in opposition of the foregoing and Mr .
Soyring stated that he had no telephone calls- in opposition .
WEST� HILL CEMETERY ASSOCIATION - SPECIAL APPROVAL - HAYTS &
TRUMANSBURG. ROADS .
Loran Marion had been requested to go back to the Association
to obtain certain precise information with respect to the
cemetery .
Mr . Armand Adams stated that Mrs . Frear is the donor of this
land and that she is hopeful that the Zoning Board will not.
put restrictions on the land in order that she may give
something to the cemetery in the future ( such as a fence or
chapel ) . Mr . Marion stated that this was also expressed
at the West Hill Cemetery Association meeting .
It was pointed out that in granting this approval , it is the
intent of the Zoning Board to restrict the area to a memorial
or burial park .
It was stated that no headstone monuments , grave markers or
plaques shall be installed above the surface of the land
except that a receiving vault , chapel or other building
necessary to the cemetery may be erected . There may also
be p�.laced. or erected any fence , enclosure , or gateway
bounding the cemetery . No structure in the cemetery shall
b_e more than one story in height or .to exceed 400 square
feet .
Upon motion by Mr . Powers , seconded by Mr . Tilton , and .
carried by unanimous vote , it was moved that tie Special
Approval be granted subject to the restrictions set forth
above . Mr . Marion left the room during the voting and did
not participate in the vote .
SOYRING - VARIANCE - 847 TAUGHANNOCK BOULEVARD
Upon the Board ' s request at its last meeting , Mr . Soyring
presented a revised plot plan for the erection of a two -
story dwelling at 847 Taughannock Boulevard . Mr . Soyring
pointed out that the 30 -foot setback from the highway is

the average set -back in the area , and the two houses on the
lot are 50 feet apart from their nearest points .
Mr . Soyring requested a variance to erect a house 10 feet
from the side lot line with a 5 foot porch . Upon motion by
Mr . Sovocool , seconded by Mr . Robert Powers and carried by
unanimous vote , based on the Submission of a new plan showing
a different location of the building , that Board moves to
grant the following additional variance : That no part of the
structure shall be closer than 5 feet from the southerly
line of the property . This variance is granted on a finding
that the building must be placed in this position due to the
steep topography of the lot .
This meeting was c.djourned at 9 : 45 P . M .
