TOWN OF ITHACA
ZONING BOARD OF APPEALS MINUTES
June 21 , 1966
A meeting of the Town of Ithaca Zoning Board of Appeals was
held at the Town Offices , 108 East Green Street , City of
Ithaca , at 7 : 30 P . M . on Tuesday , June 21 , 1966 .
Members of _ the Board present were : Chairman David Powers ,
C . A . Tilton , Robert Powers , Zoning Officer Anselm E . Soyring
and Secretary Cheryl S . Beninati ..
Also present were : Loran Marion , Vincent Franciamone , Murray
Lewis , Attorney for V . Franciamone , and Maurice V . Marion .
The minutes of the May 17 meeting were read and approved
after the following amendment : The phrase 1150 feet " referred
to in the first paragraph of the Livesay appeal was modified
to read 1125 feet within the right of way of the road . ,,
FIRST CASE : LORAN MARION — SPECIAL APPROVAL
A Public Hearing was called to order at 7 : 35 P . M . Zoning
Officer Soyring read the legal ad as published in the Ithaca
Journal .
Mr . Marion had originally requested a permit to remove top
soil from his property located near Burtt Place ( within
the vicinity of the Lehigh Valley Railroad and an abandoned
road ) . He was turned down under Article 8 , Section 70 which
relates to the extraction of natural products .
Mr . Marion submitted a sketch on the reverse side of his
application for special approval by the Zoning Board of
Appeals , and he pointed out that the area ( 1501 X 2001 )
will be re -graded after the top soil is removed .
Findings of Fact :
This application meets all applicable provisions of Section
77 , paragraph 7 ( a-f ) relating to special approval grants by
the Board of Appeals .
Upon motion by Mr . Robert Powers , seconded by Mr . Tilton ,
and carried by unanimous vote , the foregoing findings of
fact were adopted and Mr . Marion granted special approval to
remove top soil from the area .

SECOND CASE : VINCENT FRANCIAMONE - 108 RIDGECREST ROAD -
VARIANCE
A Public Hearing was called to order at 8 : 15 P . M . Zoning
Officer Soyring read the legal ad as published in the Ithaca
Journal .
Mr . Franciamone appeared before the Board requesting a variance
after denial of a building permit to build a subordinate
apartment at 108 Ridgecrest Road , which permit was denied
due to the fact that the side -line requirement of 40t ( R- 30
Zone ) was not met ( 30 + available to Franciamone ) . Mr .
Franciamone had obtained a building permit in 1963 to construct
the orginal house and carport , which he erroneously assumed
to still be in effect for this subordinate apartment . It
was pointed out that Mr . Franciamone ceased construction when
he was informed of this Error . Mr . Franciamone submitted
a letter to the Board from Mrs . Mary A . Kapp , 106 Ridgecrest
Road , in which she stated that shelas no objection to the
proposed subordinate apartment in that she felt the same
would be an asset to the area .
After discussion and review by the Board , it was found that
at the time this area was zoned R- 309 this was a non- conforming
lot size . However , upon motion by Mr . Tilton , seconded by
Mr . Robert Powers , and carried by unanimous vote , the Board
deferred any decision in this matter until consultation with
Roger B . Sovocool , Attorney .
This meeting was adjourned at 9 : 20 P . M .
