TOWN OF ITHACA
ZONING BOARD OF APPEALS
May 17 , 1966
A meeting of the Town of Ithaca Zoning Board of Appeals was
held at the Town Offices , 108 East Green Street , City of
Ithaca at 7 : 30 P . M . on Tuesday , May 17 , 1966 .
Members of the Board present were : Chairman David F : Powers ,
William S . Scott , Jr . , Roger Sovocool , Zoning Officer Andy
Soyring , and Secretary Cheryl S . Beninati .
Also present were : Mr . and Mrs . G . R . Livesay
LIVESAY APPEAL - SNYDER HILL ROAD - FIRST CASE
A Public Hearing was called to order at 7 : 35 P . M . Chairman
Powers explained to the members of the Board that Mr . and
Mrs . Livesay had been denied a building permit to build a
garage within 50 feet of the right of way of the road . The
members of the Board studied a sketch of the property , with
the proposed garage , and arrived at the following
FINDINGS OF FACT :
1 . The denial of the building permit arose through
misinterpretation of the Zoning Ordinance - there
was no Town Zoning_ Officer at the time tD guide the
applicant in applying for the building permit .
2 . At the time of application for the building permit ,
the applicant did not know the width of the right
of way of the highway .
Upon motion by Mr . Sovocool , seconded by Mr . Scott , and
carried by unanimous vote , the findings of fact were
adopted and the appeal granted . This public hearing was
adjourned at 7 : 40 P . M . Note : No persons appeared in
opposition to the foregoing.
SOYRING VARIANCE APPLICATION - 847 TAUGHANNOCK BLVD . -
SECOND CASE
A Public Hearing was called to order at 7 : 45 P . M . Chairman
Powers explained to the Board members that Mr . Soyring had
been denied a building permit to build a two -family dwelling
on a one -family dwelling lot . As of May 12 , Mr . Soyring
made application for a variance to build said two -family
dwelling and also for a set -back of 15 feet instead of 25
feet from the road for said dwelling . After studying the
sketch presented by Mr . Soyring , the members of the Board
arrived at the following :

FINDINGS OF FACT .
1 . The set -back request of 15 feet is more than the
average set -back to the north and south of this
property .
2 . The topography is difficult upon which to build
because the land drops off sharply to the east .
3 . Mr . Soyring cannot make a reasonable use of his land
due to its peculiar size and shape .
4 . The proposed building does comply with side line
requirements and depth of lot .
5 . The combined areas of the two buildings will not
exceed the 20% 'land use requirement .
6 . The proposed building complies with Section 68
of the Town of Ithaca Zoning Ordinance .
70 There will be ample parking space , and there will
be no traffic hazard created by the building or
, the proposed use .
80 The proposed building is a two -family dwelling .
Upon motion by Mr . Sovocool , seconded by Mr . Scott and
carried by unanimous vote , it was moved that the findings of
fact be adopted and that a variance be granted to build- the
proposed building and that the building be built no less than
15 feet from the right of way .: line . Note : No persons appeared
in opposition to the foregoing .
This hearing was adjourned at 8 : 00 P . M .
