TOWN OF ITHACA
ZONING BOARD OF APPEALS
NOVEMBER 3 , 1965
Members present were : Acting Chairman Robert Powers , Roger
Sovocool , C . A . Tilton , William S ; Scott , Jr . and Zoning
Officer Robert J . Wells .
The meeting was called to order at 7 : 30 P . M . by acting
Chairman Robert Powers .
A . J . MASTERMAN CASE - 124 JUDD FALLS ROAD
The public hearing opened at 7 : 40 P . M . The Zoning Officer
presented proof of publication of legal ad . The application
and apeal of A . J . Masterman , 124 Judd Falls Road was
presented by Zoning Officer . Mr . Masterman ' s lot on Judd
Falls Road is of a non- conforming character in that it is
too small ( 60 X 120 ) whereas the Ordinance requires 100 X 150 .
The house thereon is approximately 50 years old and generally
the premises are average and in keeping with the area , i . e . :
set -back , yards , landscaping , etc . Mr . Masterman is applying
for the special approval required in order to add a room to
the rear of the house . The rear yard is approximately 401
deep ; the addition would not extend out to either side of
the house and because of being built partially in a " jog "
in the rear wall line of the house , it would extend only
about 4 ft . into the present rear yard . The addition will
add a downstairs bedroom and bath to convenience Mrs .
Masterman who is under doctor ' s orders not to climb stairs
or otherwise exert herself due to recent serious illness .
The addition will be built by Burr Ripley and cost approximately
84 , 500 . 00 .
The Zoning Officer advised that all adjacent neighbors had
been notified by post card of this hearing and , according
to Mr . Masterman who had contacted them personally , none
had objections to the proposed construction .
No persons having appeared for or against the proposal ,
and in view of the facts tnat the proposal would not in any
way alter , harm or depreciate the neighborhood character
or uses , and would be in harmony with the general purpose
of the Ordinance , and that the premises are adapted to the
proposed use and no harmful effects on traffic loads ,
safety or health or welfare of the community would be
anticipated , it was moved by Mr . Scott , seconded by Mr .
Tilton and approved by unanimous vote , that the requested
special approval be granted .
The public hearing was closed at 8 : 05 P . M .

SEVILLE REULEIN DECISION
In other business , it was noted by 2 Board members that
Mr . 6 . Reulein , who now has a pending case before this
Board involving Hi -Rise Multiple Residence proposed for his
Property on the Trumansburg Road is desirous of receiving
a decision in this matter from this Board as soon as possible .
It has been the understanding of the Board and the Zoning
Officer ( information from Attorney Robert Hines and from
Robert Burns ) that the subject application was to -be
formally withdrawn by letter . This letter not having been
received to date and to honor Mr . Reulein ' s request ( actual
applicant ) .
This Board by copy hereof , notifies interested parties
that it is their intent to render a decision in this matter
at their next meeting , the date of which is unknown at this
time but which will be published when known . The Northwest
Civic Association and the actual parties at interest in the
matter will receive post cards upon the setting of the above
date .
SURVEY AND SUMMARY - ZONING BOARD ACTIVITIES
The Zoning Officer presented a survey and a summary thereof
regarding the Zoning Board of Appeals activities over the
last 5Y2 years . The Board requested that copies of this
be made available to Mr . Robert Powers and Mr . Roger
Sovocool to assist them in committee activity and study
of general zoning and Board problems and to assist in
reporting Board recommendations to the Town Board , as
requested , on Zoning and Town Policy in general . There
being no - other business before the Board , the meeting
was adjourned at 9 : 10 P . M .
