TOWN OF ITHACA
ZONING BOARD OF APPEALS
SEPTEMBER 149 1964
A meeting of the Town of Ithaca Zoning Board of Appeals was
held at the Highway Building on Monday September 14 , 1964 .
Members of the Board present were : Chairman David Powers ,
William Scott , Jr . , Robert Powers , Attorney Roger Sovocool
and Zoning Officer Robert J . Wells , Absent : C . A . Tilton .
Also present were : Mrs . Lillian Keown , Secretary , Attorney
Richard Mulvey , Attorney Edward Abbott , Mr . and Mrs . Charles
Ayers , Mr . L . Grey and Mr . and Mrs . I . Blumen .
FIRST CASE : Called to order at 7 : 45 P . M . This is a
con inua ion of the Grey vs . Ayers hearing adjourned from
8/10/64 . Mrs . L . Keown , Secretary was again present to record
testimony , which record again_ is separate from and in add -
ition to these minutes .
After hearing all evidence for or against in the matter of
the boat house in question and upon motion by Chairman
Powers , seconded by Robert Powers and unanimous vote , this
hearing was adjourned to an unspecified date for the purpose-
of allowing time for each Attorney to present summations ,
tentative proposed findings of fact , etc . to this Board
for their consideration .
The Board also decided to review the prop-erties in person
before the next hearing date . The Zoning Officer was directed
to set up the next meeting and advise all concerned , upon
receipt of all information required to continue the case .
SECOND CASE : Called to order by Chairman Powers at 9 : 30 P . M .
and bel'E'gan application to remove an existing closed porch
from the Blumen residence . at 122 Warren Road and replace it
with somewhat larger living quarters as shown on the application .
Permission was denied under provisions of Article XII , Section
54 in that the lot width is under the required minimum
and the proposed new construction would be within 8 fte of
the southeasterly Blumen lot line . The Zoning Officer
. read proof of publication .
In testimony before the Board , Mr . Blumen indicated that the
proposed construction was necessary because his family is
growing up and their present quarters are not adequate .
The terrain in this location is very difficult , in that
the land drops away from road grade very sharply and the
northerly portion of the land consists of a deep ravine ,
upon the edge of which the northerly end of the house is
now located . This limits possibility of any construction
to the southerly end of the premises as shown . . This portion
of the lot is well buffered and screened from- adjoining

property by shrubs and large trees which will be left intact
and will minimize any effect on other property .
The Zoning Officer indicated that notification of hearing
had been sent to area residents , but no persons appeared
to object to the proposal . The Zoning Officer presented
pictures of the dwelling and area involved ,
After review of all . evidence and testimony and in view of
the following findings of facts , upon motion of Chairman
Powers , seconded by Robert Powers and unanimous vote , the
Board approved the application for variance as requested :
1 . Proposed will not change the character of the
dwelling in question or the neighborhood .
2 . Hardship and practical difficulty both exist in
that the lot contains little - usable area because of the
difficult topography and unique situation that exists .
3 . Approval of this proposal in harmony with intent
and purpose of the Ordinance and there will be ' no detrimental
or depreciating effect on the area .
The meeting was adjourned at 10 : 30 P . M .
