ZONING BOARD OF APPEALS
APRIL 149 1964
A special meeting of the Town of Ithaca Zoning
Board of Appeals was held at the Highway Building on
Tuesday April 14 , 1964 at 7 : 40 P . M .
Members of the Board present were : Chairman Powers ,
William S . Scott , Jr . , C . A . Tilton , Roger . Sovocool and Zoning
Officer Robert J . Wells .
Also present were : Mr . V . Bagnardi , Architect ,
Reverend Lareva , Mr . Rodriguez , Mr ._ H . Weart , Mr . and Mrs .
J . DeWire and Mr . P . Hartman .
FIRST CASE : Chairman Powers called the meeting to order at
P . M . The Zoning Officer was directed to read the applic -
ation for a building permit , the appeal from denial of same
and to present proof of publication of the notice of public
hearing as published in the Ithaca Journal April 8 , 1964 .
So done , the issue being heard being a request for variance
to Section 69 of the Ordinance which prohibits auto parking
in front yards . This proposal , being shown on site plan
dated 1/7/ 64 , filedl. with the Board , locates approximatley
1/3 of the parking lot in front of the front building line
of the Church building . The necessity for this particular
parking location was shown to have been as a result of plot
contours , wet areas being unusable for building location
or parking , septic field location and the future need for
additional building and parking area construction . The
parking .now proposed is considered to be the minimum amount
of area required to handle the expected volume of autos
and eliminate all necessity for roadside. parking . The
Church building proper is to be located in excess of 200
feet from the street and the portion of the parking lot
in question , in front of . the building line of the Church ,
will be 175 feet from the street . These aforesaid facts
presented as establishing uniqueness and hardship as required
in order that the Board might grant the parking variance .
Photos of the site and of a Church building of the same
size and design were shown in answer to questions of area
residents present .
There being no objections to this proposal from
any persons present , or in writing , and after having heard
a summary of the facts as , presented previously in the
meeting , as outlined by Mr . Sovocool , a motion was made
by Mr . Scott , seconded by Mr . Tilton and unanimous vote of
the Board approved the granting of the requested variance
" Moved that the requested variance for a parking lot to be
located as shown on plot plan by Victor Bagnardi , Architect ,

dated 1/7 / 64 be granted .. This decision , after determining
that a unique situation exists on the plot and that hard -
ship is encountered in that there is a definite need to
develop off - street parking for this use for the general
welfare and safety of the area , and that the actual conditions
of the plot ; that is , contours , water problem , septic field
location , location of the building itself and the .- need
to retain space for future additions , in themselves , auto -
matically locate the parking area , and that the plan is in
harmony with the character of the neighborhood and will
have no detrimental effect on the area .
The meeting was adjourned at 8 : 30 P . M .
