ZONING BOARD OF APPEALS
AUGUST 209 1962
A meeting of the Town of Ithaca Zoning Board of
Appeals was held in- the Town Highway Building on Monday ,
August 20 , 1962 at 7 : 30 . P . M .
Members of the Board present were : Chairman
David F . Powers , Constance E . Cook , Robert N . Powers ,
William B . Norton , and William S . Scott , Jr .
Also present were : Zoning Officer Robert J . Wells ,
Supervisor Ben V . Boynton , Stanley Tsapis , Richard Berggren ,
Wallace Martin , and the following area residents : R . B . Child ,
Mr . and Mrs . Stump , Mr . and Mrs . Greene , Phillip Allen ,
Mr . and Mrs . Spencer , Elizabeth Laughlin , Mr . and Mrs . Walter
Andrews , Mrs . Faye Allen , Betty Graves , Mr . and Mrs . Wooley ,
Will Beruninger , Ralph Todd , Sam MacNeil , and Nora Dodd .
The adjourned hearing on the appeal of Richard
Berggren in regard to the decision of the Zoning Officer
denying permission to convert the basement of the former
Inlet Valley School into a shop for the repair.. and sale of
lawn mowers was called to order . The minutes 'of the last
hearing were read and a motion was made by Robert N . Powers
that these minutes be approved . Seconded by William B .
Norton and carried .
Mr . . Berggren stated that worse nuisances are
permitted in this zone and that Mr . Martin would make a
good tenant .
Comments were requested from area residents
who were present .
Mr . Stump - Support Mrs . Stump ' s statement of last
week . Dislike piece -meal zoning and feel that property values
increase in a residential zone . .
Mr . . Tsapis - pointed out that Mr . Martin could
operate his business if he lived in the building .
Mrs . Spencer - One variance will lead to another .
Don ' t want commercialization , want to remain and develop
as a residential area,,
Merle Greene - Opposed to granting the variance .
Sooner or later fix-it shops gather scrap and this business
would not enhance the Southern entrance to this residential
area .
Mrs . Greene - Traffic is a hazard now with school
buses having to stop on blind spots . We don ' t need any
more than we already have .
Mr . Allen - Zoning -Board of Appeals has certain
obligations to the Town Board and to the townspeople . There
are three factors which they must find in order to grant a
variance .
1 . It must be unique .
2 . It must not change the existing character of
the neighborhood .
30 . Owner can not realize . a fair return for his
investment . .
Don ' t believe that the Board can make these findings . Am
against granting this variance .
4esidents entered their vote , for or opposed' , and
all were opposed except Nora Dodd who had no opposition . . She
felt it was much less objectionable than many other uses .
A motion was made by Robert N . Powers and seconded
by David F . Powers that the . applicatioh by Mr . Richard
Berggren not be granted . Ayes all . Carried .
Hearing adjourned at 90. 00 P . M .
A motion was made by . Constance E . Cook that the
Town of Ithaca Zone Map be . corrected to show accurately the
northeast boundary of the . Light Industrial zone at the
intersection of Five Mile Drive and Elmira Road . Seconded
by William B . Norton .
A motion was made by William S . Scott to amend the
motion by Constance E . Cook to read " that the Town of Ithaca
Zone Map be corrected to show accurately all zoning boundaries
in the Town of Ithaca and that the map be printed to scale
of one inch to one -thousand feet . Seconded by William B .
Norton and carried .
Ayes all on the original motion by Constance Cook ,
Carried .
A discussion took place on the proposed amendment
of Article IX of theTown of Ithaca Zoning Ordinance . Thee
Board gives its approval of the amendment on the basis that
the Planning Board has already been empowered by the Town
Board to make reasonable changes in the requriements of the
Zoning Ordinance . This amendment only makes reference to
that power in the Zoning Ordinance . The Zoning Board of
Appeals has no objection on this basis .
After discussion , th EBoard stated that they had
no objections to the proposed amendment of Section 75 of the
Town of Ithaca Zoning Ordinance .
After discussion , the Board stated that they had
no objections to the re - zoning of the area at Shady Corners .

After dicussion of the Housing Code Applicable
to Mobile Homes , a motion was made by Constance E . Cook to
approve the adoption in principal of the Mobile Home Housing
Code . We strongly urge that the Zoning Ordinance be amended
to make proper provision for mobile homes . Sednnded by
William B . Norton and carried .
