ZONING BOARD OF APPEALS

A meeting of the • Zoning Board of Appeals was held
at the Town Highway building on Monday , July 9 , 1962 at 8 : 00 P . M .
Members of the Board present were : Chairman David F .
Powers , Constance E . Cook , Robert N . Powers , William B . Norton ,
William S . Scott , Jr .
Others present were : Robert J . Wells , Zoning
Officer , Roger Armstrong of Koppers Company , Inc . , Mr . Golder ,
City Building Commissioner , and the following residents from
the area surrounding Koppers Company , Inc . :

This is an appeal signed by Roger Armstrong of.
Koppers Company , Inc . for special approval , extension of a
non- conforming use , in regard to the decision of the Zoning
Officer denying permission to extend the office space at the
Vine and Mitchell Street plant . Permit was denied under
Article XII , Section 54 , of the Town of Ithaca Zoning
. Ordinance . Proof of publication w =..s presented .
Mr . Wells presented a drawing of the pr000sed extemr-
sion to the Board .
Comments were requested from the neighbors present .
Bruska - concerned about any kind of extension of this non-
conforming use .
Golder - Isn ' t it true that a State law provides that any
change or variance within 500 feet of the City4Town line
requires that the City be notified ? Was this done ?
Wells - No .
Golder - We are going to have , repeated requests for extensions
while Koppers is in this location . The Town should meet with
Koppers7ito discuss the possibility of re -location .
Kitzburg - Consider the hardships on the residents . Head -
aches are caused by the toxic odors .
Terwillegar second Mr . Kitzburg ' s sentinents . Speak also
for Mr . Knowles who could not attend tonight . Also theret. is
a great problem with the noise and dust .
Wolf - Trucks swing over on the shoulder causing severe dust
problems . Must close front of house due to dust .
MacDonald Could applicant supplement appeal ?

Armstrong - Office is • crowded , working conditions are cramped .
We would like more rood,. There will be no increase in the
number of employees or business expansion .
Mac Donald - Each ' extension ': paves the way for further extensions .
Hemming - When an appeal was granted to Koppers some time
ago , they specifically stated that there would be no further
requests if the appeal was granted . This was definitely put
in the minutes of that hearing .
Cook - Koppers has not . carried out the regulations stipulated .
However , the Zoning Board cannot enforce .
Terwillegar - Why don ' t they re -locate ? Mr . Boynton says
that the Town has a place for them elsewhere .
Cook - Some actions are against the law . Neighbors should get
together . Koppers can only legally do what they were ddLng
in 1954 .
Bruska Complaints , although not alwa ys carried through by
the residents , often fall on deaf ears .
Hemming - They have filled in part of the land giving them
more room to park trucks .
A motion was made by Robert Powers and seconded
by William Scott that the application of Koppers Company ,
Inc . for special approval to extend their office space be
denied . Ayes - Powers , Cook , Powers , Norton , Scott .
Noes - 0 . Carried .
A motion was madekby Constance Cook _and seconded
by William B . Norton that the Zoning Board of appeals request
the own Board to take every legal step within its power to
obtain strict enforcement of the Zoning Ordinance with
respect to the premises iiiquestion , in view of the evidence
given tonight of possible violations of the Zoning Ordinance .
Secondly , that the official agencies of the Town
endeavor to make every effort to assist Koppers Company , Inc .
to re - locate within the Town of Ithaca . Ayes - Powers ,
Cook , Powers , Norton , Scott . Noes - 0 . Carried .
