The adjourned meeting of the Zoning Board of
Appeals of the Town of Ithaca was held on December 4 , 1959
at 5 : 15 P . M . in the Tompkins County Court House in the City
of Ithaca . Members present were : Aldus Fogelsanger , tem -
porary chairman ; David Powers , Robert Powers ; and Constance
E . Cook , secretary .

John Burns , Sr .

James O ' Connor
H . S . Eighmey
Mr . O ' Connor , on behalf of Mr . Eighmey , answered
certain questions which had been raised at the previous
hearing .
He stated that the first floor of the building
only would be used for the restaurant . The se." ond floor
would be used as a residence for Mr . Eighmey and possibly
later for an employee ' s family . He stated that no rooms
would be rented to tourists .
Mr . Eighmey stated there would be no " stands up "
bar . Only a bar to service the dining room and the lounge
would be available . He stated that the " sale of liquor "
would be incidental to the sale of food .
Mr . Eighmey further stated that he expected to em-
ploy six . or seven employees and. that the restaurant would
be open only during the dinner hour about 4 P . M . to 9 P . M .
Later he might open for lunch and extend the closing to
10 P . M .
Mr . Eighmey stated he would not set up any neon
or flashing lights . He expected only to flood - light the
house and erect a small lighted sign .
Mr . John Burns stated that the house had been listed
at 535 , 000 , and was being sold at a somwhat lower price .

Mr . Dean Davis stated that he felt that any
variance should be limited to " Sunny Gables " and should
carry a provision voiding the variance in the event of a
violation .
After discussion , Mr . David Powers moved that the
variance be granted on the following conditions .
1 . Diagrams showing access drives , parking area ,
service area , lighting , signs , location of bar ,
and trees and hedges be attached to and made a
part of the application .
2 . No tourist accommodations or room rentals to the
public to be permitted .
3 . No bar for the service of alcoholic beverages
shall be located in the public areas .
4 . The permit and variance would be null and void , in
the event that any of the above conditions were
broken or held to be invalid or the use of land and
buildings did not conform to uses set forth in the
application and the diagrams attached thereto .
5 . A copy of the order of the board granting the vari -
ance be filed in the Miscellaneous Records of the
Tompkins County Clerk ' s Office .
Mr . Robert Powers duly seconded the motion . The
Board unanimously adopted the motion . There being no other
business , the meeting was adjourned .
