Zoning Board of Appeals of the Town of Ithaca .

The meeting of the Zoning Board of Appeals of the Town
� of Ithaca was held on August 12 , 1959 at 5 : 15 P . M . in the
Tompkins County Court House in the City of Ithaca as was
advertised in the Ithaca Journal on August 10 , 1959 . Mem-
bers present were : William Rolston , chairman ; David Powers ;
and Robert Powers . Others present were : Ben Boynton , Zoning
Officer ; and Frank Liguori , S . L . Boothroyd , C . Shaw , applicants .
The chairman called the meeting to order and stated that
the first . bfcbusiness was to consider the petition of
Frank Liguori for a request for variance in a proposed lot
size which is less in depth than minimum allowed under
Section 9 of the Zoning Ordinance . The premises affected are
at 104 Bundy Road , Ithaca , New York .
Mr . Liguori stated that he wishes to purchasethe corner
lot in front of his own home to protect the lake view ; and
may , at sometime in the future , wish to build on that lot .
After discussion by the board , the following resolution
was adopted unanimously , upon motion duly made and seconded .
WHEREAS , the distance between the houses is still sub
stantial , and neighbors on both sides of the property in
question have signed Mr . Liguori ' s petition indicating no
objections , and
WHEREAS , the variance applied for is in general accord
with the spirit of the ordinance , the public safety and wel
fare will be served and substantial justice will be done if
said variance is granted , and consideration having been given
to the promotion of health , safety , morals , and general wel
fare of the community in harmony with the purpose of the ordi -
nance , be it -
RESOLVED , that the variance applied for be and is hereby
granted , and an order to said effect shall be� entered in the
office of the Town Clerk .
The next item of business was to consider a petition of
Carlton Shaw for a variance of the zoning ordinance . The
petition had been denied by the Zoning Officer under Section
7 of the Zoning Ordinance . The premises affected are at
14.85 Trumansburg Road ; and the petitioner would like to move
an existing lot line 10 feet , leaving one 90 foot lot and one
100 foot lot , instead - of two 100 foot lots .
Mr . Shaw stated that if this lot line could be moved ,
it would permit better location of driveways to the two lots .
He further stated that if the variance is not grated , he will
have to dig up one existing septic system .
After discussion , the board adopted the following resolu -
tion unanimously , upon motion duly made - and seconded :
WHEREAS , there world be unnecessary hardship if the said
variance were not granted , since one existing septic system
would have to be dug up , and no objections having been raised
by the neighbors , and
WHEREAS , the variance applied for is in general accord
with the spirit of the ordinance , the public safety and
welfare will be served , and substantial justice will ' be done
if said variance is granted , and consideration ha ing been
given to the promotion of the health , safety , molls and
general welfare of the community in harmony with the purpose
of the ordinance , be it
RESOLVED , that the variance applied for be and is here -
by granted , and an order to said effect shall be entered
in the office of the Town Clerk .
The last item of business was to consider the petition
of S . L . Boothroyd for a request for variance to build a
residence on a lot of less than the stated minimum width
at the average front yard setback in the Preamble of the
Zoning Ordinance . The premises affected are - at 311 Roat
Street ,
Mr . Boothroyd stated that he now has 30 foot access
to the street for one lot , and wishes to split the street
access in half to provide access to a second lot .
There were no reasons stated in support of the proposed
change . A reason stated against the change was that the
owner , Mr . Boothroyd , had. created his own situation , and
the granting of this request f or * variance may be starting
a precedent .
The meeting was adjourned , so that members of the
board might visit the site in question .
