Zoning Board of Appeals of the Town of Ithaca
April 27 , 1959 .

The adjourned meeting of the Zoning Board of Appeals of
the Town of Ithaca was held on April 27 , 1959 at 5 : 15 P . M . in
the Tompkins County Court House in the City of Ithaca . Mem -
bers present were . William Rolston , chairman ; Aldus Fogel -
sanger ; Robert Powers ; and Constance E . . Cook , secretary .
The chairman called the meeting to order and stated that
the purpose of the meeting was to consider further the petition
of Archie Coggshall for special approval of extension of a
non- conforming use .
Nr . Coggshall presented plans for screening , pursuant
to requests made at the April 13th meeting . He also amended
his original building plan to show a lower structure with the
appearance of a residence . Considerable discussion took place
concerning the new plans after which the following resolution
was duly made and seconded .
WHEREAS , the applicant needs the additional room for his
business , and the building will be low in height and residential
in character , and there will be no noise or odor connected
with the new operation and the additional traffic will be
slight and safety factors will be improved by the removal of
truck traffic from Eastwood Avenue , and
WHEREAS , in view of the above stated facts , there are
practical difficulties and unnecessary hardship in carrying
out the strict letter of Section 21 and -
WHEREAS , the variance applied for is in general accord
with the spirit of the ordinance and the public will , safety
and welfare be served and substantial justice will be done ' is
said special approval be granted , be it
RESOLVED , that the extension applied. for be and is hereby
granted upon the following conditions :
,... ... 1 . Use of the new building for purposes other than resi .
dence shall be limited to the refining of beeswax - and the .
manufacturing of wax products and candles during the lives
of the present owners , Archie and Vera C . Coggshall and their
son and daughter - in- law , William L . and Josephine S . Cogg -
shall ,
2 . All supplies , materials , equipment and containers
belonging to the applicant , Wax Workers , Inc . , its suppliers
and customers will be stored inside or screened from view ;
3 . No deliveries or pick -ups will be made from Eastwood
Avenue except when weather conditions make other access im-
possible ,
4 . Portions of the buildings and all outside storage
areas shall be screened .
( a ) by planting Austrian or Red- Pine trees not less
than five feet in height and spaced on ten0foot centers in
two rows , the front row alternating with the back row so that
the pines will form a visual barrier .
( b ) Where plantings are not feasible or effective ,
fencing shall be erected to form a visual barrier , be it
FURTHER RESOLVED , that an order to said effect shall be
entered in the office of the Town Clerk .
The motion was unanimously adopted by the board .
Mr . Boynton announced that the Holstein-Friesian Associa-
tion had withdrawn that portion of its application relating to
a variance in use . Mr . Boynton determined that the association
was a membership club and therefore it was entitled to build
its headquarters in a residential district under the terms
of the present ordinance .
There being no other business , the meeting was adjourned .
