Zoning Board of Appeals of Town of Ithaca

The adjourned meeting of the Zoning Board of Appeals
of the l own of Ithaca was held on April 139 1959 at 5 : 15 P . M .
in the Court House in the City of Ithaca . Members present
were : William Rolston , chairman ; Robert � Powers ; David Powers ;
Aldus Fogelsanger ; and Constance E . Cook , secretary . Others
present were : Ben Boynton , Zoning Officer ; Archie Coggshall ;
James Clynes , Esq . ; and Dr . and Mrs . Thorsland , neighbors .
The chairman called the meeting to order and stated that .
the purpose of the meeting was to consider further the petition
of Archie Coggshall which was . presented at the April 6 meeting .
Mr . Rolston asked for comments . of the board members who
had visited the premises .
Mr . Robert Powers suggested a fance to screen the view .
Mrs . Thorsland wanted to know if it would be possible to
dig a cellar as the building would be very unsightly .
Mr . Clynes said Mr . Coggshall would be agreeable to
restricting the special approval to 1 ) candlemaking and
beeswax refining and 2 ) the life and use of the Coggshall
family .
The board then discussed the possibility of screening
and the motion was made and duly seconded that the meeting
be adjourned until a further date when landscaping sketch
could be prepared with descriptions .
The next business discussed was the appeal of the New
York Artificial Breeders Co - op Inc . , for permission to build
a house - type headquarters. for the Holstein .Friesian Association
upon Mitchell Street Extension . The Zoning Officer had found
that the proposed building would be in violation of sections
4 of the Zoning Ordinance relating to residence restriction .
7 of the Zoning Ordinance relating to rear line which would
be 16 feet instead of 20 .
9 of the Zoning Ordinance relating to minimum depth which
should be 150 feet instead of 60 feet on one side .
Upon examining the maps , the Board and the Zoning
Officer concluded that no variance was required. as to the
depth of the lot because it was laid out prior to the ef -
fective date of the ordinance .
After discussion , the board unanimously adopted the
following resolution , upon motion duly made and seconded :
WHEREAS , the variance relating to the rear line is in
general accord with the spirit of the ordinance and the public
will , safety and welfare be served and substantial - justice will
be • done if variance is granted , be it
RESOLVED , that the variance relating to the rear line be
granted and an order to said effect shall be entered . in the
office of the Town Clerk , and be it
FURTHER RESOLVED , that the variance relating to section 4
be tabled until further consideration can be given by the Zoning
Officer as to whether . the Holstein Friesian Association is a
Club and therefore permitted to build in a residential dis -
trict .
There being no other business , the meeting was adjourned .
