of
Zoning Board of Appeals of Town of Ithaca
October 15 , 1958 .

A meeting of the Zoning Board of Appeals of the Town
of Ithaca was held on Ocotber 15 , 1958 at 7 : 30 P . M . in the
County Court House , being adjourned from the meeting of
September 25 , 1958 , as advertised in the Ithaca Journal on
September 19 , 1958 . The members present were : William
Rolston ; chairman ; Aldus Fogelsanger ; and Constance E . Cook ,
secretary . Others present were : Thomas H . Parker , applicant ,
Albert Hoefer ; Dale Corson ; Robert Cott ; Mr . Foltman ; and Mr .
Silsbee , the prospective buyer of lot # 2 from the applicant .
The meeting was called to order by Mr . Rolston . The
application of Mr . Thomas H . Parker to subdivide a lo-t at
Northview Road , as discussed at the previous meeting was con-
sidered . The proposed lot would require a variance of Section
7 as there would not be enough front yard for Lot #land no
front yard for Lot #2 which would have an 18 foot wide strip
as access .
After hearing testimony and after discussion , the
board , upon motion duly made and seconded , unanimously adopted
the following resolution :
WHEREAS , the lot is over an acre in size , it has a
large area although a 60 foot frontage on Northview Road ; the
houses will be set back approximately the same distance as
other houses in the vicinity; the lots will harmonize with
development in the area ; subdivision plans previously filed
indicate that _ the area is large enough for four lots and the
present proposal for two would be preferable in the opinion
of the board and the neighborhood ; it is not likely that any
other use could be made of these lots because a gorge on the
west side would make it unfeasible to build an access road and
WHEREAS , the nature of the terrain of the lot in
question and the location of existing houses in t his area are
unique , the board is of . the opinion that its decision to grant
a variance in this case will not set a precedent in any way
as to similar applications in the future , . and

WHEREAS , all but one of the neighbors had no objections
to the development into two lots and that one neighbor stated
that he would . prefer a single development , and there are
practical difficulties and an unnecessary hardship in carrying
out the strict letter of Section 7 of the Zoning Ordinance and
WHEREAS , the variance applied for is in general ac -
cord with the spirit of the ordinance , the public safety
and welfare will be served and substantial justice will be
done if said variance is granted , and consideration having
been given to ' the promotion of the health , safety , morals
and general welfare of the community , be it
RESOLVED , that' the variance applied for be and is
hereby granted and an order to said effect shall be entered
in the office of the Town Clerk .

Meeting was adjourned and members attended a joint
meeting of the Zoning Board of Appeals of the Town of Ithaca
and the Town Planning Board .
